Regionalism,personalism, ethnicity,and violence: parties and voter preference in the 2010 parliamentary election in Kyrgyzstan

On the basis of interviews, census data, and precinct-level electoral results from the October 2010 parliamentary election in Kyrgyzstan, this paper examines the influences on the party vote in Kyrgyzstan. Instead of traditional socioeconomic variables, this study finds that regionalism (North vs. South), ethnicity, personalism, and violence offered the most compelling explanations of party preference in Central Asia's most competitive election. The paper also examines the contextual factors that constructed and filtered voter demand, from Kyrgyzstan's political and economic conjuncture in 2010 to its unusual party system and electoral rules.     

Evaluation of Postmortem Bacterial Migration Using Culturing and Real‐Time Quantitative PCR

Postmortem bacteriology can be a valuable tool for evaluating deaths due to bacterial infection or for researching the involvement of bacteria in various diseases. In this study, time‐dependent postmortem bacterial migration into liver, mesenteric lymph node, pericardial fluid, portal, and peripheral vein was analyzed in 33 autopsy cases by bacterial culturing and real‐time quantitative polymerase chain reaction (RT‐qPCR). None suffered or died from bacterial infection. According to culturing, pericardial fluid and liver were the most sterile samples up to 5 days postmortem. In these samples, multigrowth and staphylococci were not or rarely detected. RT‐qPCR was more sensitive and showed higher bacterial positivity in all samples. Relative amounts of intestinal bacterial DNA (bifidobacteria, bacteroides, enterobacter, clostridia) increased with time. Sterility of blood samples was low during the studied time periods (1–7 days). The best postmortem microbiological sampling sites were pericardial fluid and liver up to 5 days after death.     

论城市房屋拆迁制度的正当性缺失及补救

城市化建设与经营必然导致房屋拆迁 ,但拆迁事关民生 ,因而完善城市房屋拆迁制度 ,有效维护当事人的合法权益成为关注点。我国城市房屋拆迁制度以现行城市房屋拆迁条例为基础 ,但该条例在拆迁目的、拆迁依据、拆迁程序和拆迁补偿安置等方面存在正当性缺失 ,致使该法规实施效果不理想。补正这些缺失 ,是完善我国房屋拆迁制度的基本要求 ,也唯有如此才能从根本上有效避免“拆迁之痛”     

网络经济犯罪案件管辖权的确定

对于网络经济犯罪案件,由于计算机网络的跨地域性、超越时空性、犯罪行为与结果的分离性等原因,传统管辖权所获得的基本联结点变得不好确认,由此给传统刑法管辖规定带来了新的挑战,导致犯罪行为地、犯罪结果发生地确定困难。紧紧抓住以属地管辖为基础,以属人管辖为原则,保护管辖和普遍管辖为补充的刑事管辖原则,结合网络技术知识,深入研究国家刑事管辖权和公安机关的地域管辖权的确定问题,可以为公安、司法机关打击日益猖獗的网络经济犯罪提供帮助。     

War and identity: the case of the Donbas in Ukraine

Abstract

The study of identities struggles to capture the moments and dynamics of identity change. A crisis moment provides a rare insight into such processes. This paper traces the political identities of the inhabitants of a region at war – the Donbas – on the basis of original survey data that cover the four parts of the population that once made up this region: the population of the Kyiv-controlled Donbas, the population of the self-declared “Donetsk People’s Republic” and “Luhansk People’s Republic,” the internally displaced, and those who fled to the Russian Federation. The survey data map the parallel processes of a self-reported polarization of identities and the preservation or strengthening of civic identities. Language categories matter for current self-identification, but they are not cast in narrow ethnolinguistic terms, and feeling “more Ukrainian” and Ukrainian citizenship include mono- and bilingual conceptions of native language (i.e. Ukrainian and Russian).     

场所搜查范围的判断基准——以宪法隐私权为视角

公民住宅不受侵犯是宪法所赋予我国公民的基本权利。该权利要求在对场所进行刑事搜查时应当根据一定的基准将其分为住宅和其他场所,并适用不同的搜查程序以体现出对公民住宅权利的保护。西方所普遍接受的隐私权理论为住宅和其他场所的界分提供了良好的理论基础,这一点在我国刑事立法存在空白的情况下具有尤为重要的借鉴价值。我国的司法实践应当采用宪法隐私权学说作为区分住宅和其他场所的理论基础,并在此基础上采用对公众的开放性原则作为判断基准。
