民主转型中的韩国政党政治

就推动韩国政治转型的直接因素来说,韩国政党无疑具有相当关键的作用。然而国内的韩国学研究当中,长期以来,人们却忽视乃至刻意回避了韩国政党在民主政治转型过程中所体现出来的不可替代的重要作用。作者尝试着对韩国政治转型过程中政党这一"隐形的力量"所具有的民主化功能进行了初步地考察和分析,并将这种研究视角推及到了整个东亚地区,以期表明这种研究成果的地区规律性,及其地区借鉴意义和启示作用。     

新时期企业青年道德重塑的驱动力思考

社会主义道德体系建设涵盖企业青年道德建设,在新时期,重塑企业青年道德对于企业永葆活力有着重要的作用。文章从企业青年道德信仰的内涵出发,分析当前市场经济条件下企业青年的道德倾向,主张从建立和社会主义市场经济体制相适应的道德规范,营造良好的企业道德环境,在企业内部建立良好的道德评价制度等三个方面对新时期企业青年道德进行塑造。     

孟德斯鸠地理环境学说理论探究——以《论法的精神》和中国社会为视角

地理环境学说是西方史学中一套很重要的理论,它强调了自然环境对社会制度的影响,这种学说本身便包含了原始的自然法原理即顺应自然。孟德斯鸠作为自然法学派的代表人物之一,在他的《论法的精神》中发展了前人的地理环境学说,阐述了气候、土壤对一个地区和民族的深远影响。但是他的理论毕竟产生于200多年前,现在看来也不那么完善。     

The politics of ethnicity and post-conflict reconstruction: The case of Northern Ghana

Taking into account the complexity of contemporary ethnic conflicts, this article examines the construction and politicisation of ethnicity to understand a recent case of post-conflict reconstruction. More specifically, the article considers theories of post-conflict reconstruction, particularly the conflict transformation school that claims to respond to the hybrid nature of recent ethnic conflicts. By adopting a constructivist perspective, this article argues that post-conflict reconstruction in ethnically-fragmented areas is largely about the problem of de-politicising essentialist discourses of historically constructed ethnic identities. In order to explore this key theoretical issue, the article analyses the 1994-95 case of conflict and reconstruction in the Northern Region of Ghana. This analysis draws on archival research and 21 interviews with individuals representing nongovernmental organisations (NGOs), traditional authorities, religious leaders, opinion leaders, and the state conducted from August to October 2006 in Accra, the capital of Ghana, as well as Tamale, the capital of the Northern Region. Because very little research is available on post-conflict reconstruction in Northern Ghana, this analysis fills a major gap in the contemporary literature on ethnic conflict and post-conflict reconstruction in West Africa. At a broader level, the article suggests that contemporary theories of post-conflict reconstruction would gain from taking a more systematic look at the social and political construction of such identities.     

论我国建立民事诉讼快速审判程序的立法选择

我国的民商事纠纷的不断增加，便人民法院受理的民商事案件数量也快速增长。为了应对不断增长的诉讼潮，关键在于健全我国的民事审判程序体系，增设一个独立于现有审判程序的，全新而又高效的审判程序就是重中之重。根据现代民事诉讼法理，综合考量我国历史文化因素和现实状况。在民事诉讼中，建立快速审判程序是我国民事诉讼法的应然选择。     

关于设立取得时效制度的立法建议

取得时效是大陆法系国家的一项重要制度,目前我国民事立法尚未对其作出规定。本文主要介绍了取得时效的构成要件,阐述了设立该制度的必要性并在最后提出了一些立法上的建议。

实现"人与自然和谐相处",发展"生态文明",必须保持人类赖以生存的自然环境的生物多样性.野生动物既是重要的生物物种和环境因素,又是人类不可缺少的自然资源,对于维持生态平衡具有重要意义.国外和我国刑法针对动物资源犯罪均做出了相关规定.针对当前动物资源犯罪日益猖獗的严峻形势,我国应积极应对,加强国际合作,修订相关法律,增设有关罪名,以便取得良好成效.     

福建省服刑人员医疗保障认同度调查

服刑人员医疗保障不仅是其人权保障的重要组成部分,也是确保监管改造工作持续安全稳定的重要基础。调查表明,对服刑人员实施“全额医保”模式并不能得到监狱、监狱民警以及服刑人员在价值观念上的认同和行动上的支持。规范服刑人员的劳动报酬、将服刑人员纳入全民基本医疗保障体系、实现监狱医院的社会化医疗管理模式是破解服刑人员医疗困境的关键。     

The French elections of 2017: shaking the disease?

The results of the 2017 presidential and legislative elections represent an important shift in French politics. For the first time in the history of the 5th French Republic, the candidates of the two traditional governing parties were disqualified during the first round of the presidential elections. The duel between a centrist and a radical-right candidate in the second round of the elections constitutes an unprecedented configuration. Moreover, there was a record parliamentary renewal after the 2017 legislative elections, as well as a feminisation of the National Assembly with 38.8 per cent of women among the deputies. At the same time, abstention for the legislative elections reached a new record high. Overall, the results of the French elections in 2017 could point to major shifts in the party system, as well as to a renewal of the French political elite, and to an enduring malaise between French citizens and their political representatives.     

欧盟立法评估制度研究

立法评估是对立法效果的评估和分析.经过近十年的实践和发展,欧盟立法评估制度已经形成了包括评估目标、主体、对象、标准、主要内容以及程序步骤等在内的完整的制度框架体系.随着市场经济的发展和欧洲政治经济一体化进程的加快,欧盟的立法评估制度在市场规制、提高立法质量与增进社会公共福利方面发挥着愈来愈重要的作用.虽然该制度在具体实际运作中尚有较大的改进空间,但其仍为我国立法评估制度的构建提供了可资借鉴的因素.
