我国大陆现存的民事权利概念是专门由民法学家经营的一个概念,是民法学视域下的民事权利概念,也是狭义的民事权利概念。法哲学视域下的民事权利概念,是应该由法理学家或宪法学家经营的一个概念,是广义的民事权利概念。该概念应是站在法哲学的高度,在整个法学领域内,对民事权利进行全景式的认识和研究,因而该概念更具全面性和普适性。法哲学视域下的民事权利概念有利于全面认识和揭示民事权利的属性;有利于全面认识和揭示民事权利对法的作用和在法体系中的地位;有利于语词使用上的一致性。 相似文献

《清洁水法》、《综合环境反应、赔偿与责任法》、《石油污染法》构建了美国自然资源损害赔偿范围的基本框架。赔偿金的确定过程需经历自然资源损害的识别、资源价值的认定和赔偿路径的选择几个阶段。这一过程也构成了理解赔偿范围——修复费用、过渡期损失和评估费用,分析赔偿全面性的线索。这为我国自然资源损害赔偿制度的建立提供了借鉴。 相似文献

In this paper, it is argued that we need to understand the role of ‘hate’ in the organisation of bodies and spaces before
we ask the question of the limits of ‘hate crime’ as a legal category. Rather than assuming hate is a psychological disposition
- that it comes from within a psyche and then moves out to others - the paper suggests that hate works to align individual
and collective bodies through the very intensity of its attachments. Such alignments are unstable precisely given the fact
that hate does not reside in a subject, object or body; the instability of hate is what makes it so powerful in generating
the effects that it does. Furthermore, although hate does not reside positively in a subject, body or sign, this does not
mean that hate does have effects that are structural and mediated. This paper shows that hate becomes attached or ‘stuck’
to particular bodies, often through violence, force and harm. The paper dramatizes its arguments by a reflection on racism
as hate crime, looking at the circulation of figures of hate in discourses of nationhood, from both extreme right wing and
mainstream political parties. It also considers the part of what hate is doing can precisely be understood in terms of the
affect it has on the bodies of those designated as the hated, an affective life that is crucial to the injustice of hate crime.

由于法律传统和人文环境的不同,陪审制在英美法系国家与大陆法系国家以不同的形式存在.英美法系国家实行的是陪审团制,而包括我国在内的大陆法系国家实行的则是参审制.我国不具备陪审团制生存的条件,而参审制式的陪审制的施行绩效又不如人意.面对这一现实状况,我们不能再进行简单的选择和取舍,而应该进行制度的重新架构. 相似文献

In December 2015, leaders from Central and South Asia took part in the ground-breaking ceremony for the Turkmenistan-Afghanistan-Pakistan-India (TAPI) natural gas pipeline project. Sixteen months later, a confusing information flow continues to obfuscate external assessments of the project’s development: official rhetoric notwithstanding, there is no certainty on the details of project financing, while the pipeline route has yet to be determined. To illuminate this obscure implementation path, this article regards TAPI as a virtual pipeline, an infrastructure project that wields invaluable influence only when it is employed as a foreign policy tool or permeates domestic discourses of progress framed by the elites of the four consortium partners. The constituent elements of TAPI virtuality are discussed here through a dedicated focus on the process of energy policy-making of Turkmenistan – the sole supplier of gas for the pipeline project and the consortium’s key stakeholder. 相似文献

Yeats’On Baile’s Strand is an important work in the Irish Literary Revival. On Baile’s Strand is a thought-provoking ethical tragedy, and also a play that reflects the ideology of cultural nationalism of Yeats. In this play there is staged development from natural emotion, free emotion to ethical emotion and moral emotion. Cuchulain is motivated by his natural emotion and free emotion in most cases. He fails to take the ethical responsibility as a husband, father and little king, which aroused the jealousy, revenge and incrimination from Aoife and Conchubar. After killing his own son who he has never seen, Cuchulain regains his ration. His ethical emotion and moral emotion makes it impossible for him to withstand his guilt, even though he fights bravely in hundreds of wars and has killed numerous people. Finally, he goes to madness, and throws himself into the sea to fight against the waves. With Cuchulain’s tragedy of filicide and madness in On Baile’s Strand, Yeats warns Irish people of improving their morality and education, so as to promote the Irish national independence and national liberation. 相似文献
