论犯罪心理学的价值范畴及其方法论

犯罪心理学作为刑事科学中的组成部分,其价值范畴体现为精神价值、实体价值与应用价值三个层次;犯罪心理学的方法论体系由科学的哲学方法论、系统方法的一般论与具体研究方法构成。本文旨在探讨精神价值与哲学方法论、实体价值与系统方法论、应用价值与具体方法之间,及其价值范畴各层次与方法体系之间的上下位协同作用关系。     

Problem Drinking, Jealousy, and Anger Control: Variables Predicting Physical Aggression Against a Partner

Alcohol use and intimate partner violence (IPV) are significantly related, but only a subset of individuals who drink are aggressive and relatively little is known about what moderates this relationship in community samples. Two risk factors, anger control and jealousy, were hypothesized to moderate the relationship between IPV and problem drinking in a sample of 453 community couples. A significant three-way interaction indicated that men with jealousy problems, but not anger control problems, were most likely to show the strongest association between problem drinking and IPV. In accord with the multiple threshold model of IPV, specific combinations of risk factors appeared to represent different thresholds in which problem drinking influenced the likelihood of IPV.

新型工业化是建立在信息化基础之上的、符合我国国情的、可持续发展的工业化道路,是我国实现工业化的有效途径。本文对我国现代服务业发展的重要意义,现代服务业存在的不适应新型工业化发展的主要问题进行了分析,在此基础上提出了推进我国现代服务业发展的对策与建议。     

盘查的法律控制

盘查具有行政与司法的双重属性,应在刑事诉讼法中明确其地位。从各国经验看,强化盘查的法律控制、合理界定警察的自由裁量权是平衡警察执法有效性与保障公民宪法权利的基本方法。我国盘查措施在适用中存在诸多问题,借鉴法治国家经验,强化盘查的法律控制是解决问题的基本路径。     

毒品犯罪的法经济学分析

从经济学的观点来看,人们是否从事某一项行为都是在利益最大化原则的支配下进行的。毒品案件的犯罪嫌疑人也是在综合分析该行为的成本收益之后才实施毒品犯罪的。以经济学的观点分析毒品犯罪的犯罪成本和犯罪收益,以此为基础对禁毒对策进行经济学的分析。     

论城市规划行政自由裁量权

行政自由裁量权的存在有其合理性,但在实际运行中,必须对其进行适当控制。在城市规划行政中,可以从加强城市规划行政法律制度的建设;强化城市规划行政程序的建设;加强城市规划行政监督与制约机制的建设;完善城市规划行政法律责任制度的建设等几方面对城市规划行政自由裁量权进行法律控制。     

THE RELEVANCE OF PEACE TO STUDIES OF DRUG MARKET VIOLENCE*

Goldstein's (1985) concept of systemic violence has contributed substantially to criminological thought and research, but its power can be enhanced by connecting it to a broader typology of social life: the resource exchange—social control typology. That typology connects systemic violence logically with two important yet neglected forms of drug market behavior: peaceful resource exchange and peaceful social control. This article, which is based on 50 in‐depth interviews with individuals involved actively or recently in drug selling, describes the various forms of violent and nonviolent resource exchange and social control in illicit drug markets, stating them in quantitative terms that are conceptually distinct and empirically observable. We conclude by discussing 1) the implications of peaceful behavior for a fuller understanding of violence and 2) the relevance of the resource exchange‐social control typology to criminological theory and research.

由于自然垄断行业诸多的特殊性，有关这些行业中企业合并的法律控制标准问题相对比较复杂。它不仅涉及到反垄断法上控制标准与行业法上控制标准的适用，而且还涉及到因自然垄断行业的公益性而产生对控制标准的特殊需求。我们有必要适度借鉴相关国家和地区的做法来完善我国相关内容，保证自然垄断行业的健康发展。     

论社会治安防控体系建设的原则和发展方向

社会治安防控体系的建设是统领各项社会治安工作的系统之举。把握原则,明确发展方向是建设治安防控体系的前提和基础。要使社会治安防控体系真正发挥作用,提高驾驭社会治安局势的能力,必须遵循坚持法治的原则、科学高效的原则、整体协调的原则、与时俱进的原则;并且要有效适应动态社会环境的需要,把握好系统化、社会化、市场化、创新化、地域化的建设方向。
