The anti-corruption norm in both scholarship and the policy world has too narrowly focused on the domestic and institutional context of bribe-taking and public corruption. Instead, we argue that corruption in the contemporary global economy requires a multiple set of connected transactions, processes, and relationships that take place within informal transnational networks that blur the line between illegal and legal activities. These networks include multinational companies, elites in host countries, offshore financial vehicles and conduits, middlemen and brokers, and destination financial institutions. We examine how these actors operate in Central Asia, a region that is widely identified as corrupt, yet is rarely understood as embedded in the types of global processes, offshore connections and transnational links specified in our analysis. Examples of offshore centers in tax planning from Central Asia, and partial results from a field experiment based on impersonating high corruption risks from four Central Asian states, provide evidence for how the various actors in transnational financial networks structure their dealings. We then present two brief illustrative cases of how these transnational networks have operated in energy explorations services in Kazakhstan and telecommunications contracts in Uzbekistan. Our findings have theoretical, practical, and normative implications for scholars and practitioners of Central Asian international political economy and other ‘high risk' regions.  相似文献

Extant work on status attribution has largely focused on major powers or state capabilities as key explanatory factors driving these social processes and suggests that status considerations increase conflicts between states. We argue for a more comprehensive approach to status attribution that considers international norms as another major factor that is weighed in the attribution process. We contend that states (policymakers) evaluate one another not only on the basis of economic and military capabilities but also on the extent to which there is behavioral conformance with normative expectations and reward one another dependent upon whether these expectations are met. However, this attribution of status is dependent upon the level of contestation pertaining to that norm. Using a data set that assesses consistency with six different norms (resource transference, multilateralism, economic liberalism, democratic governance, respect for human rights, and peaceful dispute resolution), we find that status attribution is associated with norm-consistent behavior but only when these norms are uncontested at the global level.  相似文献

This paper considers the relations of truth, life and norm in the work of Georges Canguilhem and Michel Foucault argued that in France it was in the philosophy of science that one finds the clearest formulations of the problems of rationality and the sovereignty of reason. This distintive confrontation can be termed French Modern. For Canguilhem, an ontological and existential pathos arose from the fact that living beings were fated to struggle in the face of circumstances. For Foucault, this ontology became historical and political. For both, the key question was the relationship between life itself and the understanding of life. The paper concludes by reflecting upon some implications of the ways in which the relation between life and lived experience is posed today.  相似文献

量刑建议权是公诉权的应有之义,对于认罪认罚案件而言,检察机关提出精准量刑建议是量刑协商的根本要求,不仅不会侵犯审判权而且有利于审判权更加合理地行使,为实现审判中心主义创造条件,具有正当性基础。精准量刑建议包括确定量刑建议和"最小化幅度"量刑建议,按照认罪认罚案件的不同类型,遵循比例原则和诉讼经济原则之间的制约与被制约关系,并根据量刑建议精准化程度与程序简化力度之间成正比、与案件重大程度成反比的关系,构建出"分类精准"模式,分为速裁程序及有期徒刑三年以下简易程序案件的确定量刑建议、有期徒刑三年以上五年以下简易程序案件的确定量刑建议为主"最小化幅度"量刑建议为辅等五种类型。检察机关分类测算精准量刑建议时,在量刑基准上应坚持责任优先主义,根据行为的不法与罪责确定责任刑,并采取"点的理论"确定起点刑和基准刑,把认罪认罚作为独立的预防刑情节予以考量。通过建立与"分类精准"相适应的量刑指南、量刑协商、量刑建议说理、量刑调整等机制,提高量刑建议精准化水准。  相似文献

Over the past decade, in Canada and the United States, blogs have become a popular and important space for fat women and their allies to create and further develop discursive strategies to contest the gendered anti-fat discourses perpetuated by the media, governments and the field of medicine and institutions of public health (e.g., Elliot, C. Currently, popular discourses pertaining to fat people, particularly women, tend to range from larger bodies implicating a ‘moral deficit’ to a ‘risky behaviour’ to ‘political discrimination’ where elements from each discourse shape how fat women's bodies are read within the broader culture (Fikkan, J. L., & Rothblum, E. D. (2011). Sex Roles, 66, 575–592. Kwan, S. (2009). Sociological Inquiry, 79, 25–50. These messages in positioning the thin body as the ideal body are embedded in neoliberal discourses around citizenship that, in emphasizing personal responsibility, encourage (sometimes) punishing regimens of strict diets and exercise, and perpetuate an image of responsible citizenship as an extension of modern interpretations (Herdon, 2006). Using content and thematic analysis, we systematically analyze how four female self-identified fat acceptance (FA) bloggers discuss beauty standards and body image as a means to challenge these discourses. Findings suggest bloggers import elements from LBGTQ movements to extend dominant discursive strategies, model alternative forms of fat embodiment, and address the economic marginalization of fat women in industry. Moreover, through discussions on beauty and body image, bloggers use online spaces to contest anti-fat discourses and to develop discursive strategies that move beyond the binary of fat as a lifestyle choice, and body size as biologically or genetically determined that dominate the fat acceptance movement.  相似文献

刑事司法领域的改革翔实地反映出一定阶段人们对立法成果的实践情况。刑事诉讼中审判方式变革的直接产物就是1996年《刑事诉讼法》的修订。当下量刑规范化的提倡,推进了量刑程序的改革。量刑情节作为萦绕量刑始终的关键因素,其重要性不容小觑。从20世纪90年代刑事审判方式改革到如今的量刑规范化的提倡,都是一种司法实践对立法规定的回应,立法及时又将产生良性的互动。这种互敬的对话模式是立法层面的反思,更是司法角度的自省。针对目前集中反映在立法与司法中存在的酌定量刑情节问题,在有限思索的方寸间试以论述。  相似文献

现有法律规范的权威定义受制于反映论的认识进路,不仅未能全面揭示法律规范的内在含义,而且在属概念不明之时,自身也晦暗不清。法律规范的概念可以界定为法律文本中表述某主体在一定条件下对其他主体就某客体当为某类行为的条文所表示的意义。以此定义观之,在现有法律规范权威定义框架下建构的法律规范结构理论,论述的其实是复数法律规范间的复合结构,而不是法律规范的结构。  相似文献
