买卖合同的成立及其认定

合同的成立要件应当包括当事人、标的和合意,标的的数量和质量均为将标的特定化的因素,而非独立于标的的要件。《法释(2012)8号》对当事人提供送货单、收货单、结算单、发票以证明买卖合同已经成立的规定,笔者基本赞同,但主张类型化和区分签收人的身份而定;对对账确认函、债权确认书等函件、凭证的证据效力的认定,笔者表示赞同。意向书、备忘录依当事人的意思可有本约、预约和无积极的法律约束力的文件三种类型,《法释(2012)8号》仅仅注意到一种,因而合同编不应一刀切地吸收该种解释,而应视意思表示的具体情形而定。本约生效后相应的预约应该功成身退。违反预约的责任在绝大多数情况下不同于违反本约的责任,但鉴于确定违反预约的损害赔偿的数额特别难以确定,在个别场合可比照违反本约的赔偿范围确定违反预约的赔偿数额。当事人不履行预约项下的义务,在某些情况下可直接判决本约成立,在多数情况下只能判决损害赔偿。     

TRAGIC CONSCIOUSNESS,NATURAL LANGUAGE AND MODERN SPIRIT OF THE RULE OF LAW

Tragic consciousness, which originated in childhood, is complex compassion based on strong self-consciousness. After being moralized, tragic consciousness presents the dichotomy of good and evil, which has not only profoundly affected the formation of natural language, but also cradled the theory of natural law and religious spirit. Modern jurisprudence attempts to get rid of the shackles of classics and Christian humanism, to shape the autonomous and self-consistent image of law with the de lege lata as center. However, it is difficult for modern jurisprudence to surpass the natural language which rooted in tragic consciousness, and impossible to neglect or deny the independent value of the human. The inherent conflict within the rule of law makes ironically a tragedy, especially in the context of contemporary China.

基本公共服务均等化是保障公平正义的基础,公平正义是基本公共服务均等化的本质要求。我国基本公共服务供给不足、发展失衡直接影响着社会公平正义的实现,需要深化行政改革,通过建立以民为先的责任体系、参与和监督体系、合理的考核体系等,提升政府服务意识,推进政务公开透明,建设服务型政府,从而促进基本公共服务均等化。     

The Wilderness Act of 1964 and the Wilderness Preservation Policy Network

ABSTRACT

This article surveys an unpublished piece in which Friedrich Engels examined the ecological conditions of Ireland in a chapter entitled the “Natural Conditions” in his unfinished History of Ireland. In interpreting Engels’s findings dialectically we are able to explicate a dialectical framework that gives us a greater insight into how Engels understands the way in which the dialectics of nature enfold in a particular bioregion and how, crucially, those same organic processes of nature provide the necessary ecological conditions for society to engage in agricultural cultivation. The geological system of Ireland and its particular sieve-like structure moderate the climatic condition of excessive rainfall so that cultivation can continue. This investigation by Engels can be seen as a concrete case study into the dynamic metabolising relationships between the diverse organic processes of Nature as they are appropriated by society in agricultural production. The conceptual trajectory of this dialectical analysis is to emphasise the inherent fluidity, mutual interaction and “universal connection” of the forces of nature. This particular work of Engels’s is a significant contribution to our understanding not only of the dialectics of nature but also of the methodology of dialectics as such.     

Undignified Thoughts After Nature: Adorno's Aesthetic Theory

Abstract

This paper seeks to redress the marginalization of Adorno in environmental philosophical discourse. Kate Soper describes two opposing ways of conceiving nature. There is the redemptive "nature-endorsing" paradigm that lays claim to the intrinsic value or "otherness" of nature. Conversely, the "nature-sceptical" approach denies that we can access originary, untouched nature. This paper argues that the significance of Adorno's treatment of natural beauty lies in how he brings these approaches together. In writings that resonate with the dual connotations of Sebald's phrase "after nature", Adorno both affirms the skeptical point that we cannot transcend a human history alienated from nature as well as retaining redemptive hope wherein art "after" nature seeks creative possibilities from out of the very ruins of history marked by nature's destruction.     

The Defining Elements of Advocacy Coalitions: Continuing the Search for Explanations for Coordination and Coalition Structures

As the theoretical and practical interest in policy networks increases, so does the need for further research into how, and based on what rationales, actors within a policy subsystem engage in interorganizational collective action and form political coalitions. The aim of this paper is to continue the search for explanations for coordination and coalition structures in the setting of Swedish carnivore policy. Based on the Advocacy Coalition Framework (ACF) and a previous case study within the same policy subsystem, the study investigates a set of hypotheses regarding actors' coordinating behavior and the defining elements of coalitions. The empirical analysis indicates, in support of the ACF, that perceived belief correspondence is a better predictor of coordination than perceived influence. Moreover, the explanatory power of empirical policy core beliefs in general, and normative policy core beliefs in particular, is further reinforced, while deep core beliefs seemingly do not influence coalition structure. The relevance of more shallow beliefs for coalition formation cannot be dismissed and therefore calls for additional research.     

DOES IMPRISONMENT ALTER THE LIFE COURSE? EVIDENCE ON CRIME AND EMPLOYMENT FROM A NATURAL EXPERIMENT

Ex‐prisoners consistently manifest high rates of criminal recidivism and unemployment. Existing explanations for these poor outcomes emphasize the stigmatizing effects of imprisonment on prisoners seeking postrelease employment as well as the deleterious effects of imprisonment on prisoners’ attitudes and capabilities. However, these explanations must be distinguished from selection effects in the criminal sentencing process, which also could explain some or all of these poor outcomes. To distinguish between criminogenic and selection explanations for ex‐prisoners’ postrelease experience, I analyze data from a natural experiment in which criminal cases were assigned randomly to judges with sizable sentencing disparities. Using these exogenous sentencing disparities, I produce unbiased estimates of the causal effects of imprisonment on the life course. The results of this analysis suggest that selection effects could be sufficiently large to account for prisoners’ poor postrelease outcomes because judges with large sentencing disparities in their use of imprisonment had similarly high caseload unemployment and criminal recidivism rates.

The Australian Environmental Policy Agenda

This paper seeks to identify major shifts in the Australian environmental policy agenda over the past fifty years, and discusses the possible causes of and variables affecting agenda change. The issue of what comprises ‘environment’ policy is discussed, with reference to overlaps and intersections with other policy sectors such as agriculture, public health, energy and regional affairs. While the diversity of the environment policy domain complicates any analysis of trends, there have been two persistent trends of (i) an expansion from a more narrowly to a more broadly defined suite of issue (from environment to sustainable development) and incorporation of environment into natural resource management, and (ii) an increasing diversity of policy instruments being used. Consistent with the wide variety of issues confronted, pragmatism and convenience are often as influential as political ideology or underlying trajectories. The drivers of policy change are diverse, including biophysical factors such as drought, political leaders and international policy developments, and punctuations are often better interpreted as intensification or redirections of past policy trajectories.
