我国涉外合同的法律适用及完善

我国涉外合同的法律适用尽管采用了国际上先进的意思自治原则和最密切联系原则 ,但现行立法原则性太强 ,缺乏可操作性 ,应加以完善。意思自治原则方面 ,应对当事人选择法律的方式、时间、范围、法律选择的限制等事项加以明确规定。与此同时 ,最密切联系原则作为当事人意思自治原则的补充 ,应尽快出台相应法规加以明确规定。     

《行政许可法》的价值取向及实施中诸问题预测

《行政许可法》的基本价值取向是限权、便民、服务、公开和透明,它也体现着市场主体自主,社会公益、行业自律及行政事后监督优先的价值取向。地方政府及其工作人员可能在观念上有较大抵触;有关法律法规清理修订可能存在工作量大、时间紧迫而合格专业人员不足的问题;许可法在东西部的实施情况会有较大的差距。     

新时期村民自治存在的问题与对策

村民自治在民主决策、民主管理、民主监督等方面面临诸多困难和问题,构筑村民自治之路是一项比较复杂的系统工程,需要全社会关注、支持和配合。     

The parental problem-solving measure: Further evaluation with maltreating and nonmaltreating parents

Inability to solve problems related to parenting and other aspects of daily living is hypothesized to result in frustration or inability to cope, and contribute to the occurrence of problematic parental behavior such as physical abuse or neglect. The present investigation evaluated the Parental Problem-Solving Measure (PPSM), a procedure for measuring parental problem-solving skill of maltreating and nonmaltreating parents. Subjects were 60 parents with at least one child between the ages of 2 and 12. Subjects belonged to one of three groups: (a) physically abusive and/or neglectful parents (n=27); (b) nonmaltreating clinic parents seeking help for child behavior problems (n=12); and (c) nonmaltreating, non-help-seeking community parents (n=21). Results demonstrated the interrater reliability, internal consistency, and temporal stability of the PPSM and its five subscales. Support is also provided for the convergent and discriminant validity of the measure.

Stability and Changes in Problem Behavior During Adolescence: Latent Growth Analysis

The aim of this study was to examine growth trajectories of externalizing and internalizing problems during adolescence. In addition, we also examined factors that might account for individual differences in the level of problem behavior and in the rate of change: Adolescent gender and the quality of the relationships with parents and peers. The sample consisted of 212 adolescents (mean age 13.4 years at the initial assessment) who were assessed at 3 measurement waves with approximately 1-year intervals. The results showed substantial absolute and relative stability in both types of problem behavior, but also significant individual differences in both initial levels of problem behavior and in the rate of change across the 3 measurement occasions. Adolescent gender and the quality of the parent–adolescent relationship predicted the initial level of both externalizing and internalizing problems. The protective effect of the positive quality of the relationship with peers was found for internalizing but not for externalizing problems. No differences appeared between boys and girls in the effect of the quality of interpersonal relations on the level and on the rate of change in problem behavior, suggesting that the etiology of problem behavior might be similar for boys and girls in spite of gender differences in the prevalence of problem behaviors.     

关于完善国有企业委托——代理关系的思考

委托—代理理论重点研究委托人与代理人之间的权责关系如何体现在契约中。我国国有企业中的委托—代理关系由于种种原因存在着诸多的问题。要完善国有企业委托代理关系必须建立正确、灵活、有效的激励机制;建立强有力的监控机制;加强公司外部法规和制度建设;培育职业经理人市场;重视企业文化。     

监狱人民警察心理卫生状况调查

目的:通过对监狱人民警察心理健康与人格量表的测定,研究其心理卫生状况及影响因素。方法:295名监狱人民警察参加了本研究,其中男警察197人,女警察96人。所有被试填写了症状自评量表(SCL-90)及艾森克人格问卷(EPQ)。结果:34.95％的监狱警察存在心理健康问题,严重程度相比国内正常人群要轻;一线工作警察比科室工作的存在显著差异,且前者严重;男性监狱警察比女性心理卫生问题突出。SCL-90与EPQ得分相关分析表明,情绪越不稳定或精神质越明显者,倾向出现更多的心理健康问题;性格越内向、掩饰倾向越弱心理健康问题越突出。
