民俗旅游村:活态文化保护与开发的一种载体

活态文化是一种精神文化遗产,也是一种现实存在的文化,它最主要的传承方式是口传心授。活态文化具有双重价值:一是存在价值,这是核心价值;二是经济价值,它是存在价值派生的直接和间接的经济价值。存在价值是源,经济价值是流,存在价值越大,潜在的经济价值也越大。

从茅台、五粮液案看最低转售价格维持的反垄断法规制

最低转售价格维持是纵向垄断协议的一种形式,美国对其一直严格适用本身违法原则。2007年Leegin案判决之后,美国对最低转售价格维持转而适用合理原则,但实践中多数州以及一些学者都对该做法持有异议。我国反垄断法第14条严格禁止最低转售价格维持,似乎我国对其倾向于适用本身违法原则,茅台、五粮液案又从实践中印证了此种态度,与锐邦诉强生公司案形成不同的处理结果。对于我国这样一个缺乏反垄断法传统的国家来说,在借鉴美国和其他发达国家经验时,不仅要注意最新适用原则的转变,更要仔细甄别具体实施效果,结合我国的实际,对最低转售价格维持做出合理的反垄断法规制。     

群众路线:毛泽东的一个伟大创造

群众路线的概念虽不是毛泽东首先提出的,但赋予群众路线以丰富内涵并提升为党的群众路线理论,却是他的一个伟大创造。这是毛泽东和他为代表的中国共产党人对中国革命斗争经验的科学总结。群众路线是党领导中国革命和建设能够取得胜利和成就的一个决定性因素,也是毛泽东思想活的灵魂的一个基本点。在改革开放的今天,群众路线同样是中国特色社会主义理论体系的活的灵魂,对于实现中华民族伟大复兴的中国梦具有伟大的时代意义。     

流动的新市民:常住大陆台胞社会融入的现状评估

针对台胞在大陆的社会融入状况,本研究建构了一套测量常住大陆台胞社会融入的指标体系。该体系将社会融入划分为“经济融入”“生活融入”“社交融入”“心理融入”四个维度,含15个一级指标以及34个二级指标。通过问卷调查和深度访谈,本研究得出三点基本结论:第一,常住大陆台胞不是“实用主义的过客”,而是流动于两岸、具有较高情感认同的“新市民”群体;第二,相较于个体心理性融入,台胞在制度性层面的融入程度较低;第三,台胞社会融入在心理和行为上呈现出悖反性。     

Nocturnal Oviposition Behavior of Forensically Important Diptera in Central England

Timing of oviposition on a corpse is a key factor in entomologically based minimum postmortem interval (mPMI) calculations. However, there is considerable variation in nocturnal oviposition behavior of blow flies reported in the research literature. This study investigated nocturnal oviposition in central England for the first time, over 25 trials from 2011 to 2013. Liver-baited traps were placed in an urban location during control (diurnal), and nocturnal periods and environmental conditions were recorded during each 5-h trial. No nocturnal activity or oviposition was observed during the course of the study indicating that nocturnal oviposition is highly unlikely in central England.     

消费者的法律范畴研讨

我国现行立法没有明确“消费者”的法律概念,学术界对该概念探讨也未形成统一观点。消费目的、消费主体及消费方式一直是主要争论点,为司法人员准确判定消费者的法律范畴带来困惑。文章根据2013年修订的《消费者权益保护法》的立法宗旨,对消费者法律范畴的判定提出了客观的、可以衡量的三个核心要素,即消费客体具有商品的价值属性、消费客体被终结性消费、消费主体个人化,以利于及时、有效、合理地保护消费者的合法权益,维护市场经济秩序。     

Democratising the military: Lessons from Mediterranean Europe

This article analyses the factors and processes involved in democratizing the armed forces of Spain, Greece and Portugal in the 1970s and 1980s. After a brief comparative review of the history of civil‐military relations in the three countries, the article examines the role of societal, institutional (military professional) and international factors in the democratisation process. The article concludes that military professionalism can be a stimulant to intervention and de‐intervention, depending on societal considerations and the perceptions of the military at a given time. Explanations accounting for military democratisation can be found at the level of value‐congruency between society (including the international arena) and the armed forces.     

‘Responsibilty’ as a strategy of governance: regulating people living with AIDS and lesbians and gay men in Ontario

This paper investigates responsibility/irresponsibility as an important regulatory strategy, in two instinct but interrelated social sites – people living with AIDS and HIV, and lesbians and gay men, especially within the Canadian province of Ontario. This responsibility/irresponsibility technique of governance is developing in response to the struggles of people with AIDS and community-based AIDS groups and lesbians and gay men and the alternative strategies of regulation articulated through these struggles. Practices of ‘resistance’ and activism alter the grounds of hegemonic regulation/governance and point towards new techniques of governance. I show how responsibilizing and normalizing strategies in the context of social struggles over AIDS and sexual regulation allows for those constructed as ‘responsible’ to be managed through forms of self-regulation and professional forms of goverance of their live. For those who continue to be constructed as ‘irresponsible’ forms of criminal law, policing and public health governance are called into action.
