未成年人违法犯罪特征探究 --以近5年的北京市为例

在调研的基础上,以北京市为例阐述未成年人违法犯罪的基本特征——主体特征从作案成员的身份看,无业人员、农民、学生居多;从文化程度看,初中、小学文化程度的居多;从年龄看,原先低龄化趋势有所缓解。类型特征从作案类型看,侵财型案件最为突出;从作案方式和手段看,共同作案多,团伙作案突出,作案手段暴力化、成人化、智能化。     

胆囊收缩素基因单核苷酸多态性与精神状态的关系及法医学意义

胆囊收缩素（cholecystokinin,CCK）是一种具有广泛生物学活性的脑肠肽,既是胃肠道主要调节激素之一,还广泛存在于中枢及外周神经系统中以神经递质或神经调质的形式发挥重要的生理作用。近年来国内外研究发现,CCK基因上存在多个单核苷酸多态性（single nucleotide polymorphisms。SNP）位点,其中一45C／T,-196G／A变异与多种精神状态如精神分裂症、抑郁症、自杀行为、帕金森病等存在一定的相关性。这些SNP多态性可应用于法医物证学的亲子鉴定和个人识别,并且可能成为某些特殊案例如涉及精神病鉴定、法医病理学的疾病鉴定、异常行为（自杀倾向等）鉴定的辅助指标之一。     

谷氨酸受体基因单核苷酸多态性与精神分裂症的关联

谷氨酸是人类神经系统中重要的兴奋性神经递质,通过与受体结合发挥生物学作用.当编码受体的基因异常时,可能导致精神疾病发生.本文通过回顾相关研究,发现诸如GRIN1、GRIN2B、GRM3等受体基因上的rs11146020、366C/G、rs1468412与精神分裂症相关联;同时也存在矛盾的研究结果,表明精神分裂症可能为多因素、多位点、多基因复杂遗传疾病.部分位点如GRIN2B上的366C/G、2664C/T,GRIK2上的rs1408766(C/T)的遗传多态性较好,可能成为法医学个人识别与亲权鉴定的新指标.该领域研究在司法精神病的鉴定工作中可能具有潜在的意义.

近年来,由特殊关系引发的不作为侵权案件不断涌现,给我国侵权行为法提出了新的课题。经过司法实践的长期总结,特殊关系的类型多样,但主要是"学校、教师与学生之间的特殊关系"、"专门职业人员与契约相对人、第三人之间的特殊关系"、"恋人之间的特殊关系"等。特殊关系理论在分析过程中体现的不足和缺陷,需要各国理论和司法实践的不断深入和更新。

Bullet Caliber and Type Categorization from Gunshot Wounds in Sus Scrofa (Linnaeus) Long Bone

Studies on ballistic trauma to the ribs and thorax, cranium, and long bones demonstrate the potential of obtaining a bullet caliber from an entrance wound. In order to validate prior research on caliber estimation in bone tissue and assess the viability of bullet type determination based on the macroscopic evidence at the entrance wound, thirty fleshed pork (Sus scrofa) shoulders (humeri) were shot with either lead or copper jacketed bullets in one of three calibers; 0.22, 9 mm, or 0.38. Overall, our findings are consistent with previous research indicating that calibers can be grouped into “small” and “large” categories. Bullet type, lead or copper jacket, can be ascertained based on cortical flaking and the analysis of materials deposited around the entry wound. The addition of this evidence holds value in cases where no firearm or ballistic evidence is recovered from a crime scene.     

Narratives of Being a Helper: The Presentation of Supporters and Victims in Victim Support Sweden

The aim of this study was to determine how self-presentation is formulated in victim supporters’ narratives of their interactions with crime victims, and identify the function of the presentation of the crime victim in this self-presentation. This was done through a narrative analysis of material from 12 focus groups in which representatives of Victim Support Sweden discussed their work. A master narrative was identified, in which ideals of flexibility and helpfulness are counterbalanced with ideals of setting proper limits. The analysis also showed that helper ideals were presented in a consistent way, while the concrete helping repertoire presented varied greatly.     

Destruction,Narrative and the Excess of Uniqueness: Reading Cavarero on Violence and Narration

In this article, I critically engage Adriana Cavarero’s account of uniqueness via an analysis of her work on narrativity and violence. I suggest there is an ambivalence in Cavarero’s account of uniqueness: Cavarero argues both that uniqueness is susceptible to destruction, and that it cannot finally be annihilated. To make this clear I use Cavarero’s account to read a narrative offered by Miklós Nyiszli, of a woman who survived an Auschwitz gas chamber. I contrast this to Cavarero’s reading of Eurydice and Orpheus, arguing that the ambivalence in Cavarero’s account can be resolved by thinking an excess proper to uniqueness.
