日本《部分工时劳动法》的修正——以均等待遇原则为中心

日本部分工时劳动发展当中,差别待遇问题日益突出。在日本社会特殊的雇佣体制下,同工同酬原则一直不被认可,禁止差别待遇缺乏法源依据。2007年《部分工时劳动法》作出重大修正,最大的亮点是有限度的导入了国际劳工组织倡导的均等待遇原则,对满足一定条件的劳工给予同工同酬保护。中国非全日制用工发展中差别待遇问题同样突出,日本修法的经验对于中国具有借鉴意义。     

对信息化时代女性话语仍被“消音“的再思考

网络的出现为两性的平等提供了潜力,但在父权制的社会里,这一新事物仍使女性处于“话语权”被消音的状况中。尽管现状并不很乐观,但还是存在着改变的潜力和希望的。     

湖北地区德国牧羊犬10个微卫星DNA基因座遗传多态性研究

目的研究85头德国牧羊犬的10个基因座多态性。方法选用美国应用生物系统公司的10个商用犬微卫星基因座荧光标记复合扩增试剂盒进行PCR、并进行统计学分析。结果对85头德国牧羊犬的10个基因座的多态性研究表明,10个基因座累积DP值在0.9999972,非父排除率在0.9399,微卫星DNA基因座PEZ6、PEZ8、FHC2054的等位基因数均在8个以上,DP值接近或超过0.9,杂合度接近或超过0.7,能有效地应用犬的个体识别和亲权关系鉴定,其它7个基因座均未达到理想的个体识别和亲权鉴定使用条件。结论联合使用多个犬微卫星基因座,可以用于犬的个体识别和亲权鉴定。     

禁止法律规避制度在中国国际私法中的地位——对《民法典草案》第九编禁止法律规避条款的思考

法律规避是国际民商事交往中一种常见的欺诈行为。在禁止法律规避的问题上,各国的国际私法理论、立法和实践各有不同的主张。在我国,现行司法解释关于禁止法律规避的规定尚不完善,拟以专编规定我国国际私法规范的民法典草案。对法律规避问题亦没有给予足够的重视。本文围绕禁止法律规避制度在中国国际私法中的地位问题,提出了禁止法律规避应当是我国国际私法中一项独立的、一般性的、非歧视性的制度的观点,并在分析《民法典草案》第九编的体例和内容的基础上,对如何完善我国国际私法中的禁止法律规避制度提出了相应的建议。

Color separation in forensic image processing

In forensic image processing, it is often important to be able to separate a feature from an interfering background or foreground, or to demonstrate colors within an image to be different from each other. In this study, a color deconvolution algorithm that could accomplish this task is described, and it is applied to color separation problems in document and fingerprint examination. Subtle color differences (sometimes invisible to the naked eye) are found to be sufficient, which is demonstrated successfully for several cases where color differences were shown to exist, or where colors were removed from the foreground or background. The software is available for free in the form of an Adobe Photoshop-compatible plug-in.     

Genetic polymorphism at 15 tetrameric short tandem repeat loci in four aboriginal tribal populations of Bengal

POPULATIONS: This study reports the genetic polymorphism observed at 15 short tandem repeat loci D3S1358, TH01, D21S11, D18S51, D5S818, D13S317, D7S820, D16S539, CSF1PO, vWA, D8S1179, TPOX, D2S1338, D19S433, and FGA in four aboriginal populations of Bengal. The analysis was performed to decipher the suitability of CODIS as well as six other highly polymorphic and unlinked markers in Forensic Testing. Studied populations include four tribes: Karmali, Kora, Maheli, and Lodha.     

论社会歧视的社会心理根源及其消除方式--社会心理学视野下的社会歧视

社会歧视是指针对某一特殊社会群体的不公平、不合理、排斥性的社会行为或制度安排.从社会心理学看,这是由社会偏见这样一种不公正的、具有否定性和排斥性倾向的社会态度所导致的,属于一种刻板印象.但社会偏见并不一定导致社会歧视,实现这种转变与被歧视者自身力量相对弱小、"谈判力"不足相关.要减少或消除社会歧视,一方面必须壮大被歧视者的力量,增强其"谈判力",阻止已有的偏见向歧视的转化;另一方面通过被歧视者的努力,加强沟通来改变固有的刻板印象并防止新的刻板印象的产生.     

Morphological and spectroscopic measurements of plastic bags for the purpose of discrimination

The discrimination of noncolored transparent polyethylene bags was studied by several nondestructive and semidestructive analytical methods. X-ray diffraction, infrared spectroscopy, and optical microscopy (differential interference contrast microscopy and phase contrast microscopy) were applied to polyethylene films. X-ray diffraction was used to distinguish variations in the crystalline phase, infrared spectroscopy was used to distinguish variations in the molecular components, and optical microscopy was used to distinguish the different surface morphologies. The results show that X-ray diffraction classifies the crystalline phase of the film depending on whether it is made from low-density polyethylene, linear low-density polyethylene, or high-density polyethylene; that infrared spectroscopy is useful to distinguish the molecular components and it is the most discriminating technique; and that optical microscopy discriminate films easily by their morphological differences.     

FTIR图像—单点模式法无损鉴别不同品牌激光打印机墨粉色痕

利用傅里叶红外图像系统,采用单点模式对收集到的八种品牌激光打印机墨粉色痕进行红外扫描,采集样品红外光谱,并对其中两种样品红外光谱进行二阶导数运算,得到对应的二阶导数光谱。实验表明,该方法可有效区分不同品牌激光打印机墨粉色痕,并可为其他书写材料无损检验鉴定提供借鉴。
