法医文证审查100例分析

通过100例法医文证审查案件的分析,发现在目前检察机关文证审查工作中,存在委托数量不足、委托程序不规范、送检材料不全面等问题;在送审鉴定文书中,也存在标准条文掌握不当、鉴定人基础知识欠缺和粗心大意等问题。同时发现,鉴定文书的规范化程度和采信率已经得到有效的提高;且规范化越高的鉴定机构,则其鉴定文书的准确率越高,被采信率也越高。目前有必要加强检察技术部门文证审查的技术水平,进一步积累办案经验,切实增强检察机关的法律监督能力。

Linkages Methodology: No Man is an Island

The paper argues that given the diversity of the field of forcedmigration, research requires a multi-disciplinary approach andan awareness of the multiplicity of interacting factors whichcome into play. It examines two key texts published 20 yearsapart which exemplify the linkages approach. Imposing Aid (1986)studied the developing situation in Sudan as refugees arrivedfrom Uganda in the early 1980s, and showed the unproductivenature of interactions between officials and refugees. Landscapeof Hope and Despair (2005) examined the situation of Palestiniansin refugee camps, where the refugees’ own agency comesup against the structural constraints of camp administrationand the political actions of local and international power holders.

大力发展医疗责任保险,对医疗执业过失给患者造成的损害进行充分赔偿,在保障患者和医疗机构及其医务人员的合法权益,优化医疗环境和医疗公共秩序方面有重要的促进作用。由于我国医院主体是公立医院,侵权法人身损害赔偿相对于综合医院尚未到重大程度,并且综合性医院每年发生的医疗过失案件基本确定,选择满足面临危险的医院财务安全需要的医疗责任保险模式,如医疗责任保险信托等,才能促进医疗责任保险的发展。实践表明,商业性医疗责任保险不宜成为我国医疗责任保险的主体。建立独立的医疗过失纠纷调解鉴定机构,才能保证医疗责任保险顺利开展。

传递性推理心理效应是指在进行传递性推理时各种因素对做出演绎结论的影响。传递性推理的心理效应主要包括端点锚定效应、系列位置效应、符号距离效应、一致性效应、转换效应、方向效应。深入研究传递性推理中的心理效应有助于进一步揭示传递性推理机制。在未来的传递性推理研究中要高度重视对心理效应的系统研究。

在预防跨国腐败犯罪的具体制度建设层面各国有所不同。结合本国国情进行预防跨国腐败犯罪制度研究,必须重视两方面的制度建设:一是完善本国立法,二是借鉴别国经验。     

SPECIAL NEEDS CHILDREN IN FAMILY COURT CASES

This article presents a conceptual framework for describing cases involving children with special needs that are increasingly being seen in family court. Three categories that represent the most common of such cases include (1) acute, life-threatening medical conditions; (2) chronic developmental disorders; and (3) psychological and behavioral syndromes. After detailing the nature of the disabilities in each category, perspectives from the bench are offered with specific recommendations and general strategies for effective case management. This is followed by a proposal of an innovative conceptual model—the Individualized Parenting Plan (IPP)—that organizes and integrates nine domains essential for a comprehensive parenting plan for special needs children. The article concludes with a list of sixteen strategic guidelines for servicing the families of these special needs children, in their best interests.     

Increasing Evidence-Based Programs in Criminal and Juvenile Justice: A Report from the Front Line

For the past 5 years in the United States, there has been an increased emphasis on evidence-based programs, and, in particular, the promotion of experimental designs as the highest standard of evidence. This interest has been fueled by the Federal government's demand for accountability that links budget allocation with program performance. The National Institute of Justice, the research, development and evaluation agency within the Office of Programs in the U.S. Department of Justice is undertaking a number of efforts to improve the quality of evaluation research and address the need for evidence-based programs. These efforts have focused on making improvements upfront in the grant selection process so that well-designed evaluations will be undertaken and in the management and monitoring of ongoing evaluation research grants so that implementation and design issues can be identified and addressed. Evaluability assessments is a key strategy that NIJ is relying on increasingly to identify programs that have a high likelihood of being successfully evaluated. Whether these efforts will lead to an overall increase in the rigor of NIJ-supported evaluations remains unanswered at this time. 党的十六届四中全会首次明确提出逐步推进党务公开,这是党的执政理念的新突破和提高党的执政能力的新举措。理论界围绕党务公开的内涵、党务公开的依据、党务公开的过程、党务公开存在的问题以及推进党务公开的路径等进行了研究,提出了各种看法。进一步加深对党务公开的理论研究,为贯彻落实科学发展观,全面推进社会主义民主政治建设提供理论指导,是理论工作者的重要任务。
