道德话语系统与压力型司法的路径选择

面对道德困境案件的日趋增多,司法之道德话语系统的社会意义得以凸现,法官往往需要将目光往返于法律话语系统与道德话语系统,充分反映民众的共同道德观,并自觉拒斥虚妄的民意诉求对司法的消极影响。当然,也使难办案件意义上的司法裁判被简缩为"冲击—回应"的被动过程,从而形成了一种基于外在压力影响但又需要慎重对待的压力型司法。如果现代司法放弃建立纯而又纯的法条主义之梦,而将道德话语系统融入司法的价值判断,那么压力型司法将在以道德论证弥补法律之确定性的裂缝以及以判决书说理制度增加司法判决的可接受性之方法选择中走出困境。     

迈向“言说”理性的法律会话推理

法律推理是理性的过程,具体而言是一种实践理性.法律实践是一种“言说”的实践,特别是在司法过程中,任何一个环节都离不开“言说”这种会话模式.法律推理的过程就是在法律会话实践中选择最适合结论的过程,它包括一定法律行为正当化的论证和相对于一定目的的最佳手段的确定.法律会话推理①正是从多主体“言说”角度寻找正当性的法律推理方法,是一种“言说着”的理性,其以话语为媒介,以法律当事人之间的会话沟通为方式,通过各方对话语意图理解找到解决问题的最佳行为方法,从而对推理结论进行正当性论证,这里的正当性建立在主体间性的基础上,因而具有主体间的可接受性和社会层面的合理性.     

霸权、话语建构、反极权主义:后马克思主义社会批判空间转向

处于"后现代主义"语境中的西方马克思主义,在20世纪60年代之后逐渐转向了一种"后马克思主义"的理论视域。以拉克劳和莫菲所代表的后马克思主义,运用"话语"、"霸权"等逻辑消弭马克思主义阶级主体的正当性,以此回应现实社会政治变化的趋势,从而提出了激进、多元的民主解放的蓝图。阿伦特的反极权主义理论在20世纪后期可谓独树一帜,体现出让人耳目一新的原创性和洞察力。而反对本质主义、反对极权主义也是后马克思主义的微观政治特征之一。     

话语权博弈下司法判决的形成

近年来,新媒体的迅速发展为民众表达话语权提供了广阔的渠道,致使个别案件的审判被演变为“媒体审判”、“民意审判”,判决往往成为不同话语权博弈后的结果.其实,无论是媒体监督的无序失范、司法独立性价值的消弱还是民意与判决的冲突,都可归结为媒体所代表的民意话语权与相关利益主体所代表的话语权、法律阶层所代表的话语权之间的冲突.面对该困境,文章通过典型、热点案例,从话语权选择主体、话语权表达主体两方面为困境中的理性判决提供了合理性建议.

Beyond the literary veil – Women writing Africa: The northern region (2009)

Abstract

Whenever African literature is discussed there is an articulated incorrect assumption that this relates to all the regions of Africa, except North Africa. A related further assumption is that only men in North Africa write. Female writers from the North barely receive critical attention, although they have been writing creative works. The aim of this article is to dispel the notion of literary drought when describing North Africa. Using the text, Women writing Africa: The northern region, the article demonstrates the different sensibilities that female authors in North Africa have created and manifest, when writing against patriarchy as well as against ideological philistinism within their communities. It is argued that female authors from North Africa – African-Arab women – are versatile in their imaginations as they engage with social reality from the perspective of creative art as well as political discourse. The article concludes that this assertion removes the literary veil so that North African female authors can begin to be appreciated artistically, more than has been the situation up to now.

The impact of the cease fire is addressed by examining the geography of troubles-related fatal incidents since 1985. This provides a period of 9 years both before and after the cease fire for comparison. The substantial decline in violence in Northern Ireland as a whole has a clear geographical pattern, with the rural nonmetropolitan zone experiencing a much steeper fall than Belfast and elsewhere. This is explained in terms of two factors. One is the relative rate of decline of killing by Republicans and Loyalists, while the other is the spatial variability of this decrease for each of these two perpetrator categories.

分析我国网络民意的话语表达特点，发现当代中国的网络民意还停留在“大众话语空间”的表达层面，缺乏公共理性的指导和约束，这一态势必然阻碍网络民意发挥其政策价值。因此，把网络民意从大众话语空间的表达层面上升到公共话语空间的表达层面，是网络民意政策价值制度生成的必要路径。

This paper provides some reflections on the current state of the discourse of economics and its relationship to changes in the economies to which that discourse is linked. The arguement is that the discourse of economics is in a fundamental state of flux, in both its conventional and its heterodox forms. The new analytical agendas thrown up by these changes are assessed and the ‘politics’ of their implications alluded to.
