析清"应当知道"的教义学意涵,应当区分其具备的三种不同意义:词源意义、语境意义和类别意义。在词源意义上,"应当"是一个多义情态动词,既可表示推测性判断,又可表示规范性命令;"知道"则具备多元时态面向,这共同决定了"应当知道"具备多元的词源意义。在语境意义上,级次混乱造成了"应当知道"含义探寻的难题,但厘清"应当知道"条款的证据规则属性后,即可将其界定为有间接证据证明的知道,系对故意的认识层面之描述。在类别意义上,"应当知道"是对知道与否的概率判断,而非对知道确切程度的判断,其与直接故意或间接故意的类别定性没有逻辑关联。 相似文献

Use of metaphors is a staple feature of how we understand policy processes – none more so than the use of ‘policy stages’/'cycles’ and ‘multiple streams’. Yet even allowing for the necessary parsimony of metaphors, the former is often criticised for its lack of ‘real world’ engagement with agency, power, ideology, turbulence and complexity, while the latter focuses only on agenda‐setting but at times has been utilised, with limited results, to understand later stages of the policy process. This article seeks to explore and advance the opportunities for combining both and applying them to the policy‐formation and decision‐making stages of policy making. In doing so it examines possible three, four and five stream models. It argues that a five stream confluence model provides the highest analytical value because it retains the simplicity of metaphors (combining elements of two of the most prominent models in policy studies) while also helping capture some of the more complex and subtle aspects of policy processes, including policy styles and nested systems of governance. 相似文献

This article suggests theoretical refinements to the multiple streams framework (MSF) that make it applicable to parliamentary systems and the decision‐making stage of the policy process. Regarding the former, the important role of political parties in parliamentary democracies is highlighted. Party policy experts are expected to be members of the policy communities in the policy stream and to promote viable policy alternatives in their respective parties, while the party leadership is concerned with adopting policies in the political stream. With regard to the latter, the introduction of a second coupling process to analyse decision making more rigorously is suggested. Moreover, the article provides operational definitions of the framework's key concepts when applied to parliamentary systems and derives a systematic set of falsifiable hypotheses for agenda‐setting and decision making in these systems, thus addressing one of the main critiques against the MSF – namely that no hypotheses can be derived from it. 相似文献

SUMMARY The Hawaiian Studies Program (HSP) integrates the learning of Hawaiian culture with more traditional secondary curriculum in science, social studies, and English. Students also participate in weekly community service-learning sessions. Fifty-five HSP students and 29 peers (who were not involved in the program), completed a survey measuring: students' connection to, pride in, and responsibility for their community; civic attitudes; and career knowledge and preparedness. HSP teachers, community members, and students were also interviewed about program outcomes. Compared to other peers, HSP students tended to report feeling more connected to their community and school and to agree that they had career-related skills. Participants believed that service-learning contributed to these outcomes by making connections between school and community life and by exposing students to a variety of careers. 相似文献

Turkey initiated a major reform in its criminal justice system in 2005 and a probation system was officially created. This article analyses the probation policy formation, and development processes in Turkey using a multiple streams framework (MSF), as theorised by John Kingdon. Qualitative method is employed through archival records, governmental documents, and semi-structured interviews with key actors. Findings suggest that MSF explains the evolution of the probation system, which emerged in a critical time. However, although the probation system was set up to overcome the increasing prison population and alternative to incarceration, the number of prisoners and probationers have increased significantly. Today, Turkey has been ranked one of the largest prison population in the world. It is concluded that the penal policy has led to unintended consequences, and the penal system including probation practices has been dramatically politicised by the government. 相似文献

The recent work of Loïc Wacquant identified the emergence of the penal state as a core feature of the global expansion of neoliberalism and the neoliberal government urban marginality. Drawing on Wacquant’s theoretical and conceptual reflections, this article analyses the emergence of a Latin American form of penal statecraft. By taking an in-depth look at the increasing criminalization of urban marginality in contemporary Latin America as well as the related developments in the local prison system, the single most important institutional expression of the Latin American penal state, important commonalities and differences between the penal statecraft experiments throughout Latin America and the countries of the ‘developed world’ are highlighted. 相似文献

ABSTRACTA considerable proportion of crimes involve multiple perpetrators. Yet, little is known about how police officers construct, administer, and record eyewitness identification procedures for multiple suspects. An online survey of law enforcement agents in Sweden, Belgium, and the Netherlands (N?=?51) was conducted to obtain an initial understanding of police perceptions of prevalence and characteristics of multiple perpetrator crimes, and to examine identification procedure practices given the little to no guidance provided for police. Practice converged when it came to the use of sequential, photographic lineups, but diverged between and within countries on whether or not suspects of multiple perpetrator crimes should be placed in separate lineups. Results specifically highlight contextual cuing as one critical area for future research in identification for multiple perpetrator crimes (i.e. placing multiple suspects in the same lineup or asking eyewitnesses to look for a specific suspect). 相似文献

Homes in multiple occupancy (HMOs) – residential properties containing common areas shared by several households – are a growing feature of the housing landscape across the UK. They have often been subject to political stigmatization as a result, in part, of comprising poor quality dwellings. This paper uses a “spaces of exception” framework to explore the juridical and material mechanisms involved in the rise of fuel poverty among people living in HMOs. Having analysed evidence from interviews, census data and the secondary literature pertaining to the English context, we highlight the processes that have led to the biopolitical othering of this housing stock in institutional and infrastructural terms. We argue that the expansion and persistence of fuel poverty in HMOs are promoted not only by the disproportionate concentration of low-income residents in relation to the rest of the private rented sector, but also by the socio-technical configurations that underpin this type of housing. Fuel poverty can thus be seen as the joint outcome of broader practices of legal, political and material delegitimization. 相似文献
