论自然人破产制度的构建——对《民事诉讼法》第235条的探讨

我国现行的《民事诉讼法》第235条第五项规定,在自然人作为被执行人的案件中,裁定终结执行的依据是该被执行人“生活困难无力偿还借款,无收入来源,又丧失劳动能力”。事实上,这一条并不具有前瞻性,同时在实践中又由于其前瞻性的缺乏,导致许多执行法院在具体的案件中适用此条有困难,仅对类似案件裁定予以“终结本次执行程序”。这种无奈之举不但于法无据,而且是对终结执行本身目的的违背。     

Reactions to Mandatory Sentences in Relation to the Ethnic Identity and Criminal History of the Offender

This study investigated the responses of 181 participants (87 men, 94 women), from Adelaide, South Australia, to scenarios describing mandatory sentences for perpetrators of a property offense committed in the Northern Territory, Australia. Four scenarios that were randomly distributed varied ethnic identity (White Australian, Aboriginal Australian) and criminal history (first-time offender, third-time offender). Participants completed attitude measures for both mandatory sentencing and capital punishment, a right-wing authoritarianism scale, and a scale concerned with sentencing goals (retribution, deterrence, protection of society, and rehabilitation). Results showed strong effects of attitude toward mandatory sentencing on scenario responses for variables such as perceived responsibility, deservingness, leniency, seriousness, anger and pleasure, and weaker effects of ethnic identity and criminal history. Participants were generally more sympathetic when the offender was an Aboriginal Australian. Results of a multiple regression analysis showed that attitude toward mandatory sentence was predicted by right-wing authoritarianism and by sentencing goals relating to deterrence and the protection of society.     

关于我国死刑的适用仍要坚持"少杀慎杀"原则的建议

"保留死刑、少杀慎杀"是我党长期坚持的死刑政策,体现了刑罚的改造功能价值,可以尽量避免错杀,保存活证据,使反腐斗争深入.同时有利于保持社会稳定,巩固共产党的执政地位.这既符合我国的实际,也顺应了世界刑罚的发展潮流.在我国的死刑适用中,仍要坚持"少杀慎杀"原则,废除经济犯罪的死刑,积极适用死缓制度,鼓励犯人立功受奖.     

Environmental Reporting as a Communications Tool: A Question of Enforcement?

This article examines the effect of mandatory corporate environmentalreporting in the context of corporate accountability. It asksthe question whether such reporting can be an effective communicationstool, both internally and externally and whether this will leadto a greater awareness of environmental issues throughout anorganisation, resulting in improved corporate decisions, practicesand outcomes. In order to answer this question, the author drawson longitudinal research examining the performance of the top100 Australian companies. The article then looks at the roleof the regulator, arguing that mandatory environmental reportingshould be coupled with guidance and enforcement by a regulatingauthority. The lack of this enforcement in Australia has resultedin the quality of the reporting being less than optimal. Throughoutthe article, the author has compared the Australian experiencewith that of Norway, which has similar mandatory corporate environmentalreporting laws.

简论沈家本的废除死刑观

近代著名法学家沈家本在他主持的清末法制改革中,针对中国古代刑罚的残酷、繁多,主张刑罚趋轻、废除酷刑,并形成了自己颇具特色的废除死刑观。沈家本认为,要在中国废除死刑,必须结合中国的国情,走二步废除论之路,即首先减省死刑、死刑惟一;然后在此基础上谋教养、讲道德、废死刑。
