Since 2017, complaints of sexual violence have increased in France. At the same time, the management of sexual offenders has been at the center of international public health policies. The prevalence of mental disorders among sexual offenders is an essential field of research. There are some published studies on the prevalence of psychiatric disorders in sexual offenders in detention, but there are few recent published studies among French individuals who were detained. Our objectives were to determine the prevalence of psychiatric disorders among persons detained for sexual offenses and the level of care received according to their diagnosis. For this purpose, we carried out a retrospective observational study from January 2017 to October 2021 of all adult sexual offenders, whether accused or convicted, who were seen in the psychiatric consultation unit of Les Baumettes prison, Marseille, France. The primary outcome measure was the psychiatric diagnosis entered in the medical records. One hundred forty-two patients were included in analysis. All patients were men, and the majority (n = 97, 68.3%) of these patients presented with at least one psychiatric disorder, principally a personality disorder (31.7%). 10.6% presented with a schizophrenic disorder, 4.9% a bipolar disorder, 3.5% a depressive disorder, 5.6% pedophilic paraphilia, and 25.4% an addictive disorder. Their management and comorbid addictions were analyzed in subgroups for each psychiatric disorder. Patients appeared to receive an appropriate level of care for their diagnosed disorder. It seems important to develop structured assessment of recidivism risk for better management of sexual offenders.  相似文献

实践中宅基地使用权收回时常处于或被弃用或被错用或被滥用的状态,究其根源,则在于对宅基地使用权收回的性质缺乏一个合理而精准的界定。为此,通过一体考虑宅基地使用权设立与收回,借鉴合同法中的强制缔约理论与解除权理论,树立宅基地使用权设立的合同观,从而最终将宅基地使用权收回界定为一种私法上的行为——合同解除行为。  相似文献

In this article I re-assess the parameters of what we seek to abolish as we pursue penal abolition. I apply Black Feminist Hauntology to exorcize the barriers of traditional and ineffective deconstructions of crime and criminalization. To illustrate these weaknesses I discuss police killings and related vigilante white supremacist violence. I present the aftermath of the deaths and trials (when there were trials) to bring to light the large disconnects that exist between abolitionism and the world in which crime lives. To begin to address this disconnect I present an abolitionist theory on crime founded upon five pillars of assessment: abolition’s perceived minimization of violence; the abusive R.I.P. relationship between crime and justice; a cultural phenomenon of achieving significance through proximity or by association; abusive naturalizations of violence that have been unaddressed in penal abolition; locating the struggles to exit abusive relationships within the core of our studies of criminal justice and penal abolition. I conclude that when penal abolitionists conceive of crime as a social construction tied to criminal justice institutions alone, as opposed to part of a structurally Racist-Imperialist-Patriarchal [R-I-P] abusive relationship, they stunt the possibilities of abolition in manners akin to pushing against a 500 year old tree from its trunk and expecting it to topple over without any account for the roots that hold it firmly in the ground.  相似文献

This article documents a government-led strategy to more closely integrate policing with community-based ‘crime prevention’ programming in the city of Winnipeg, Manitoba, Canada. These initiatives have targeted neighborhoods with large Indigenous populations. In this article I illustrate how community-level conflicts over responses to ‘crime’ are also sites of settler colonial conflict, and how settler colonial governance is reproduced and resisted through the governance of crime. Interviews with politicians, policy-makers, bureaucrats in the crime prevention branch of the provincial government, and directors and employees at community-based organizations suggest that the pursuit of the government strategy of integrated crime prevention and suppression has been more a project of attempting to ‘manage’ urban Indigenous people than serve their interests. As a contribution to abolitionist thought and theory, this article profiles sites of conflict between community police and community-based organizations over definitions of the ‘crime’ problem in city-center Winnipeg. These examples highlight a kinship between carceral abolitionist and decolonial politics.  相似文献

In this article we explore the intersections between white liberal feminisms and the carceral state, particularly within nonprofit agencies. We find a strong collusion between ‘dominating feminisms’ and the carceral state, through funding structures and the belief that the legal system can provide protection to victimized women. We use evidence from our own research on rape crisis centers and gender-responsive programming for criminalized women, respectively, to investigate how some nonprofit agencies further threaten the safety, stability, and self-determination of women of color, queer women, transgendered clients, economically disadvantaged women, and disabled women. As a result, when white liberal feminists seek to intervene in the criminal legal system, we often see reform efforts that directly strengthen institutions that perpetuate economic exploitation, colonialist notions of progress, and white supremacy. We conclude our article with an exploration of some guiding principles within noncarceral antiviolence organizations that espouse a liberatory feminist framework.  相似文献

刑法第306条辩护人、诉讼代理人伪证罪的设置是一项不公正不平等的规定,存在诸多负面影响,如助长了职业报复,危及律师事业的发展等,且该法条规定本身亦不严谨。笔者建议,考虑到现行刑法完全存在其他可以援引的法条对该罪规定的三种行为予以规制,有必要取消刑法第306条。  相似文献
