全球化一方面促进了世界的和平与稳定,另一方面也加深了国家、民族之间的鸿沟与矛盾,冲击着世界的安全,对我国也不例外。全球化使我国拥有了巨大的发展机遇,我国的国家实力将随之不断加强,但也对我国政治、经济、文化的安全提出了挑战。加大维护我国国家安全的力度,确保国家的利益已成为我们今后工作的重要内容。     

试论加快我国内外贸一体化进程

在我国流通领域,内贸、外贸分兵割据由来已久。随着改革开放的深化和市场经济的发展,客观上要求我们必须加快实行内外贸一体化经营与管理。加快内外贸一体化进程应制定长远规划从多个方面逐步推行,主要包括赋予内贸企业外贸经营权力、重视外贸企业组织创新、发展大型流通集团、加强复合型人才的培养等途径。     

The World on the Box: International Issues in News and Factual Programmes

A report on factual international programmes shown on UK TV in 2003 reveals that the total of hours broadcast is similar that of previous years. However, there has been a drop in the number of programmes on developing countries, and the definition of 'factual international' covers a misleadingly wide range - including game shows and travel programmes. The amount of developing country coverage on terrestrial TV is the lowest since the measurement began in 1989. Many serious programmes on developing countries are now shown exclusively on the new BBC digital channels. It appears that ITV is no longer fulfilling its public service remit to broadcast programmes covering 'matters of international significance and interest'. The proportion of foreign coverage in television news increased in 2003 across all bulletins, as a result of the Iraq war.     

公民环境权的生成与合理定位

公民环境权的合理定位与配置,对于保障环境法秩序的实现有着重要意义。本文试从公民环境权的生成问题入手,否定了公民环境权为环境行政权的“衍生形态”或“反射性利益”的错误认识,提出公民环境权作为一种人生而应有的权利,其法定化将对公民的“偏好”及环境行政权的合理化有重大作用。由此提出公民环境权并非“环境权私权化”的产物,而是天然地归属于一种社会性权利,这是由环境的物品属性决定的,同时也将对其权利的保护与救济产生重大影响。     

社区治理框架中的居民参与问题：一项反思性的考察

本文以治理模式与公民社会的依存性作为分析的理论依据,提出考察中国城市社区居民参与的另一路径。一方面,居民参与意愿和参与程度制约着社区选择何种治理模式;另一方面,选择何种社区治理模式对于促进或制约居民参与程度具有重要影响。通过对二者互动过程的考察,从中国城市社区建设的基本哲学假设、居民—社区关系的理念预设、动员居民参与的理想目标等方面对中国城市社区居民参与动员的策略做了若干反思。

本文从GDP相关指标(传统GDP、绿色GDP和人文GDP)的排名、综合国力排名、国际竞争力排名、经济强国指数排名、《财富》全球500强企业数量排名等多个视角对中国国际地位进行了比较全面的分析。其中,经济强国指数研究是我们在国际比较领域的新尝试,该研究借鉴了综合国力评估、国际竞争力评价和人类发展指数等相关研究的理论和方法,通过深入分析国际权威数据库,设计了一套比较完整的经济强国指标体系,并计算得出各级各层经济强国指数。     

新型环境伦理观对完善我国环境立法的影响

在市场经济条件下,经济利益与生态建设的矛盾已经日益呈现。本文拟通过对新型环境伦理观的介绍,并在分析我国现行环境立法基本状况的基础上,寻求这种伦理观与生态环境立法之间的关系,从而对完善环境立法体系,保护生态环境有所裨益。     

Hedge Funds, the Deutsche Börse Affair and Predatory Anglo-American Capitalism

Boardroom trouble at Deutsche Börse, the company that operates Germany's main stock market, has recently provoked an important debate about competing capitalist models. Werner Seifert, Deutsche Börse's ousted Chief Executive, was eager to portray himself as the innocent victim of aggressive Anglo-American investors who had bought into his company but failed to understand its traditional operating ethos. In this, he was ably supported by key figures within the ruling Social Democratic Party, who, in order to shore up the party's core support, had increasingly come to blame overseas hedge funds for the development of German corporate governance models which prioritised profits over jobs. I review the SPD's structural reading of the Deutsche Börse affair, whilst comparing it to an alternative interest-based reading. The latter allows me to focus more closely on the issue which, more than any other, led to Seifert's downfall: his refusal to bow to the expressed interests of his own shareholders by pressing ahead, against their wishes, with a hostile bid for the London Stock Exchange. Seifert's eventual removal foreclosed the possibility of an integrated London-Frankfurt stock market and, somewhat ironically given the SPD's response to the affair, as a consequence it also prevented the entry of London's highly capitalised institutional investors into the German market for corporate control. The actions of Deutsche Börse's overseas shareholders might still be seen as evidence of a predatory Anglo-American capitalism. However, their successful removal of Werner Seifert may well have been responsible for temporarily keeping other financial predators at bay.     

环境污染刑事案件中严格责任与推定原则问题探讨

污染环境刑事案件中对于行为人的主观过错以及客观行为与损害后果之间因果关系的认定存在着很大的困难.笔者主张严格责任原则不足取法,但应当采用过错推定原则认定主观过错.同时,在排除有罪推定的前提下,适用环境民事侵权诉讼中的因果关系推定原则,以使污染环境的犯罪能够得到及时有效的惩治,但也要进行严格限制适用.     

党务公开：发展党内民主的理论和制度创新

党的十六届四中全会《决定》首次明确提出逐步推进党务公开,这是党的执政理念的新突破和提高党的执政能力的新举措。党务公开是发展党内民主的内在要求,贯穿于党内民主建设的各个方面和环节。推进党务公开,进一步扩大了党员和群众对党内事务的知情权、参与权、选择权和监督权,成为新时期发展党内民主的理论和制度创新。
