略论传统中国的乡村控制与村社结构

本对传统中国的乡村控制和村社结构进行了简略评述,认为在传统中国,专制国家虽然希望把自己的权力延伸到乡村社会之中,但受交通、通讯和行政管理水平的限制,在事实上不得不利用乡村社会中的权威资源实施支配与控制。地方精英的成份和功能十分复杂,不能简单地用“自治权”、“士绅社会”等概念加以概括。乡村社会的权力结构是由建立在血缘关系和地缘关系基础上的各种组织机构和个人关系构成的,对此必须综合地、辩证地加以理解。     

新形势下治安管理社会化的新探索

组织和发动群众参与治安工作,是我国公安工作的特色和优势所在,是适应治安形势变化、改变群防群治弱化状态、缓解治安管理任务繁重与警力不足的需要.可采取聘用"联防钟点工",吸引群众直接参与治安工作;将现有的专职联防队逐步过渡到理顺体制的保安队,改善群防群治队伍的成员结构,提高治安管理辅助力量的个体素质等措施,以提高整个治安主体的战斗力.     

Belgium's Anti-Sect War

Since the suicide—homicide of 53 members of the Order of the Solar Temple in 1994 and the gas attempt by Aum Shinrikyo in Tokyo's subway in 1995, a number of European states have decided to fight against sects. France and Belgium are in the forefront of this battle. Both countries have set up official observatories of sects and state agencies involving various ministries to combat them. Preventive policies targeting sects are being carried out. In Belgium, the Anthroposophic Society, a philosophical movement listed as 1 of 189 sects suspected of being dangerous, has sued one federal entity that printed unfounded accusations against their movement in a widely distributed brochure against sects. The same Anthoposophic Society has also petitioned the Court of Arbitration to have the law establishing an observatory of sects annuled. This report deals with both legal actions.     

Is Partner Aggression Related to Appraisals of Coercive Control by a Partner?

Research and clinical reports on men who are aggressive towards their intimate partners find that these men tend to behave in highly controlling ways towards such partners (e.g., restricting their social interactions, monitoring of activities, and reducing decision-making power). This study tests the hypothesis that men and women in violent dating relationships appraise such behaviors differently than individuals in nonviolent relationships. Based on clinical and empirical partner abuse literature, 119 college students rated the extent to which they perceived hypothetical behaviors towards a partner as controlling. Results suggest that individuals who had either engaged in or received partner aggression appraised restrictive, domineering, and coercive behaviors from a male to a female partner, and from a female to a male partner as less controlling than individuals who had neither perpetrated nor received partner aggression. Men also viewed those behaviors as less controlling than did women. Generalizability, clinical implications, and directions for future research are discussed.     

我国对外资银行金融监管体制的设计与创新

我国对外资银行主要实行市场准入、业务经营、资本金、税收方面的监管,但存在的问题不少,主要是监管目标的错位,导致不正当竞争,监管法律不完善等。问题的原因在于监管法治化水平不足、监管目标混乱、体制不合理。解决办法有两方面：一是宏观模式的选择,二是微观规制的创新

价值的统领：宪法与其他法律形式的关系的一个视角

一国的法制价值是通过宪法来集中表达的。宪法具有最高的法律效力,其他法律形式的规范内涵不得与宪法规范相矛盾和发生不一致,在法律效力上要低于宪法。宪法是国家根本法,是确认一个社会共同体终极价值基础的基础规范,是衡量其他法律的标准。

邓小平的《解放思想，实事求是，团结一致向前看》，是冲破“两个凡是”，解放思想，破除僵化的宣言书；邓小平的南方谈话，深刻地回答了长期束缚人们思想的许多重大认识问题，它是把改革开放和现代化建设推进到新阶段的又一个解放思想、实事求是的宣言书，他为我党重新确立和坚持解放思想，实事求是的思想路线，做出了重大贡献。     

“德—道”与“自然—自由”:庄子心性秩序理论的形上建构

在天人之辨这一主题中,局限于对庄子哲学作"客观自然义"理解,遮蔽了其心性理论及其道德哲学主旨,即如何合乎人性化生存这一存在论与价值论问题。理解庄子的心性秩序建构需要把握其双重规定性,即"德-道"理型与"自然-自由",前者构成心性秩序的本体性规定,后者则是庄子建构心性秩序的实践理性原则。在这样的理解中,自然与道德、个体性与普遍性、生命个体与伦理实体的关系及其内在张力获得伦理道德精神与心性秩序的精神还原。基于本体与现象的区分对自然与自由关系的探讨,庄子不仅深刻反思了人的道德存在本质从而呈现其存在论价值视阈,而且由对自然心性与现实人伦的深刻审察进一步敞开社会伦理向度这一重要的实践领域,探讨自然秩序与道德价值、自然心性与历史道义之间的关系,由此获得审视现代理性道德价值这一深刻的现代性论域。
