裁判文书公开是司法公开的核心,裁判文书上网公开又是目前裁判文书公开的重要形式。虽然裁判文书上网公开的普遍性和便捷性能满足公众对于司法知情权的需求,但不可避免在一定程度上会对相关人员的隐私权造成侵害。互联网的广泛应用为裁判文书公开提供了良好的载体,但也使得知情权与隐私权的碰撞更为激烈。通过比例原则和可分割性原则,对于涉及个人隐私的不同情况进行区别对待,并赋予当事人充分的程序保障权,以此对裁判文书上网公开中的知情权与隐私权的冲突予以平衡。  相似文献

网上证券交易逐渐成为现代证券市场重要的交易方式和目标模式 ,其技术上的优势给现代证券交易提供了良好的发展机遇 ,其所造成的市场结构和交易条件的改变又对市场各方和现行法律形成了巨大的挑战。针对网上证券交易带来的主体、交易平台和系统、交易形式、安全和风险、监管、争议解决等方面的法律困境 ,应坚持“三公”和“保护投资者利益”原则 ,从监管体制、市场准入机制、场外替代交易类型、交易形式效力规则、风险安全保障、争议处理等六个方面完善相关的制度。  相似文献

The legal and psychological research surrounding online Child Sexual Exploitation Material (CSEM) is focused on visual depictions of children, either as still images or movies. Narrative CSEM (N-CSEM) describes an under-researched area, resulting from difficulties surrounding its conceptualisation, both legally as well as concerning the function for its users. The current study describes an initial attempt in defining N-CSEM in comparison to visual material, based on interviews with users of CSEM and N-CSEM and professionals working with this user group. Thematic Analysis resulted in three super-ordinate themes. All themes were analysed and enriched from the perspectives of user- and service-representatives. The study provides insight into N-CSEM as a separate entity from visual CSEM, challenging and informing legal decision-making and assessment and treatment providers for users of CSEM.  相似文献

Legal education is in a period of rapid development driven by changing industry demands and developing technologies. This paper will describe an innovative pilot study which utilises new technologies to provide an alternative mode of teaching and learning to meet growing industry demands for graduates who are technologically savvy and have strong communication and collaboration skills. The pilot study redesigns a law unit combining a more traditional approach with an approach in which online collaboration is critical to student learning as a teaching and assessment tool. After completing an online collaborative activity as part of their assessment for the unit, students completed an online survey to identify their perspectives of the online collaborative experience. The online survey data was analysed to identify common themes and the experiences of students are shared in this paper. The paper provides an example of how instructors might take advantage of a learning design process, online tools and infrastructure to develop educational experiences which promote communication and collaboration within the law discipline. It will also include five recommendations to consider when including online collaboration in unit design for law students.  相似文献

Abstract

The article focuses on two flagship initiatives – the open method of co-ordination and online consultations – in which the European Union aimed to improve democratic legitimacy through collaborative governance. Offering an analytical framework to scrutinize the large body of existing theoretical and empirical research, the article concludes that not only were the high expectations on the effects of applied governance disappointed, the results also hint at larger, more general implications for the governance concept that, in contrast to the high expectations, appears to be indeed strongly dependent on government-like conditions to operate successfully.  相似文献

Various theories, theoretical viewpoints and models on consumer behaviour stipulate consumers’ offline and online behaviour when purchasing a product or using a service. This article deviates from the purchasing perspective and instead proposes an information and web-based communication message ‘seeking and consumption1 perspective. This new perspective is theoretically grounded in two new approaches to online consumer behaviour: the web-based communication exposure and internal psychological behavioural processes approaches; as well as the integration of various theoretical perspectives, approaches, theories and models that address fragments of offline and online consumer behaviour. The research problem is to address the existing limited and fragmented approaches, because existing purchasing perspectives arguably do not provide adequate theoretical criteria to explain online consumer behaviour during interactive information-seeking and consumption activities. Hence, the main aim of this article is to propose new theoretical criteria for online consumer behaviour to address these shortcomings.  相似文献
