从实业救国到社会主义——论胡厥文的心路历程

胡厥文出生于19世纪末,经历了几个不同的朝代,从立志走实业救国的道路到真心实意地拥护中国共产党走社会主义的道路,实现了爱国、救国、建国的抱负.他是中国民主建国会的创建人和领导人之一,与中国共产党长期亲密合作,为中国新民主主义革命的胜利和社会主义革命和建设事业的发展作出了重要贡献.     

HELPING CLIENTS TRANSITION TO INDEPENDENT LIVING

There is growing recognition and concern that too many of the 20,000 foster youth who age out of the child welfare system each year 1 in this country do so without the basic necessities of housing, education, employment, and health care. The purpose of this article is to outline the problems facing foster youth as they leave care and to detail, as a case study, the steps taken by KidsVoice, a Pittsburgh legal services organization representing almost 5,000 dependent children each year, to help youth in foster and substitute care transition more successfully to adulthood and independent living.     

法学方法论的困境与出路——论最小损害原则

近几年以来,国内对法学方法论的研究呈现出一派繁荣之势。但其成效如何,却有待检验。文章结合中国司法实践中所出现的疑难案件来检验当下法学方法论研究的成果,指出语义分析、法律解释、法律论证与利益衡量等法学方法所面临的困境与原因。在此基础上,从现实的司法实践中总结、重构出最小损害原则,以法律教义学体系为最小损害的对象,以损害之命题所处的层级、损害之确定性程度、损害的原因以及损害的波及度作为比较损害大小的标准,以期为至少大部分疑难案件提供可能的解决思路。     

民主·宪政民主及其低度程序法则

人是民主的目标,任何意义的民主都与人的生活方式有关;政府是民主的载体,民主是引领政府走向人道的唯一方法。民主政治的核心程序是竞争性的选举,但选举仅仅是一种低度的民主形式。宪政民主乃民主体制与宪政主义的有机结合,使它得以运转的低度程序法则,正是现代政府合法性的低度标准。     

A syndicalist moment? Democracy,insurgent unionism,and the ‘Outlaw Strike’ of 1920

This article considers World War I era labor insurgency through an examination of the 1920 ‘outlaw’ switchmen’s strike, one of the largest rank-and-file revolts of the postwar strike wave. Drawing upon Bureau of Investigation surveillance reports, the article argues the strike represented not so much an expression of a ‘syndicalist impulse’ as a struggle over the definition of the new unionism and the ideological legacy of the war. Inspired by the wartime rhetoric of Americanism and industrial democracy, pressed by the rising cost of living, and frustrated with the failure of the state and their parent unions to deliver living wages, the insurgents briefly succeeded in building democratic, cross-craft unions. The rebel unionists failed, but the ‘Outlaw Strike’ arguably was as important as the later and larger 1922 national shopmen’s strike in the way it highlighted issues of wages, union democracy, and employee representation.
