从人类学的角度看,法律是一个安排秩序的分类体系,它安排了事物、行为、意义的秩序。每个社会、每种文化都有它与众不同的分类体系,由此产生了作为“地方性知识”的法律的多元格局。地方性规范比国家法律容纳了更富多元性的人们对人生意义的思考等非技术性意义因素,法律多元因此不可避免。不同的分类体系之间的差异会导致法律冲突的发生,但是作为不同分类体系的国家法律与地方性规范之间仍然有可沟通性。对于国家的法治建设来讲,不是如何去消除多元法律,而是如何处理差别。  相似文献

学界在谈论法律文化研究在我国兴起的原因之时,多将其归咎于国外法律文化研究的引入,这固然不错,但笔者以为,恐怕更深层次的原因还在于特定时代背景下的现实需求使然;法律文化研究在我国的出现,是基于特定“社会居所”的现实欲求和历史思索以及学术共同体内部渴望打破旧有研究格局的需要等多重诱因作用的结果,国外法律文化研究的传入,某种意义上仅仅是开放了法学界希望从更为广阔的角度来理解和解说法律实践的特定接受趋向,同时赋予国内的法律文化研究一种“学术合法性的追认”,并未产生太大实质性学术影响。  相似文献

This paper argues that the central concepts of justice theory (e.g., inputs and outcomes) have not been well defined and that this lack of precision in definition has led to subsequent ostensible inconsistencies in empirical findings. We offer definitions of both inputs and outcomes in a manner that facilitates more formal theoretical formulations and specifies a functional relationship between the two. In addition, the concept of relevance is discussed. This discussion highlights the difference in determinations of what is relevant to an outcome and the moral desirability of the distribution rule producing those outcomes. We suggest that the perception of what is relevant to the production of an outcome and how much it should be weighted is a source of potential conflict and/or disagreement between groups who are allocators or recipients of resource distributions. The potential disjuncture between what is considered relevant and what is considered moral in terms of allocation decisions is a potential source of dissatisfaction and feelings of injustice across groups. The discussion also suggests that it is not simply a difference in rule preference across groups that may lead to negative feelings regarding allocations but even when groups agree on the rule they may not agree on either the factors to be included in the assessment of relevance or on the morality of the distribution resulting from such assessments. Finally we introduce the concept of exchange domain as a mechanism for facilitating theoretical development.  相似文献

Three decades ago, it was widely believed by criminologists and policymakers that “nothing works” to reform offenders and that “rehabilitation is dead” as a guiding correctional philosophy. By contrast, today there is a vibrant movement to reaffirm rehabilitation and to implement programs based on the principles of effective intervention. How did this happen? I contend that the saving of rehabilitation was a contingent reality that emerged due to the efforts of a small group of loosely coupled research criminologists. These scholars rejected the “nothing works” professional ideology and instead used rigorous science to show that popular punitive interventions were ineffective, that offenders were not beyond redemption, and that treatment programs rooted in criminological knowledge were capable of meaningfully reducing recidivism. Their story is a reminder that, under certain conditions, the science of criminology is capable of making an important difference in the correctional enterprise, if not far beyond.  相似文献

Incentive regulation in the form of price caps was adopted for interstate access service in 1991 as a way to provide local exchange carriers with an incentive to improve their productive efficiency. An issue that has arisen with the adoption of price cap regulation is whether deterioration in service quality for interstate access service has been an unintended consequence. The analysis in this paper uses several different measures of service quality, including the average installation interval, the percent of commitments met, total trouble reports, and the average repair interval for both switched access service and special access service, to investigate empirically whether there has been a decline in service quality between 1991 and 2000. The results are conclusive. Overall service quality has fallen. To rectify the situation, a proposal is offered to adjust the price cap index to penalize LECs who fail to provide an acceptable level of aggregate service quality.  相似文献
