宪政程序正当化:宪政建设的制度基础

宪政程序正当化是宪政建设的依托和目标。对于宪政建设而言 ,制宪程序正当化是前提 ,行宪程序正当化是基础 ,护宪程序正当化是保障。程序是宪政运作过程的形式载体 ,宪政的运作需要程序的建构、完善与实施。如果没有宪政程序 ,宪政的运作将会是无所依托、杂乱无章的行为。宪政程序的合理性就在于其自身的正当化 ,这种正当化就其外在价值而言 ,必须支持宪政所内蕴的实体内容 ;就其内在价值而言 ,宪政程序的正当化意味着“公平”与“效率”的实现

论自愿戒毒：法规范、定位与制度创新

《戒毒条例》将自愿戒毒单独成章,使其成为我国一项基本戒毒制度。但关于自愿戒毒,《戒毒条例》与《禁毒法》存在着严重的规范并用和冲突现象。从自愿戒毒的基本自足点在于戒毒者权利保护的立场出发,推动我国自愿戒毒工作的开展,就必须进行相应的制度创新,这集中体现在将自愿戒毒作为首选性戒毒制度、加强戒毒医疗机构建设和推进戒毒药物维持治疗三个方面。     

Hispanic Perceptions of Community Policing

Abstract

The two core elements of community policing are community partnership and problem solving (Rosenbaum, 1994). A major challenge that continues for proponents of community policing is developing and evaluating programs in areas with diverse ethnic groups. While many agencies have successfully developed community policing programs, empirical evaluations of community policing are scarce in areas that include a variety of minority groups. This research explores the effectiveness of community policing by examining citizen satisfaction with local police. Analyses are conducted with data from the Bureau of Justice Statistics on Criminal Victimization and Perceptions of Community Safety in 12 United States cities. The results indicate that Whites and Hispanics have the most positive perceptions of police, while Blacks, Eskimos, Asians, and Pacific Islanders have negative perceptions of police.

人类生存的维护形式,经历了原始社会集体维护,到特殊关系（家族、身份、家庭）内部维护和个体维护,最终在工业化和城市化面前完全崩溃。在完全的私有制和极端的贪欲下,生存所依赖的相关资源配置发生严重的不平衡,权力、财富、报酬分配过多地向社会强者聚集,社会弱者生存资源单一且微薄,生存与发展问题十分严重。当国家和社会把维护人类生存与发展的义务背负起来,形成生存的社会维护,并使再次分配成为生存的基本资源一部分时,社会立法回应了这一新状况,西方国家的社会法就是在此中产生并得以发展。

Toward a Framework for the Sustainable Management of Social （Public） Housing Estates in Nigeria

Housing is a centre for many socio-economic activities and often provides a mark of prosperity, social acceptance, and an element of urban development and growth in a country. However, it is suspected that the significance of housing to people in the Niger Delta of Nigeria is lacking because of poor post-construction management practice that is currently in place. At the same time, there are housing shortages, uncompleted, vandalized and abandoned social housing stock in the Nigeria Delta. This has been a continuing challenge facing people in this region as reported in previous studies. Therefore, the overall aim of the study is to develop a framework for the sustainable management of social （public） housing estates in the Niger Delta of Nigeria. This paper aims to set out the context for the research, identify its overall aim and objectives and thereafter considers issues related to the determination of an appropriate scope for the study. It argues that the management of social housing estates in a sustainable manner needs to adopt the principles of sustainability in combination with effective people-centred management and building maintenance practices. It further asserts that the development of such a framework would be a panacea approach in meeting the social housing challenges faced in the Niger Delta and in Nigeria at large.     

THE IMPACT OF ORDER‐MAINTENANCE POLICING ON NEW YORK CITY HOMICIDE AND ROBBERY RATES: 1988‐2001*

Local officials and national observers have attributed the New York City drop in violent crime during the 1990s to the aggressive enforcement of public order, but relevant research is limited and yields contrasting conclusions regarding the effects of order‐maintenance policing (OMP) on violent crime trends in New York City. The current study investigates the effects of order‐maintenance arrests on precinct‐level robbery and homicide trends in New York City with more reliable crime and arrest data, longer time series, and more extensive controls for other influences than used in prior research. We find statistically significant but small crime‐reduction effects of OMP and conclude that the impact of aggressive order enforcement on the reduction in homicide and robbery rates in New York City during the 1990s was modest at best.
