Zum Regelungsumfang des Art 16 Z 2 LGVÜ/Art 22 Z 2 EuGVVO

Klagen gegen einen internationalen Sportverband, die auf Feststellung der Unwirksamkeit einer Sperre eines bei einem nationalen Sportverband besch?ftigten Trainers von Wettbewerben dieses Sportverbandes und auf Unterlassung von Handlungen, die eine Akkreditierung verhindern bzw erschweren, gerichtet sind, unterliegen der ausschlie?lichen inl?ndischen Gerichtsbarkeit des Sitzstaates; eine Verbindung solcher Klagen mit einer gegen den nationalen Verband gerichteten gleichartigen Klage ist daher unzul?ssig. – Eine damit zusammenh?ngende Schadenersatzklage gegen den internationalen Verband steht auch nicht in dem von Art 6 Nr 1 LGVü geforderten Zusammenhang mit einer Klage gegen den nationalen Verband wegen Aufl?sung des Trainervertrages aufgrund der Sperre.     

猪日本乙型脑炎病毒NS1基因重组腺病毒的构建及表达

应用RT-PCR方法扩增出猪日本乙型脑炎病毒(JEV)的NS1基因,通过SalⅠ EcoRⅠ双酶切后把该基因插入到经过同样双酶切的穿梭质粒pDC315中。重组穿梭载体经过双酶切和PCR鉴定后进行测序,序列测定正确。将获得的重组穿梭质粒与腺病毒骨架质粒共转染293细胞后获得重组腺病毒。PCR鉴定及间接ELISA检测的结果证明所构建的重组腺病毒成功地表达了JEV的NS1。     

Unbrauchbarkeit der Wohnung (undichte Gasleitungen) – Rügeobliegenheit

Die Undichtheit von Gasleitungen stellt keinen offenkundigen und schwerwiegenden Mangel dar, der bei der geringsten überprüfung leicht erkennbar gewesen w?re. Wenn der Mieter im Zuge umfangreicher und kostenaufwendiger Adaptierungsarbeiten entgegen der im Mietvertrag ausdrücklich erkl?rten ursprünglichen Einsch?tzung der Vertragsparteien die Undichtheit der Gasleitungen erkennt, dann entspricht es Treu und Glauben, den Vermieter über diesen Mangel zu informieren und ihm die Gelegenheit zur Sanierung zu geben.     

新风胶囊对佐剂性关节炎大鼠血清IL-1、TNFα、IL-4及IL-10的影响

目的：观察新风胶囊对佐剂性关节炎的治疗作用及对细胞因子系列（IL－1、IL－4、IL－10及TNFα）的影响。方法：将50只大鼠随机分为正常对照组，模型对照组，新风胶囊组，雷公藤多苷片（TPT）组和甲氨喋呤TX）治疗组，每组10只，制备完全佐剂并分别向除正常组以外的其余动物右后足跖皮内注射0．05ml致炎，观察各组血清中各细胞因子含量的变化，结果：与治疗前比较，新风胶囊治疗组，TPT治疗组及MTX治疗组治疗后大鼠的关节炎指数（AI）显降低（P＜0．05或P＜0．01），新风胶囊治疗组给药后体质量增加值与正常对照组比较差异无显性（P＞0．05）；TPT治疗组及MTX治疗组给药前后体质量增加值显低于正常对照组和新风胶囊治疗组（P＜0．01），与模型对照组相比，新风胶囊治疗组的IL－1，TNFα显降低，IL－4，IL－10显升高（P＜0．01），并与其余两治疗组无显性差异（P＞0．05），结论：新风胶囊与MTX，TPT一样能降低佐剂性关节炎模型大鼠的AI，而在增加大鼠体质量方面优于TPT和MTX，新风胶囊可能通过下调致炎因子（IL－1，TNFα），上调抗炎因子（IL－4，IL－10），抑制致炎效应，增强抗炎效应，从而达到降低AI，消除肿胀的治疗目的。     

论我国刑事诉讼中被追诉人的测谎权

山木集团前总裁宋山木强奸案向我们提出了被追诉人有无权利要求测谎的问题。只要在刑事诉讼中允许使用测谎技术,无论是允许其作为证据使用还是仅仅将其作为审查判断证据的手段,被追诉人单方面向法院申请测谎,实质上均是一种试图向法院澄清事实真相的诉讼证明行为。被追诉人的测谎权是一种相对权,而非绝对权。鉴于我国目前的现实情况,测谎只能作为审查判断言词证据的方法,尚不能作为独立的证据适用,因此法院是否批准被追诉人的测谎申请,应以有测谎之必要为前提。     

心肌缺血-致命性心动过缓血清代谢特征分析

目的探讨心肌缺血-致命性心动过缓大鼠血清代谢特征。方法制作心肌缺血-心动过缓-死亡(myocardial ischemia-bradycardia-sudden cardiac death,MI-B-SCD)大鼠模型,以假手术组为对照组,应用气相色谱质谱联用仪检测死后血清代谢谱,结合代谢组学策略分析血清代谢特征。结果 MI-B-SCD大鼠血清代谢轮廓与对照差异显著。与假手术组相比,MI-B-SCD大鼠血清赖氨酸、鸟氨酸、嘌呤、丝氨酸、丙氨酸、尿素、乳酸含量明显升高;琥珀酸、棕榈酸、酮己二酸、甘油醛、己烯二酸、辛二酸含量明显下降,其中多种差异代谢物之间存在相关性。结论 MI-B-SCD大鼠血清代谢显著改变,赖氨酸与嘌呤有较高的诊断MI-B-SCD价值,可望为心源性猝死的法医鉴定及临床防治提供参考。     

The problem of tatemashi in Murakami Haruki’s work: comparing The Wind-Up Bird Chronicle and 1Q84

Abstract

This article investigates a problem that has been underexamined in Murakami scholarship so far, namely what I will call tatemashi (stacking), a method of novel-writing which Murakami Haruki used twice in his career, first in Nejimakidori Kuronikuru and later in 1Q84. In both cases, Murakami first published a shorter, two-volume version, but later stacked up the novel with a third volume. This article studies the various problems surrounding this writing method. I suggest that edits during the translation process of the two novels into English have made it impossible to detect why tatemashi was carried out. By studying the Japanese versions, I identify that a main reason for tatemashi to happen is the thrust of a storyline that calls for the development of a ‘smaller-scale’ story of personal self-discovery into a ‘larger-scale’ tale of commitment to an ‘other’.     

Political accountability,fiscal conditions and local government performance—cross‐sectional evidence from Indonesia

Why are some local governments more successful than others in managing resources and delivering services? And even more vitally, how can malfunctioning governments be reformed so that they perform their responsibilities more effectively? This article contributes to our understanding of theses overarching questions by exploring the interactions between political institutions and public sector performance in the context of decentralisation and local governance. It shows–both theoretically and empirically–that performance outcomes are determined by the extent to which people can hold their governments accountable through political institutions. The basic hypothesis underlying this research is that political accountability, either by encouraging sanctions upon non‐compliant public agents or simply by reducing the informational gap regarding government activities, will create forceful incentives for elected officials and civil servants to reduce opportunistic behaviour and improve performance. Using a cross‐sectional regression the hypothesis is empirically tested against evidence from newly empowered local governments in Indonesia. The empirical findings broadly support our hypotheses. Improved public services on the ground, both in terms of quantity and quality, require informed and well functioning decision‐making processes that allocate resources to priority areas that meet the demand of the broader community.
