刑事证明责任之分配与犯罪成立之判断密切相关。两大法系国家在证明责任分配上均要求控方承担积极构成要件证明责任,而由被告人承担某些特殊事实的证明责任。我国刑事诉讼法中缺乏对刑事证明责任明确的规定,实践中,控方对犯罪成立几乎承担着全方位的证明责任。为平衡不同利益,对部分犯罪中的特殊事实实行证明责任倒置是合理且必须的。 相似文献

Quantifying the strength of gunshot residue (GSR) evidence requires scientific knowledge about the number of particles expected to be found on individuals who were or were not involved in a shooting. However, controlled experiments demand expensive resources in terms of microscope time and labor, which restricts the data of most studies to only a small group of individuals. We suggest a novel method that exploits data collected routinely on suspects during the daily work of forensic laboratories. These observational data relate to both persons who were involved in a shooting and innocent individuals. We suggest a mixture approach with different models for the number of gunshot residue particles in each group and develop an iterative algorithm to estimate the probabilities of observing the evidence under the defense proposition that the suspect is innocent and under the prosecution assumption that he is not. The method is applied to data of more than 500 suspects collected by the Israel National Police Division of Identification and Forensic Science. The analysis shows that the probability of finding three or more GSR particles on the hands of innocent suspects is very small, less than 1.5 in 1000 cases. Our new method enables researchers to use data on real cases, possibly supplemented by experimental data, in order to estimate the probabilities of a given GSR finding under the defense and prosecution propositions. 相似文献

This empirical study shows that trade unions in China do not play a significant role in affecting industrial labor income. Inactive trade unions, moreover, contribute to the deterioration of income inequality because of the existence of administrative monopoly power. China's dual market structure (i.e., the coexistence of an administrative monopoly sector and nonadministrative monopoly sector), as well as the trade unions' administrativization and bureaucratization, are main reasons that trade unions do not effectively improve China's income distribution problem. Thus, in order to optimize the structure of income distribution, trade unions in China should start a reform of de‐administrativization, reconstruction of the function of workers' rights protection, and strengthening the independence of the grassroots trade union organizations. 相似文献

A fatal case of 1,4-butanediol (1,4-BD) oral ingestion is reported here, in which a 51-year-old man was found dead in his bed. According to the police report, the deceased was a known drug user. A glass bottle labeled (and later confirmed to be) “Butandiol 1,4” (1,4-BD) was found in the kitchen. Furthermore, the deceased's friend stated that he consumed 1,4-BD on a regular basis. The autopsy and histological examination of postmortem parenchymatous organ specimens did not revealed a clear cause of death. Chemical-toxicological investigations revealed gammahydroxybutyrat (GHB) in body fluids and tissues in the following quantities: femoral blood 390 mg/L, heart blood 420 mg/L, cerebrospinal fluid 420 mg/L, vitreous humor 640 mg/L, urine 1600 mg/L, and head hair 26.7 ng/mg. In addition, 1,4-BD was qualitatively detected in the head hair, urine, stomach contents, and the bottle. No other substances, including alcohol, were detected at pharmacologically relevant concentrations. 1,4-BD is known as precursor substance that is converted in vivo into GHB. In the synoptic assessment of toxicological findings, the police investigations and having excluded other causes of death, a lethal GHB-intoxication following ingestion of 1,4-BD, can be assumed in this case. Fatal intoxications with 1,4-BD have seldom been reported due to a very rapid conversion to GHB and, among other things, non-specific symptoms after ingestion. This case report aims to give an overview to the published of fatal 1,4-BD-intoxications and to discuss the problems associated with detection of 1,4-BD in (postmortem) specimens. 相似文献

The subject of this research was the inorganic gunshot residue component collected from shooting patterns obtained on woven cotton cloth using a Pietro Beretta model 70 pistol, cal. 7.65 mm and Serbian ammunition for the following muzzle-to-target distances: 25, 50, 75, 100 and 125 cm. For each distance, three rounds of shooting were performed. Particles were lifted within a 10 cm radius of the projectile entrance and automatically analyzed using a scanning electron microscope coupled with an energy dispersion X-ray spectrometry. The obtained data on the populations of particles were analyzed taking into account their numbers, chemical classes and sizes. The results showed an apparent maximum incidence within all particles containing barium at about 50 cm distance. Also, lead particles revealed a distinct behaviour, being dominant at a 25 cm distance, falling below the other chemical classes, and finally becoming dominant again at 125 cm. The analysis of the frequency of occurrence of particles sorted according to their sizes confirmed that the small particle population is the largest, and their distribution in function of the equivalent circle diameter is exponential-like. The obtained results provided knowledge on the distribution of particles in the vicinity of the tested firearm and ammunition cal. 7.65 mm which generally corroborates with similarly studied GSR distributions obtained for the use of pistols cal. 9 mm. This information, together with the examinations of gunshot damages and other types of residues such as soot or unburned propellant grains may support qualitative inferences on shooting distance estimation, especially in cases, when the firearm and cartridges are not available to perform test shooting. In such cases even roughly estimated shooting distance can be helpful, e.g. for confirming or excluding the possibility of self-inflicted injuries or suicide and infer on the mutual position of the shooting stage actors. Pipe bombs of steel or PVC fragment in reproducible patterns when similarly configured. The power of the explosion correlates with number, mass, and size of the fragments recovered, where a large number of small, low‐mass fragments indicate a high‐power event and vice versa. In discussing performance, describing pipe fragmentation pattern by fragment weight distribution mapping (FWDM) or fragment surface area distribution mapping (FSADM) was useful. When fillers detonated, detonation velocities of ~4.4 mm/μs were measured. In such cases, side walls of the pipe were thrown first; the average fragment velocity was ~1000 km/s. In deflagrations, the end cap was first thrown; fragment velocities were only ~240 km/s. Blast overpressures varied; at 10 feet, 2 × 12 inch steel pipes containing ~550 g of detonable mixture produced overpressures of 5–6 psi; similar nondetonating pipes produced less than 2 psi. Very little is known about how relationships between people with disabilities and their paid support workers are positioned in policy. With the policy shift toward choice of provider, individualised approaches, person centredness and self‐directed funding, the nature of their relationship assumes a more prominent role in the quality of support practice. The policy analysis in this article explores the extent to which current disability policy acknowledges, promotes, or diminishes the relationships between people with disabilities and workers, in their organisational context. It uses Honneth's conditions for recognition—love (cared for), rights (respected) and solidarity or social esteem (valued)—to understand how policy positions mutuality in the relationship. The policy review applied a three‐stage process: categorisation of policies, textual analysis and content analysis to policy documents at four levels—international, Australian federal, state and organisational in two case studies. The analysis revealed that while a rights framework is explicit in most policies, the emphases on the conditions for recognition within a relationship between people with disabilities and workers are compromised in instructional policies that attempt to manage the tension between choice and risk, particularly at the organisational level. 相似文献

为探究猪圆环病毒2型(PCV2)在保育猪浅表淋巴组织和器官中的分布规律,帮助临床检测疾病更好地选择采样部位。对广西某地区PCV2感染的猪进行临床症状和病理学观察,结果发现感染PCV2的猪淋巴组织和器官均有不同程度的病变,其中腹股沟浅淋巴结病变较为严重。运用免疫组织化学技术进行PCV2在保育猪浅表淋巴组织分布规律的研究,发现阳性信号主要存在于巨噬细胞和淋巴细胞的胞浆中,腹股沟浅淋巴结均能检测出阳性信号,且PCV2阳性信号高于其他浅表淋巴组织。建议将腹股沟浅淋巴结作为PCV2诊断的采样组织部位。 相似文献

目的建立甲胺磷的犬灌胃染毒致死模型,观察甲胺磷在犬体内的死后分布规律。方法犬经8倍LD50(7.4mg/kg)剂量甲胺磷灌胃后,观察其中毒症状,死亡后即刻解剖,分别取心、肝、脾、肺、肾、脑、右上肢肌、右下肢肌、胸肌、胃组织、心血、胆汁、玻璃体液和尿液,GC/MS和GC法检测其中甲胺磷含量。结果犬8倍LD50甲胺磷灌胃染毒后20min内出现中毒症状(,53.3±14.1)min死亡。各组织脏器及体液中甲胺磷含量由高到低分别为胃(99.84±0.87)μg/g、脾(46.87±28.67)μg/g、肝(43.82±22.74)μg/g、肾(43.79±29.04)μg/g、心血(35.36±13.98)μg/mL、肺(35.25±18.59)μg/g、尿34.81μg/mL、胸肌(19.23±17.18)μg/g、右上肢(16.92±8.98)μg/g、心(15.09±6.11)μg/g、右下肢(12.83±7.63)μg/g、脑(10.91±4.13)μg/g、胆汁(6.75±1.45)μg/mL、玻璃体液(6.22±4.97)μg/mL。结论甲胺磷在犬体内死后分布不均,胃、脾、肝、肾、心血、肺、尿检材中含量较高,可作为疑似甲胺磷中毒毒物分析的检材。 相似文献
