The method proposed by Grove [1] for comparing measurements made on control and recovered fragments is extended to deal with the possibility that the recovered fragments may originally have come from more than one source. The cases of two and four recovered fragments are examined in detail. Simulation results are given which show that the discriminatory power of the method varies with the number of sources and with the distribution of the fragments over those sources. It is greatest when the recovered fragments come from one source.  相似文献

ABSTRACT

This paper examines the rise of female Pentecostal-Charismatic (PC) church leaders and how they legitimize themselves in a male dominated religious field in Kenya and Tanzania. It explores, in a qualitative way, four women leaders’ modes of attaining legitimacy in African PC milieus and contributes empirically based knowledge from four cases which include Eleonorah Wambui of Prosperity Gospel Ministries and Jesca Njuguna of Prophetic Word Ministry in Kenya, as well as Neema Mwambembela of Holy Ghost Power Assemblies and Irene John of Miracle Prayer Ministry in Tanzania. We make reference to Boulding’s delineation of sources of legitimacy ([1967] ‘The Legitimacy of Economics.’ Economic Inquiry 5 (4): 299–307). We found that the four East African female preachers that we examined share certain common practices, but that differences are manifest among them owing to differences in their personal preferences and to the contextual flavour of each ministry.  相似文献

For some time 'regulatory reform' has been a government watchword, and the streamlining and improved quality of regulation its professed ambition. Impact assessments (formerly known as regulatory impact assessments) are a significant ingredient in these governmental initiatives, now promoted by the newly created Department for Business, Enterprise and Regulatory Reform. Just as they have come to refer rather freely to the Explanatory Notes that now accompany all public Acts of Parliament, judges have also begun to invoke impact assessments when construing legislation. This paper investigates the extent of this practice and the manner in which judges employ impact assessments. It warns of the potential consequences if the judiciary avails itself too readily of these highly politicised, and sometimes deceptive, documents.

The negotiation literature has extensively examined the topic of power and how it can be wielded. Numerous frameworks have been created and utilized in the various treatises on negotiations; analyzing the power differential in any given situation is a common teaching technique. However, despite this focus on the topic, discussions of power have been mainly focused on negotiations in the private sector. As a result, many of the most common frameworks are oriented toward this type of situation, resulting in a clumsy application to a public-sector negotiation. Given the growing importance of negotiations to public-sector leaders, we provide a new structure for analyzing power that can be utilized in such situations. For a municipal leader confronted with a complex public-private partnership, it is important to have the right tools to use when examining the power dynamics at play. After examining several current models of power, as well as other writings on the topic in negotiation and strategy literature, we present a new model. This model divides power into different categories based on whether it stems from formal or informal mechanisms, and then offers several specific forms relevant to the public sector. We then use this new model to examine a case study involving the new mayor of Manchester, New Hampshire and her efforts to negotiate a better response to the opioid and homelessness crisis. This case study illustrates the unique nature of public sector negotiations and provides a roadmap for negotiators looking to use our new framework.  相似文献

我国近代银行立法始于1908年,完善于1947年《银行法》。在近40年的法制建设中,既有《中央银行法》、《商业银行法》等单行法,又有综合的《银行法》等法律。还有数量众多的以"则例"、"条例"等名称出现的银行法规,构成了近代银行法的制定法渊源。此外,钱业习惯法对近代金融业的规范、监管起到了积极作用,也是银行法的渊源之一。制定法与习惯法在20世纪30年代前是相互依存,互补发展的,但随着国民政府金融统制的加剧,钱庄业被强制改造为银行,代表不同利益的制定法与习惯法规则,发生了冲突与博弈,习惯法随之消亡。  相似文献

股东查阅权制度,是确保股东表决权和诉权的重要公司法律制度.我国公司法及其司法实践尚没有规定完善的股东查阅权制度.本文对美国公司法股东查阅权制度的演变过程,包括其理论基础、历史渊源(判例法渊源和制定法渊源)、特拉华州公司法股东查阅制度的发展、判例法股东查阅权和制定法股东查阅权的关系等作了初步探索.藉以此为我国当前正在修订的<公司法>提供借鉴.  相似文献
