为使农民能分享到城市化进程中农地非农化的增值收益并解决被征地农民的生计保障与发展问题,实践创新推出征地留用地政策.但立法尚未将其纳入调整范畴,难免操作遭遇法律规制之用地指标限制、办证费用高及违规用地等某些尴尬,使得良好政策未必惠及被征地农民。需要设法研究解决土地利用管理规制中的某些时弊、留用地政策实施中的法律障碍,以确保良好的政策实效,促进城乡统筹与科学发展。  相似文献

"From the economic point of view, common law is more efficient than civil law." Is this recent statement published in an economic report valid for mergers and acquisitions (M&A)? The main objective of this paper is to compare the legal performance of M&A in France and in the United States. The purpose is to quantify the impact of both legal systems on the long-term performance of M&A transactions. To carry out this research, a specific methodology was developed and the results of which are evaluated. Two legal structures for M&A transactions were retained: the purchase of shares (share deal), and the purchase of assets (asset deal). Each of these acquisition structures was then subdivided into eleven steps composing the process, for example from preliminary information, letter of intent, due diligence, stock or asset purchase agreement, closing, to litigation with formal summons. Performance was then measured by taking into account time, cost, and satisfaction factors. The time factor was broken down into person-days and the number of days, weeks, or months required to complete each step. French and U.S. respondents were asked to fill out a questionnaire with reference to a specific acquisition project. A typical question was for instance: What is your estimate of working days to complete this step (person-days)? Radar charts were used to compare the mean of each performance factor. In order to check for correlations among the performance factors, an inter-factors analysis (regression) was carried out. The research findings are presented in this paper. Results show that a share deal in France is generally cheaper and participants indicate a significantly greater amount of satisfaction than in the U.S. However, for the time factor, the results vary. The conclusion is that the application of the civil code rather than common law does not reveal substantial differences as far as M&A transactions are concerned. One reason is that in both France and the U.S. these transactions are carried out following standard procedures in compliance with common contractual practices.  相似文献

In a rural agrarian economy like that of Nepal, land has traditionally been a primary source of livelihood and security, as well as a symbol of status. Thousands of poor farmers are completely dependent on land for their livelihoods, yet not all of them have access to or control over this fundamental resource. Negotiation for access to land has been a lengthy and complicated process. It remains so in the changed political context of Nepal, where increasing numbers of emerging actors need to be considered, often with conflicting claims and counterclaims. In this context the traditional ways of thinking need to be revised, both with regard to the negotiating process and the mechanisms of land reform, to accommodate the country’s recent and ongoing massive socio-economic transformation.  相似文献

The gender-specific approach for working with offenders gained momentum during the 1990s and has since been largely accepted by academics and practitioners. Despite numerous studies demonstrating a need for gender-responsive programs and policies within both adult and juvenile correctional systems, scant research has explored whether these services are meeting the intended goals. The current study addresses this through a qualitative analysis of 1 county juvenile court using in-depth interviews with staff. Findings reveal that in spite of the court's efforts to incorporate a gender-responsive approach, much work still remains regarding training staff and meeting girls' needs. Staff identified critical gaps in services and continued to perpetuate gendered norms and stereotypes. Included is a discussion as to why it has been difficult to effectively implement gender-specific programs.  相似文献

This article examines the idea that residential minimum parking requirements are associated with lower housing and population densities and higher vehicle densities (residential vehicles per square mile). Cities frequently use minimum parking requirements to manage traffic, but parking requirements accommodate vehicles, suggesting they should lead to more driving and congestion rather than less. If parking requirements reduce congestion, they likely do so not by reducing the number of vehicles in an area but by reducing the densities of housing and people. We support this idea by comparing the Los Angeles and New York urbanized areas. We show that differences in housing, vehicle, and population densities across and within these urbanized areas are closely correlated with differences in the share of housing units that include parking, and that the share of housing units that include parking is in turn correlated with the stringency of parking requirements. Compared with Los Angeles, New York shifts less of the cost of driving into its housing market. We further show that within New York City, a 10% increase in minimum parking requirements is associated with a 5% increase in vehicles per square mile, a 4% increase in vehicles per person, and a 6% reduction in both population density and housing density. These relationships remain even after controlling for street layout and proximity to the subway.  相似文献
