美国东北亚政策的进攻性现实主义解读

以米尔斯海默为代表的进攻性现实主义是现实主义理论的最新发展,其从历史分析与理论论证的角度为美国的东北亚政策提出了"离岸平衡手"的解读与构想。然而朝核危机爆发后,美国的东北亚政策正朝着建立多边安全机制的方向发展,进攻性现实主义提出的"中国威胁论"也不攻自破。     

Rebels without a Cause? The Irish Referendum on the Lisbon Treaty

The Irish referendum on the Lisbon Treaty follows a pattern of class-voting also seen in the 2005 referendums on the European Constitution. However, the poll differed in other respects. Polling in the wake of the vote suggested that the main reason given for voting no was a lack of knowledge about the treaty (22 per cent of no voters holding that view). A further 40 per cent of the voters voted no because they claimed not to understand the Treaty. This is in contrast to referendums in 2005 in Spain and the Netherlands where, respectively 70 and 51 per cent, of those with a self confessed 'very limited ' knowledge of the Constitution voted yes.     

我国金融诈骗犯罪的现状与对策

近年来,包括我国在内的世界各国的金融欺诈案件迅速增加、损失日益加剧,伴随着我国改革开放的发展,金融领域内的欺诈犯罪行为也在蔓延,且呈迅速上升之势。可以说,金融诈骗已成为当前我国经济犯罪活动中危害最大的犯罪类型之一。为了打击金融犯罪、保护国家和人民群众的财产权益、维护金融秩序、保护国家经济安全,应注重相关的立法与执法、协调各方面的力量、共同打击金融诈骗犯罪,从而有效遏制金融诈骗犯罪的产生和蔓延。     

Social Impact Bonds: Implementation,Evaluation, and Monitoring

Traditional approaches to public policy increasingly fail to resolve social challenges, particularly in the field of criminal justice. High rates of juvenile recidivism, for example, are often linked to inequality in education and persistent, long-term unemployment—factors which, while complex, are nonetheless conducive to preventative strategies.

Social impact bonds (SIBs) are “pay-for-success” programs that attract private-sector, upfront funding for social interventions. If the program achieves agreed targets, taxpayer funds repay the investor. If the program fails to meet agreed targets, investors take the loss.

This innovative form of social finance through public–private partnership has helped spur efficiencies and improvements in the provision and outcomes of criminal justice services. However, the success of a SIB depends on careful implementation, evaluation, and monitoring.     

The Bottom Line: The Fundamental Weaknesses of Latin American Finance

Throughout the 1980s, Latin America experimented with financial liberalisation, which was supposed to solve the perpetual weaknesses of low savings, lack of access to capital, and the resulting stultifying effects on growth. We find that fundamental weaknesses in regional financial systems continue. We suggest that there are three basic policy reactions: a deepening of neoliberal policies; a neo‐structural reform of them; and a Bolivarian social reform‐oriented approach. While the neo‐structural approach has yielded the most promising performance, it is still limited. We conclude that the success of reforms lies in understanding and changing the calculations of the political beneficiaries of the status quo.     

论我国知识产权融资许可制度之构建——以美国UCITA法的融资许可为借鉴

知识产权许可交易在经济发展中的重要地位决定了其融资机制必然成为知识经济发展的调节器,故应将其纳入法律规制。美国融资许可的法律规制具有通过设立知识产权融资许可制度来规制知识产权许可融资;采用私法手段;发挥知识财产被许可使用的积极作用等特点。我国应在借鉴美国规制经验的基础上,根据知识产权许可与融资的实践及国情,有的放矢地建立完善的规制机制。然而,我国现行融资制度并不利于知识产权许可交易。因此,应对我国知识产权融资许可法律规制作全新的制度建构,其主要内容包括:明确融资流程,并设立担保制度、被许可人融资合同义务条款限制解除制度、知识产权瑕疵责任制度、资金供给者违约救济制度等。     

The Impact of the Housing Bubble on the Growth of Municipal Debt: Evidence from Spain

The aim of this paper is to analyse the impact of the recent Spanish housing boom and the subsequent burst on local public finances. Particularly, we investigate the effect of the rise and later fall in revenue from urban development on local government debt. Using a sample of the Spanish largest municipalities in the period 2003–2011, we find that debt was substituted by revenue from urban development during boom years and this substitution effect vanished after the burst of the boom. Our results also reveal that local public finances have worsened after the burst of the housing bubble since now they have larger current spending and smaller savings.     

论我国合作金融行业组织体系的法律重构

我国合作金融的发展亟需有效的行业组织。当前合作金融行业组织运行中的重重问题,要求从行业组织的模式和行业组织制度两个方面对我国合作金融行业组织体系进行法律重构。对于合作金融行业组织的模式,我国既要选择能满足行业组织成员自由选择需求和行业组织整体能力积聚需求的混合结构模式,又要在行业组织的具体组织形式上选择合作制组织形式,并由法律对这两种模式进行重构。对于合作金融行业组织制度,法律重构的重心主要在于对合作金融行业组织的设立、成员加入与退出、代表产生和多票权等制度进行设计。
