高校扩招应与经济社会发展相适应

高校扩招使教育投资不足、教育不公、学生就业困难等问题凸现,高校扩招要结合我国的国情,与经济社会发展相适应。要实现教育兴国,就必须保证国家财政对教育的投资。教育不公是最大的社会不公,要从制定政策入手解决。大学是培养高级建设人才的学府,必须提高质量。     

对故意传播艾滋病的刑事立法刍议

保障艾滋病病毒感染者和艾滋病病人的合法权利,使其得到应有的治疗,并规定他们应承担的避免将艾滋病毒传染给他人,包括亲人的义务。政府必须加快制定HIV感染者病人的行政和刑事管理法规,对“传播艾滋病罪”作出规定。     

中国语境中学生权利救济机制的构建

基于高等学校与学生关系的法律性质以及大学自治与司法审查的关系,高校管理关系包括招生管理、学籍管理、校内公共设施管理和校园秩序和安全管理所形成的关系。在中国语境下的大学自治制度框架内,应当建构以司法权为核心的学生个体权利救济机制。     

电针激活Nrf2/HO-1通路抗帕金森病模型小鼠氧化应激的机制研究

目的 观察电针“风府”“太冲”“足三里”穴对帕金森病(Parkinson’s disease, PD)模型小鼠大脑纹状体中酪氨酸羟化酶(tyrosine hydroxylase, TH)、核因子E2相关因子2(nuclear factor-erythroid 2-related factor 2,Nrf2)、血红素加氧酶-1(heme oxygenase-1,HO-1)水平的影响,探讨电针治疗PD的可能机制。方法 将30只小鼠按随机数字表法分为对照组、模型组和电针组,每组10只。模型组、电针组小鼠按照30 mg/kg腹腔注射1-甲基-4-苯基-1,2,3,6-四氢吡啶(1-methyl-4-phenyl-1,2,3,6-tetrahydropyridine, MPTP)制备PD小鼠模型。电针组小鼠给予“风府”“太冲”“足三里”穴电针干预,每日1次,每次30 min,连续干预12 d。其余两组小鼠不予任何干预。采用爬杆实验和悬挂实验观察3组小鼠行为学改变,旷场实验观察小鼠自主运动总路程,免疫组织化学法检测小鼠大脑纹状体中TH表达水平,实时荧光定量PCR法检测小鼠大脑纹状体中Nrf2、超氧...     

高校社团育人机制的跨文化研究——对中美高校社团的比较分析

中美高校都十分重视学生社团工作,但两国高校社团在与社会的联系程度、社团活动经费的筹集与充裕度、社团经费管理制度方面存在差异。因此,我们要完善政策体系,构建高校社团育人机制政策平台;加强组织领导,健全高校学生社团管理制度;加大资金投入,保证高校社团育人机制良好运行;增强相互交流,强化高校社团育人功能。     

论由区分所有权人连带赔偿高空抛物所致损害的法律障碍——兼评《中国民法典草案侵权责任法编》第56条

我国侵权法草案规定侵权人不明的高空抛物致人损害,由“不能证明自己没有过错的建筑物使用人”连带承担全部赔偿责任。这实质上是对建筑物区分所有权人设定了一种对其在住宅内的行为随时举证证明的义务。这种对建筑物区分所有权人自由权利的限制和负担,无法解释和证成其正当性。建筑物区分所有权人实施的抛物行为是其承担侵权责任的根据,侵权行为人不明,受害人就无法按照侵权法获得赔偿。区分所有权人相互之间的监督义务和协助查找义务以及作证义务,乃公法上的义务;以此为根据要求其对受害人承担连带侵权责任,违反了法律关系理论的基本原理。要求建筑物区分所有权人证明没有实施抛物行为,违背了未发生的事实无法证明的证据法原理。推定所有可能实施侵权行为的人实际实施了侵权行为,违背了违法行为不能推定的侵权法原理。所以该条应该删除。     

The Impact of Language Status as an Acculturative Stressor on Internalizing and Externalizing Behaviors among Latino/a Children: A Longitudinal Analysis from School Entry through Third Grade

This study examined the relationship between limited English proficiency status, and internalizing and externalizing behaviors among a sample of Latino/a children (N = 2,840) from the US Department of Education’s Early Childhood Longitudinal Study, Kindergarten (ECLS-K) data set. Results of cross sectional regression and hierarchical linear modeling (HLM) analyses suggest that there is a positive relationship between limited English proficiency and externalizing symptoms, particularly by third grade. Additionally, sex and place of birth also helped to explain externalizing behaviors at various time points in the models. Place of birth and family poverty were significantly associated with internalizing symptoms. Implications for future research and interventions related to internalizing and externalizing behavior among the Latino/a school aged population are discussed.

Did Jamie Oliver Really Put School Dinners on the Agenda? An Examination of the Role of the Media in Policy Making

Healthy eating is high on the government's agenda in current times and to all intents and purposes the media appears to have played a crucial role in putting it there. While media focus is no doubt intense and playing a vital role in public education (take Jamie Oliver's 2005 Channel 4 documentary, ‘School dinners’, for example), the question that lies at the heart of this article, is whether the media has led the government agenda on healthy eating and school dinners as appears to be the case. A close examination of the evidence suggests otherwise: government policy was already well set before the media began to show a concerted interest and hence its influence on policy‐making is more limited than might be expected. Rather than setting agendas per se, the media's role has been to refine and energise existing policy areas and to facilitate implementation.     

Comparing Putin’s and Brezhnev’s Policies toward the Middle East

This article compares Moscow’s and Washington’s foreign policies toward the Middle East in 1982 and 2008. In 1982, Moscow and Washington each had a distinct set of friends and foes. In 2008, Washington still has a distinct set of friends and foes, but Moscow has relatively good relations with all governments and most major opposition movements in the region—the only exceptions being Al Qaeda and its affiliates. It is argued that Putin’s policy toward the Middle East is not really aimed at displacing the U.S. in the region, but protecting Russia and Russian interests from Al Qaeda and its allies. Indeed, a continued American presence in the region serves to protect Russian interests in the region.
