Pore Sub‐Features Reproducibility in Direct Microscopic and Livescan Images—Their Reliability in Personal Identification

Abstract: Third level features have been reported to have equal discriminatory power as second level details in establishing personal identification. Pore area, as an extended set third level sub‐feature, has been studied by minimizing possible factors that could affect pore size. The reproducibility of pore surface area has been studied using direct microscopic and 500 ppi Livescan images. Direct microscopic pore area measurements indicated that the day on which the pore area was measured had a significant impact on the measured pore area. Pore area measurement was shown to be difficult to estimate in 500 ppi Livescan measurements owing to lack of resolution. It is not possible to reliably use pore area as an identifying feature in fingerprint examination.     

Internet domain names and the interaction with intellectual property

This is the fourth in a series of articles looking at the interaction between Internet domain names and intellectual property. It outlines the ICANN dispute resolution procedure for gTLDs whereby objectionable domain names can be transferred away from their registrants or cancelled. It also compares this to legal proceedings in the UK Courts and outlines a referral to the European Court of Justice on issues relating to a trade mark registration as the basis or legitimate interest for a .eu domain name registration.

刑法上的因果关系探究

对刑法中的因果关系的判断应着眼于本国的司法实践。由于我国耦合式的犯罪构成模式,使得我国在刑法因果关系的判断上不可能仅是事实层面的判断,而应是事实层面和价值层面的统一。只有将这两个层面之间的关系理顺,才能对刑法上的因果关系做出合理的判断。

随着中国—东盟自由贸易区的建成和进一步发展,对高水平口译人才的需求也在日益增长。为了满足自由贸易区发展对口译人才的需求,提高学生的口译听辨能力成为口译教学亟需解决的问题。本文提出从加强东盟国家语言变体听辨训练和加强背景知识积累两个方面,有针对性地解决口译员在中国—东盟自由贸易区背景下出现的听辨障碍。     

Buying treaties with cigarettes: Internal side‐payments in two level games

Two‐level games models predict that domestic division within a state can alter the extent to which that state is able to reach agreements with other states, and also alter the content of any agreement that is reached. I extend the model by introducing internal side‐payments composed of unrelated domestic issues. Domestic opposition to an international agreement will inhibit cooperation most when the executive and median legislators are in relative agreement about other salient domestic political issues. Domestic opposition to an international agreement will inhibit cooperation least when the executive and median legislators are in relative disagreement about other salient domestic political issues. U.S. ratifications of the NAFTA and the Chemical Weapons Convention illustrate that not all types of domestic division inhibit international cooperation—some can facilitate it     

司法鉴定机构等级管理基本问题论纲

虽然目前对司法鉴定机构采用司法行政部门的行政管理和司法鉴定行业协会的自律管理相结合的方式进行。但司法实践中,司法鉴定行业依然存在重复鉴定、缠鉴闹鉴、少数鉴定机构随意出具鉴定意见等乱象：另外,不少鉴定机构,尤其是技术水平较低的鉴定机构。不是从改善仪器设备、优化人员结构等方面提高自身素质,而是通过不正当竞争获取一定的检案量,对司法鉴定发展产生阻碍。对此,建立、完善司法鉴定等级管理制度能够在一定程度上有效缓解上述问题。在此之前,应当明晰司法鉴定机构等级管理的内涵、明确建立鉴定机构等级管理的必要性、确立鉴定机构等级管理的原则等有关基本问题;同时,对不同资质等级的鉴定机构出具的鉴定意见的证据效力以及受案范围应当予以特别重视．在防止不同资质等级鉴定机构之间产生“行政层级”上的服从与被服从关系的基础上．以确保鉴定的质量和效率。     

所有权制度的历史分析

从历史的角度看,没有哪一项法律制度像所有权这样承载着极为厚重的人文价值。人类社会从蒙昧时期、文明时期发展到近现代社会时期,所有权制度经历了从原始的财产支配到个人人性乃至社会整体的精神解放、从等级身份制条件下的公然不平等到形式主义的人人平等、从近现代的绝对所有权到现代社会兼顾实质平等的所有权这些重大的法律价值嬗变。所有权制度的有效性,是法律体系的核心目标,而有效的所有权制度,只有从认真对待民众的自然权利的角度入手才能够真正予以理解。在我国,解放民众所有权上的制度和思想桎梏、建立科学的公共财产所有权制度,应当成为我国进一步发展所有权制度的社会共识。

2011年全国县级党校工作座谈会结束后,县级党校的发展迎来了新的历史机遇,如何做到与时俱进,把握时代脉搏,具有前瞻性和开放性,加快发展成了当前面临的首要任务。文章结合实际,对县级党校的发展提出了建议与对策。
