国际法中健康权的产生、内涵及实施机制

健康权作为二战后兴起的一项重要人权,其发展路径具有从国际法向国内法扩展的特点。"人身的固有尊严"是健康权的正当性基础所在,也决定着健康权的基本内涵。《经济、社会和文化权利国际公约》第12条第1款规定的健康权既是自由权,也是社会权,既指获得卫生保健的权利,也包括获得构成健康基础条件的权利;第12条第2款规定只是列举了公约起草者认为特别重要的四项义务,而非缔约国的全部义务。缔约国义务的性质和范围必须结合公约第2条规定的一般义务条款加以判定。健康权的实施机制包括缔约国报告机制、书面申诉机制,以及调查报告机制三种,不同机制对缔约国的约束力不同,综合运用多种机制确保健康权的有效实施是今后的发展趋势。     

Medical–Legal Partnerships: How Legal Services can Dramatically Improve Health Outcomes,and the Missed Opportunity to Help Women Seeking Abortions

There are significant health disparities in the United States, with low‐income and minority Americans experiencing higher rates of chronic disease and autoimmune disorders. Research has firmly established that social factors ‐ such as malnutrition, limited access to healthcare, and safe housing ‐ play a critical role in these health disparities. Medical‐Legal Partnerships are a relatively new approach to improving the health of people living in poverty by addressing the root causes of these health‐harming social factors. This article discusses the benefits of Medical‐Legal Partnerships and argues for continued expansion of the model, particularly in pediatricians’ offices, because parents are more likely to seek medical care for their children than themselves. This article further discusses how legal constraints prevent federal funding for Medical‐Legal Partnerships in abortion clinics; this creates a missed opportunity to work with women who are seeking abortions, many of whom face considerable social and economic challenges that could be addressed through legal assistance. This article digs into the legal restrictions that create this missed opportunity and proposes potential solutions to better serve the vulnerable population of abortion‐seeking women.     

Target congruence theory and Latino youth victimization

While a number of studies have found that immigrant youth are less likely to engage in delinquency, they are more likely to report victimization. Scholars have traditionally attributed this finding to American cultural norms that may generate marginalization and culture conflict that, in return, increases the likelihood of victimization. However, few studies have applied victimization theories to this study population. Therefore, the purpose of this study is to apply Target Congruence Theory to test its capability to explain victimization among Latino youth. Data collected from the Dating Violence Among Latino Adolescents (DAVILA) Study shows that a target’s vulnerability, gratifiability, and antagonism modestly predicted their victimization. Results, as well as the study’s limitations and suggestions for future research, are discussed.     

Reducing Domestic Violence and Improving Outcomes for Children: Funding Civil Legal Aid to Maximize Impact

Domestic violence survivors and children in foster care often experience significant unmet civil legal needs. Legal aid services, when adequately funded, can help close the justice gap for these two populations while improving safety, stability, and court efficiencies. However, despite ample literature demonstrating how legal aid can improve outcomes, almost half of those seeking legal aid services are turned away due to lack of resources. This article reviews the research and data about how legal aid can improve outcomes for people in the domestic violence and child welfare contexts. It also discusses how several state‐administered federal funding opportunities—including the Victims of Crime Act (VOCA) Victim Assistance Formula Grant Program, Title IV‐D child support funds, and Temporary Assistance for Needy Families (TANF) basic block grants—can fund the needed civil legal help.     

Guiding Principles for Family Justice Programs

The Association of Family and Conciliation Courts and Relate, UK, co‐convened a 24‐hour consultation at St George's House, Windsor, UK, on modern family justice issues across Europe. This article identifies a preliminary set of guiding principles for family justice programs developed by consultation participants.
