论社会文化对犯罪界定的影响

犯罪虽然由法律所界定，但刑法在犯罪圈的划定上受到社会化的深刻制约，犯罪的范围界定在不同国家，不同历史时期也就不尽不致。立于社会化的视界，透视各种化现象和犯罪界定的联系，不难发现犯罪界定受到法化传统，社会哲学，社会道德和社会宗教等化因素直接而深刻的影响，所以，对犯罪的理解应当植根于化之中，了解并把握立干背后制约犯罪划定的社会化机理。

试论我国刑事申诉复查程序之建构

申诉复查程序是申诉再审程序启动的必经程序,我国刑事诉讼法尚无明确规定,以致在实践中缺乏可操作性,弊端突显,文章指出应建立我国的申诉复查程序,并提出了具体建议。     

中国外交的大局意识

大局意识是中国外交决策的一个重要因素。保持社会稳定、维护国家安全,是坚持以经济建设为中心这个大局的前提条件。中国在制定外交政策和在外交工作中,坚决反对别国干涉中国内政,切实维护中国的政治稳定;努力发展与各国特别是主要大国的关系,促进中国的经济稳定;妥善处理敏感涉外事件,避免引发国内社会不稳定因素;加强与国际社会特别是邻国的合作,共同打击恐怖主义、分裂主义和跨国犯罪,维护民族团结和国家统一。     

社会主义核心价值的多维探源

社会主义的核心价值是无产阶级对人类共同理想的解读,是生产社会化要求的推导,是对资本主义价值理念的“扬弃,”是共产主义价值目标的“初级”表现。     

Do individual factors and neighborhood context explain ethnic differences in juvenile delinquency?

Individually measured factors and neighborhood context were related to juvenile delinquency in a community sample of 506 urban, public-school boys. Neighborhood context was measured with an objective, census-based score that classified neighborhoods as underclass or not underclass. When African American youths and white youths were compared without regard to neighborhood context, African American youths were more frequently and more seriously delinquent than white youths. When African American youths didnot live in underclass neighborhoods, their delinquent behavior was similar to that of the white youths. Hierarchical multiple regression analyses showed that boys' hyperactivity and parental supervision were the strongest correlates of delinquency. Single-parent status and poverty/welfare use were not related to delinquent behavior. Once individually measured factors were accounted for, residence in underclass neighborhoods was significantly related to delinquent behavior while ethnicity was not. This study points to the importance of including the neighborhood context when addressing the social problems of African American youths.     

Workplace justice and employee worth

Distributive and procedural justice gain new meaning in light of other distinctions about how organizations value employees (the employees' “worth”). Fair compensation gives employees worth as achieved status: how the employee is like some employees (similarly rewarded) and not like others (dissimilarly rewarded). But employees also want to be treated uniquely as individuals and in other ways to be treated like all other employees, both reflecting worth as ascribed status. Such worth need not involve the distribution of outcomes; it can be gained if procedures function as ends in themselves. Different types of worth thus become the source of different criteria for justice. Based on a paper entitled “Justice as Worth,” which was prepared for the Third International Conference on Social Justice research (held in the Netherlands during July 1991).     

合作作品含义探析

我国著作权立法对合作作品的定义没有做出正面、明确的规定,导致学说和实践对合作作品的认定存在很大的分歧。应该坚持制度创新,将合作作品认定为“由数位作者付出独创性劳动、并且各自的创作意图和合理期望均指向该部以最终形式表现出来的、同一部完整的共同作品。”     

水牛瘤胃细菌及纤毛虫孕酮受体分析

本实验采用放射受体分析测定水牛瘤胃细菌及纤毛虫孕酮受体(PgR),其量用fmol/mg蛋白表示,作Scatchard图求其解离常数Kd。结果为:水牛瘤胃细菌PgR和纤毛虫PgR的最大结合容量分别是412.61±35.60和39.84±8.66fmol/mg蛋白;而其Kd值分别等于2.79±0.33×10~(-9)和8.46±0.50×10~(-11)M;此两种来源的受体与孕酮的结合表现出明显的专一性并随配基浓度的增加出现饱和。纤毛虫PgR的Scatchard曲线上凸,提示其与配基的结合较为复 杂,可能存在正协同效应;而细菌PgR与孕酮的结合较为均一,表现为其Scatchard曲线典型。竞争结合分析结果显示17β-雌二醇,皮质醇及睾酮与细菌PgR无交叉反应,醛固酮对之有微弱的竞争结合作用;纤毛虫PgR对皮质酮和醛固酮均有一定程度的竞争结合能力,但不结合17β-雌二醇和睾酮。
