论我国军事刑事管辖权的困境与出路——以涉外非战争军事行动为视角

在涉外非战争军事行动背景下,维护军事利益的价值目标与军事刑事管辖缺乏域外效力发生冲突。军事刑事管辖应坚持维护国家主权和军事利益原则、对等原则和国内法与国际法相统一原则,尽可能通过谈判,与他国签定建立在平等、互利原则基础之上的部队地位协定。我国军事刑法的属地管辖应扩展至武装部队所至地域或空间,应将外国军人、战俘以及特定形势下的平民犯罪纳入军事刑法管辖范围。

Managing visibility and differentiating in recruitment of women as leaders in the armed forces

Recruitment is one of the Swedish Armed Forces’ (SAF) main challenges today. Recruiting more women into the organization is one of the organization’s aims, as well as providing them with more opportunities for career development. The purpose of this article is to gain a deeper understanding of how female military officers perceive barriers and advantages on their way to higher leadership positions. A total of 10 women from a variety of backgrounds and positions in the armed forces were interviewed. Their ranks ranged from Captain to Colonel and they represented army, naval units and air force. The interviews were analysed using a Grounded Theory approach. The qualitative analysis resulted in two main themes: Supporting visibility of women as leaders and differentiation of women as leaders. The former concerns positive strategies on an individual and organizational level that support an increase in the number of female leaders in the SAF, and is a way of responding to political incitements and the SAF’s fundamental values. The second concerns ways how women are portrayed as different and divergent from the male standard. The suggested model may be valuable in recruitment, educational settings and leader development of high-level military officers from a gender perspective.

Peacekeeping from Oceania: Perspectives from Australia,New Zealand and Fiji

Abstract

This article gives an overview of the involvement of Australia, New Zealand and Fiji in peacekeeping operations with attention to motives, experience and ‘lessons learnt’. Australia and New Zealand have been strongly influenced by regional considerations and an understanding of good international citizenship. Fiji’s contribution has been determined less by regional considerations and more by its position as a small developing country whose peacekeeping activities bring economic benefits, although it could be argued that by providing a basis for extending military forces they have contributed indirectly to political instability. Police contributions have been increasingly important to Australia and New Zealand and they have advocated a stronger role for police in other situations around the world.     

Multinational cooperation: building capabilities in small air forces

European air power is represented by a variety of air forces, each equipped with different capabilities and facing different limitations. Developing the former and making up for the latter requires resources and finances and is not always possible within a national capacity. It may be particularly problematic for smaller air forces, especially with the trend of shrinking defence budgets and increasing costs of the newest technological achievements. This article investigates the idea of multinational cooperation in Europe as a way to make up for these shortfalls and build collective European capabilities. In doing so, it focuses on two states, namely Poland and Sweden as examples of small air forces. By choosing these countries as case studies it also provides an opportunity to investigate the different forms of multinational involvement existing within and outside a major military alliance, namely NATO. The article explores the participation of the Polish and Swedish Air Forces in several multinational initiatives and investigates how such involvement increases (or not) their capabilities.     

公安边防部队处置突发事件中的舆论引导探析

近年来,从公安边防部队辖区的现状和社会发展的趋势来看,在媒体高速发展的今天,特别是伴随着网络媒体的迅速崛起,公安边防部队已经处在了一个高度媒介化和舆论监督越来越受重视,以及公众知情权和参与意识空前提高的环境当中。面对突发事件,搞封锁消息、回避媒体、隐瞒真相或者以对抗的方式逃避舆论监督注定是行不通的。只有及时、有效、合理的进行舆论引导,重视网络舆论,积极地接受舆论监督,才能有效地化解危机,真正维护和树立好边防部队的形象。     

Japan’s new role in peace-building missions

Japan’s policy towards peace operations has been in a state of evolution. One of the issues on its peace operations policy was that the Japanese Government tended too much attention to possible tasks involving the Self Defense Forces (SDF). However, the Japanese society should consider the possibility of its participation in peace operations in the wider framework, such as multifunctional peace-building missions. In fact, the concept of peace-building is compatible with UN Millennium Declaration in 2000, and the Japanese Ministry of Foreign Affairs also recommends that peace-building should be included as one of the priority issues in Japan's new policy on Official Development Assistance (ODA). Meanwhile, Japan will be required to participate in peace-building with the framework of multinational forces as well as the United Nations in the current post-9/11 era, such as its current mission in Iraq.
