Local Resilience and the Reconstruction of Social Institutions: Recovery,Maintenance and Transformation of Buddhist Sangha in Post-Khmer Rouge Cambodia

ABSTRACT

This article explores how local resilience is realised in post-conflict reconstruction, by examining the redevelopment of Buddhist institutions in Cambodia. It firstly proposes three forms of resilience that were significant in the local level peacebuilding practice in the country – recovery, maintenance and transformation – and examines the process by which each form of resilience was materialised from the perspectives of local communities. Moreover, this study highlights two factors that determined the development of local resilience: ontological security and local leadership structure. Based on the empirical findings, this study discusses the conceptual and theoretical implications of such elements of resilient peacebuilding.     

转售价格维持的反垄断法分析

对于转售价格维持行为,传统反垄断法上强调其便利零售卡特尔以及生产商卡特尔等负面效果,因而长期适用本身违法规则。2007年美国最高法院的Leegin案判决则改而采用合理规则,这对我国《反垄断法》第14条、第15条的实施具有重大的启发意义。但另一方面,合理规则的适用十分复杂,因而应当在进行合理性分析之前,先对相关市场的情况进行考察,以明确该行为是否符合产生反竞争效果的结构条件,对于不满足这些条件的行为,则认定其合法,而不需要进行进一步的合理性分析。这样可以大大减少需要进行深入分析的案件的范围,简化合理规则的适用,并为经营者提供明确的指引。     

Procedural Justice and Order Maintenance Policing: A Study of Inner‐City Young Men’s Perceptions of Police Legitimacy

There is tension between the core tenets of procedural justice and those of order maintenance policing. Research has shown that citizens’ perceptions of procedural justice influence their beliefs about police legitimacy, yet at the same time, some order maintenance policing efforts stress frequent stops of vehicles and persons for suspected disorderly behavior. These types of programs can threaten citizens’ perceptions of police legitimacy because the targeted offenses are minor and are often not well‐defined. Citizens stopped for low‐level offenses may view such stops as a form of harassment, as they may not believe they were doing anything to warrant police scrutiny. This paper examines young men’s self‐described experiences with this style of proactive policing. Study findings highlight that order maintenance policing strategies have negative implications for police legitimacy and crime control efforts via their potential to damage citizens’ views of procedural justice.     

遏制不利因素 强化“维稳”机制

当前,我区总体社会治安形势稳定,但还存在着一些不稳定的因素。如,群体性事件、＂三股势力＂活动、西方敌对势力涉疆活动、非法宗教活动等。各种因素相互交织,使矛盾的不确定风险增大,＂维稳＂更为艰巨。因此,正确分析社会存在的各种矛盾,遏制和消除＂维稳＂的不利因素,建立纠纷排查和＂维稳＂风险评估、完善法制建设、继续长久地保持＂高压态势＂、加大社区＂维稳＂建设、强化＂综治＂工作等全方位的、立体式的＂维稳＂应对机制,对维护新疆社会稳定,加快社会经济发展,有着十分重要的现实意义。

劳动能力丧失损害赔偿标准适用之考察

劳动能力丧失程度是确定损害赔偿纠纷侵权人承担赔偿范围的依据之一。劳动能力鉴定及伤残等级鉴定制度为劳动能力丧失的判断提供了客观标准,但对扶养费关系涉及的边缘人群应更多体现法律规范的政策功能。遭受侵害的权利人提起赔偿之诉时,应适用劳动能力丧失说确定侵权人的赔偿范围,就扶养费计算标准而言,则应适用生活来源丧失说,从而在保障权利人全面受偿的同时不致对侵权行为人施以过分苛责。

Fiscal Crisis and Community Development: The Great Recession,Support Networks,and Community Development Corporation Capacity

Community development corporations (CDC) are a cornerstone of neighborhood improvement in legacy cities. Yet they face challenges that threaten their financial sustainability, challenges that grew exponentially with the Great Recession. This article examines the impact of the Great Recession on the revenue and survival of CDC in Baltimore, Maryland; Cleveland, Ohio; and Detroit, Michigan. An analysis of financial data from the National Center for Charitable Statistics from 2004 to 2011 highlights issues of industry contraction, revenue concentration and loss, and CDC survival. Interviews and examination of multiple secondary sources of information on CDC activity and support networks in each city further our understanding of the financial results. We find that the CDC industry in all three cities was severely impacted by the Great Recession and that the CDC support networks in each city had a significant intervening effect on the ability of CDC to adapt to the fiscal and service pressures created by the recession. We discuss the implications of the shared trends and the city-specific dynamics for the role of CDC in neighborhood improvement in legacy cities.     

霸权衰落与“泛安全化”：基于美国的个案分析

衰落是霸权的宿命,但霸权国既不会主动放弃国际政治中的主导地位,也不会静待霸权体系崩溃。处于衰落阶段的霸权国期待维持与崛起国之间的权力差距,以延长霸权的寿命。然而,权力转移等国际关系结构性因素的变化导致离岸平衡和军事打击等传统手段难以在衰落阶段奏效。相比之下,“安全化”为霸权国家的霸权护持行动与选择——如领域撤退或强制惩罚——提供了合法性依据。同时,由于霸权的同心圆特性,核心利益被触动会引发霸权国在核心和外围领域的全方位的打压,进而泛化议题和对象。衰落中的霸权国通过“危机感知”—“构建并接受安全化诉求”—“泛安全化”的传导路径,将维持霸权地位的诉求以泛安全化的形式展现出来。然而,美国霸权衰落的经验事实表明,泛安全化作为衰落阶段的霸权护持手段不仅与理论预期相反,而且成效也不尽人意。面对美国霸权的泛安全化,中国应当保持战略定力,坚守并贯彻总体国家安全观。     

当前我国警察心理健康问题研究

当前,新形势对公安民警的素质和身心健康提出了越来越高的要求,公安机关的领导以及警界的学者们共同意识到健康的心理素质是警察依法履行职责、完成各项任务的重要保证。警察职业环境中存在着比常人更多的负向刺激物,警察在工作实践中会面临多种多样的压力事件,压力事件及压力情境构成警察的心理压力源,工作压力源成为警察心理压力源的主要内容。针对我国警察心理保健的现状、警察心理压力源及其对警察产生的负面影响,在公安机关开展警察心理保健工作,不仅能使人们了解警察行为的发生机制,使社会更加透彻地了解警察这个群体最为真实的工作生活状态,还能有效提升警务工作的服务效益。
