NEIGHBORHOOD CONTEXT AND NONLINEAR PEER EFFECTS ON ADOLESCENT VIOLENT CRIME*

Although evidence of the strong correlation between deviant behavior and exposure to deviant peers is overwhelming, researchers have yet to investigate whether a nonlinear functional form better captures this relationship than does a linear form. Researchers also have yet to examine the extent to which peer effects vary as a function of the neighborhood context. To address these issues, we use data from the Project on Human Development in Chicago Neighborhoods (PHDCN) to examine 1) the functional form of the relationship between peer violence exposure and self‐reported violent crime and 2) the extent to which the effect of exposure to violent peers on violence is ecologically structured. Estimates from logistic hierarchical models indicate that the effect of peer violence exposure on violent crime decreases at higher values of peer violence, as reflected in a nonlinear relationship (expressed in terms of log‐odds). Furthermore, exposure to violent peers increases along with neighborhood disadvantage, and the effect of peer violence exposure on violent crime is attenuated as neighborhood disadvantage increases, which is reflected in a cross‐level peer violence/disadvantage interaction.     

道家抵制科技的根源及其积极影响

道家对科技的态度是抵制的,这种抵制根源于科技"有为"与道家"无为"的冲突及科技"有欲"与道家"寡欲"的冲突。透过道家抵制科技的表象,可以看到道家对科技的积极影响,即其在理论实质上对客观规律的肯定,在技术上对"技进于道"的升华,在科学技术应用上对"人与自然和谐"意识的推动。     

论网络舆情对政府制定公共政策的影响

当前我国处于网络信息新时代,网络舆情是政府了解民意的重要渠道和方法,对于民意的征求也应适当地采取网络投票、提问等方式。网络传播方式已成为我国公众表达利益诉求、维护自身权益的重要公共平台。因此,网络舆情对政府制定决策有着重要的影响,同时伴随着很大的压力,并且网络舆情的积极作用与消极作用并存,所以网络舆情状态下政府如何制定好公共政策成为考验政府能力的一个挑战。     

投保人的告知义务再检讨

以保险法和海商法理论为指导,借鉴国外立法和司法实践,从确定告知义务的角度、广度、深度以及维度,对投保人或者被保险人的告知义务进行了全方位的研讨,力求对告知义务进行一个立体化的解析,以达到准确使用法律之目的。     

Racial composition,sentencing reforms,and rates of incarceration, 1970–1980

Association with delinquent peer groups is one of the most salient predictors of delinquent behavior. Despite the widespread documentation of these effects, little is known about whether the delinquent peer effect is conditioned by individual‐level characteristics. Using data from a multi‐wave survey of Mexican‐American adolescents, this study explored the interactive effect of susceptibility to peer influence and differential association with delinquent peers on delinquent outcomes. Results suggested that the delinquent peer effect on self‐reported delinquency is amplified when an adolescent is highly susceptible to peer influence. Analyses also indicated that this moderating effect varies according to offense seriousness. Specifically, the conditioning effect is most important when considering acts of serious delinquency.     

广州地区农民工政治信任状况的实证研究

我国农民工的数量极其庞大,广州地区是我国农民工重要的集散地。广州地区农民工的政治信任呈现出三大特点：政治信任的水平与信任客体的层级正相关、政治信任的认知基础比较模糊和新生代农民工的政治信任度较低。这一状况容易导致广州地区农民工群体性事件的发生,为此,我们需要采取以下措施来提升其政治信任度：提高农民工的工资水平,拓宽农民工的政治参与渠道,加强对农民工信任网络的整合,发挥电子媒介的政治传播功能。     

WHEN THE COST IS TOO GREAT: THE EMOTIONAL AND PSYCHOLOGICAL IMPACT ON CHILDREN OF INCARCERATING THEIR PARENTS FOR DRUG OFFENCES1

The advent of the modern “war on drugs” and its accompanying “lock 'em up and throw away the key” crime policies largely explain the evolution of mass incarceration in the U.S. and account for much of the emotional and psychological pain caused to children who have lost their parents to long prison sentences. It is by reducing reliance on incarceration to tackle the “drug problem” in the United States that there will be a positive impact on reducing the number of parents being separated from their children for inordinate amounts of time, thereby potentially reducing the negative emotional and psychological impact on children. Aiding parents combat their addiction outside of prison walls is perhaps to most sensible criminal justice policy in addressing the needs of children who are caught in the cross‐fire of the war on drugs. In the meantime, as policy makers review, assess, and, eventually, reform draconian drug laws and sentencing policies, it is imperative that front‐line service providers who work with children and family and juvenile court judges be mindful of the emotional and psychological impact that parental incarceration has on youth. A more in‐depth understanding of the complexities of these young people's life experiences will hopefully enable the development of appropriate support services.     

刑法修正案（八）实视阈中的我国监狱管理创新

《刑法修正案（八）》（以下简称《刑八》）的颁行实施,必将对我国监狱工作全方位产生现实而深远的影响。新的刑法立法精神确立必然带来监狱行刑理念的创新;新的刑法制度确立和实施必然要求监狱行刑制度的创新和重构;新的押犯结构必然促进监狱改造手段的创新;新的职能定位必然催生监狱运行机制的创新。以《刑八》实施为契机,推动我国监狱管理的全面创新：确立现代监狱的核心价值体系,凸显社会主义刑罚文明;规范现代监狱的职能设计,科学履行法律惩戒和社会防卫职责;改革传统监狱管理模式,创设中国特色的监狱管理制度;客观审视传统改造手段,构建科学的改造罪犯手段体系;回归监狱工作理性,使监狱行刑从理想走向科学。
