盗窃罪中的被害人同意

盗窃罪的客观构成要件是违反占有人意愿而转移财物的占有;相反,得到占有人同意而取走财物,就可以排除盗窃罪的客观构成要件。将被害人同意的一般原理与盗窃罪构成要件的具体特征相结合,能够强化刑法总论与各论之间的整合与协调,促进刑法教义学的纵深发展。运用"预设的同意"理论,可以有效回应ATM机等自助型机器类案件中的疑难问题:使用"伪币"从机器处取得财物的,构成盗窃罪;使用真币从机器处取得财物后又抽出真币的,构成针对真币的盗窃罪;非法使用他人的信用卡在ATM机上取款的,不构成盗窃罪;使用信用卡利用ATM机故障恶意取款的,构成盗窃罪。在盗窃陷阱的场合,应根据是否存在同意而区分既遂和未遂。按照"客观权限+审核义务"的标准来区分盗窃罪间接正犯与三角诈骗,体现了对被害人意愿的尊重。     

公司章程限制股权转让的合理性审查

公司可以通过章程限制甚至禁止股权转让,这是公司自治的表现。对于这些限制,除非违反了股东平等原则和损害了股东的核心利益,法院在实践中应予充分尊重,通过尽量合理的安排平衡相关股东和公司的利益,不宜简单地宣布其无效。

The strategic value of new university technology and its impact on exclusivity of licensing transactions: An empirical study

Commercialization of new university technology within the new product development process is an important tool by which established firms can expand their innovative capabilities. The strategic importance of the university technology to the firm, however, can vary considerably. An exclusivity agreement is a useful tool to protect the firm’s investment and help ensure that value is appropriated through the commercialization process. An empirical study of 66 technology transfer projects in the information and communications technology industry reveals that licensing transactions are usually secured by some form of exclusivity agreements when the product innovation enabled by the new university technology is new-to-the-firm or new-to-the-market and the firm’s perception of the strategic value of the new technologies is high.

Following the transfer of DNA: How far can it go?

The issue of DNA transfer is becoming increasingly important in crime scene situations, as DNA analytical techniques now detect tiny amounts. Whereas primary and secondary DNA transfers have been well studied, subsequent transfer steps have received much less focus. This study aimed to measure the detectability of a DNA source after multiple transfer events. Transfer of wet blood gave a full genetic profile well beyond the secondary transfer events on both cotton and glass substrates. Dry blood gave a full profile well beyond the secondary transfer events on glass only, but to a lesser extent than wet blood. Touch DNA only produced a full profile on the primary substrate on both cotton and glass, and detectable quantities beyond the secondary transfer event on glass only. Our results will contribute to a better understanding of the tertiary and subsequent transfer of DNA, which will allow for improved evaluation of the likelihood of alternative scenarios explaining why an individual's DNA was found at a crime scene.

International Policy Formation: The Development Of Restorative Justice Policy Within The United Nations

Restorative justice and its related terms moved from the background of ancillary sessions to the floor of the United Nations Congress. This article documents and discusses the transfer of local policy to the international arena using the UN forum and restorative justice as a case study. First, a historical timeline traces the three influential forces, (1) the United Nations forum, (2) the non-governmental organization (NGO) activities, and (3) the individual Member States’ activities, behind the restorative justice movement onto the UN agenda. An integrated modification of Blumer’s process of collective problem definition is used as a framework to analyze the policy formation. Finally, the context of how future researchers may make use of the process is analyzed by comparing the traditional research development framework to Blumer’s policy framework. A need for wide spread implementation and outcome evaluations are needed as the policy is implemented is among the key findings.

区际要素流动与产业转移相辅相成,劳动力流动和资本流动对产业转移的影响是相反的,劳动力流动很大程度上阻碍了一个国蒙内部的区际产业转移和产业结构升级.包括"泛珠三角"区域合作的"九省二方"在内的我国省区间的要素流动和产业转移存在劳动力流动规模大、趋势强、资本反向流动、产业结构趋同化等特点和问题.在劳动力和资本自由流动的情况下,要顺利实现"泛珠三角"区域内的产业转移,实现产业结构整体优化和协调发展,需要合理引导区际要素流动.     

农村土地承包经营权流转法律问题研究

《中华人民共和国农村土地承包法》的颁布实施,标志着我国农村土地承包经营权流转法律制度的正式构造。但该项制度仍有诸多方面需要加以改进、完善,其中包括土地承包经营权的生效应采用债权形式主义物权变动模式,转让中发包方的同意权应加以限制,取消对承包经营权抵押、继承的限制,规定股份合作权的流转方式,建立承包经营权流转的中介服务组织等。
