大陆法系将无因管理划归"债权法"范畴,其重点在于保护无因管理人的权利,与之对立的是英美法系,它从衡平原则出发,从保护"本人"的自由角度来考虑问题。正是因为二者的出发点不同,才为法律在处置无因管理人之报酬请求权一事上提供了两种不同的思考路径:前者肯定了无因管理行为的积极意义,后者从权利义务的平等角度提出要防止管理权被滥用的可能性。这也为中国今后的民事立法提供了更为广阔的研究空间,并因之而加深对成立无因管理的道德基础与文化价值的理解,为最终解决管理人的报酬请求权问题提供正确的理据。  相似文献

In this paper I try to see how the Derridean aporias of the law of the urgency of legal decisions (the law interrupts the input of knowledge in the decision-making process) and the épokhè of the rule (justice can never be done in the present) are revealed in the context of the justification of sanctions. I argue that sanctions can only be justified in a purposive manner in the last instance. They can only be means to an end of punishment which has been opted for, and which can be justified on grounds of principles, or an authoritative calculation of incommensurable entities. I argue against theories, which advocate the internal connection of law and morality, because if such a connection could be established, the aporia of the hurried and unjustified action would obviously disappear. In particular my target is discourse theory as formulated mainly by Robert Alexy with his Sonderfallthese(Special Case Thesis). My objection is that, because of their instrumental nature, sanctions cannot be justified on moral grounds. I also consider some objections that could be raised from Klaus Günther's theory of appropriateness and Habermas' distinction between the moral, ethical and pragmatic employments of practical reason. I am argue that the former, which would become relevant at the stage of application, that is sentencing, does not resolve the justificatory problem of sanctions, and the latter confirms rather than falsifies my claim that punishment can never be said to be just.  相似文献

In his Democratic justice and the social contract, Weale presents a distinctive contingent practice-dependent model of ‘democratic justice’ that relies heavily on a condition of just social and political relations among equals. Several issues arise from this account. Under which conditions might such just social and political relations be realised? What ideal of equality is required for ‘democratic justice’? What are its implications for the political ideal of citizenship? This paper focuses on these questions as a way to critically reconsider Weale’s model. After presenting Weale’s procedural constructivism, I distinguish his model from an institutional practice-dependent model, one salient example of which is Rawls’s political constructivism. This distinction allows for a formulation of the social and political equality required for justice in each case. The contingent model assumes that an equality of ‘status’ will generate just social practices, yet it fails to recognise that an equality of ‘role’ is also important to ensure citizens’ compliance. The paper ultimately seeks to show that the contingent model is insufficient to ensure that just social practices will become stable.  相似文献

ABSTRACT

The paper inspects how agrarian debates apply to rural Belarus. Following the ‘persistence versus disappearance’ debate, it finds the moral economy alongside request for change. Pursuing the ‘adaptation versus resistance’ debate, it spots adaptability and exclusion of those failing to adapt. Here ‘lukascism’ surfaces resting on constructing the ‘other’. A rare case of agrarian populism employed by top authority, lukascism is otherwise humdrum. Proclaiming some principles of the moral economy while disregarding others, inconsistent lukascism undercuts the ‘coexistence scenario’ of households with large-scale farming. With nine main theses that are interspersed with each other, this paper explores and articulates some of the most important questions in natural law theory. The theses include: I. In investigating facts, one finds reasons to choose an honest self-discipline; II. Deliberating, one finds reasons similarly directing one to other intrinsic goods; III. Taken integrally, these goods and principles acquire the force of moral precepts; IV. Those precepts, natural moral law, depict our nature (humanity) in its flourishing; V. Nature and natures are best explained by free, intelligent transcendent creation; VI. Creation and other gifts past and present deserve our gratitude; VII. Natural moral law and historical revelation are two channels of information; VIII. Secular and spiritual communities are distinct and respectfully self-governing; IX.
