对新时期警察健康管理工作的思考

警察健康管理是对与民警个人健康相关的危险因素进行全面跟踪管理的过程,通过调动民警个人及组织的积极性,利用有限的资源达到最大的健康效果。健康管理是理念和方法,更是一套完善、周密的程序,其目的在于使病人以及健康人群更好地恢复、维护和促进健康。民警健康管理是落实"以人为本"管理理念,促进民警的全面发展的必然要求;有利于保持民警的身心健康,提高生活质量和工作效率;有利于提高警力资源的使用效率,提升公安队伍的战斗力。     

巨额财产来源不明罪的立法完善

巨额财产来源不明罪在立法技术、刑罚标准等方面存在一定的不足,应从制度上对公职人员的职务犯罪行为进行预防和惩处。完善巨额财产来源不明罪,一方面要搞好前置措施的设置,重在预防;另一方面要严密刑事法网,严惩巨额财产来源不明的犯罪分子。可从明确行为模式、规范法律用语、提高刑罚幅度、增设附加刑等方面对巨额财产来源不明罪进行完善。     

Is Fluorescence Under an Alternate Light Source Sufficient to Accurately Diagnose Subclinical Bruising?

This single‐blinded, randomized validation study was conducted to evaluate whether fluorescence under alternate light sources (ALS) is sufficient to diagnose subclinical bruising (bruising not visible under white light). Standardized trauma was induced on randomly selected ventral forearms. On days 1, 7, and 14 investigators independently examined case forearms under white light for perceived bruising and under ALS for fluorescence and compared body maps. 56 case and 62 control forearms (n = 118) were examined. Sensitivity of ALS on days 1, 7, and 14 was 76.8%, 69.6%, and 60.7%, respectively, compared to 69.6%, 60.0%, and 32.1% for white light. The specificity of ALS on days 1, 7, and 14 was 51.6%, 59.7%, and 53.2%, respectively, compared to 71.0%, 81.4%, and 86.9% for white light. ALS has increased sensitivity yet low specificity compared to white light in accurately detecting bruises. Fluorescence under ALS is not sufficient to accurately or responsibly diagnose subclinical bruising.

多元的物权法源及其适用规律

从我国物权的立法、司法、交易等实践情况来看,我国的物权法源是多元的。在属于规范性法律文件的法源中,国家立法机构制定的物权法等狭义法律是核心,它们的位阶平等,相互间存在替代、细化、补充等关系。狭义法律之外的其他规范性法律文件,包括行政法规、地方性法规、没有变通规定的自治条例、单行条例或经济特区法规、司法解释、部门规章、地方政府规章,解释和细化了狭义法律,在不违背狭义法律目的的前提下,给物权内容提供了重要支撑。规范性法律文件所认可的法源包括国家有关规定或国务院的有关规定以及当事人订立的合同。在上述法源之外,习惯与物权法的根本宗旨、基本定位、整体风格、相关规定等高度契合,在无其他法源可供适用时起到补充作用。中国共产党的政策在农村土地物权领域发挥着重要作用,在它与狭义法律不一致时,承载基本政策和具体政策的党中央文件可作为法院裁判说理的依据.但不能成为裁判依据。     

Police investigations in Internet open sources: Procedural-law issues

Analysing large amounts of data goes to the heart of the challenges confronting intelligence and law enforcement professionals today. Increasingly, this involves Internet data that are ‘open source’ or ‘publicly available’. Projects such as the European FP7 VIRTUOSO are developing platforms for open-source intelligence by law enforcement and public security, which open up opportunities for large-scale, automated data gathering and analysis. However, the mere fact that data are publicly available does not imply an absence of restrictions to researching them. This paper investigates one area of legal constraints, namely criminal-procedure law in relation to open-source data gathering by the police. What is the legal basis for this activity? And under what conditions can domestic and foreign open sources be investigated?     

Political competition and foreign policy power sharing

In this essay I examine the intersection of domestic and international politics in the formation and conduct of foreign policy. 1 develop a three‐actor model that allows us to specify the incentives for power sharing under different assumptions about the distribution of preferences and capabilities between a government, a domestic opposition, and a foreign state. The model generates several interesting hypotheses about the interaction of policy goals and the willingness of actors to share power. In particular, I show that under certain conditions there are important asymmetries whereby doves may be more willing to share power than hawks. Importantly, this willingness is endogenous to the model and comes from the alignment of preferences in the policy space, rather than from an a priori value for the democratization of foreign policy making. The model also suggests several hypotheses about the circumstances under which states have incentives to meddle in the foreign policy processes of other states.     

The Day‐to‐Day Life of a Dean: Engaging in Negotiations and negotiations

This article analyzes the negotiating strategies and tactics that proved useful during my eight‐year stint as dean of the New York State School of Industrial and Labor Relations during the 1970s. David Lax and James Sebenius have paved the way with their pioneering work on The Manager as Negotiator. By taking this perspective to the academic setting, I have identified a portfolio of tactics that are helpful in understanding how an administrator operates in a complex environment. The examples presented in this article help flesh out the standard categories of distributive and integrative bargaining as well as forcing and fostering strategies for implementing change.     

中国法学的苏联渊源——以中国法学的学科性质和知识来源为主要考察对象

苏联法学对中国法学的影响,从中国法学的学科性质和知识来源来看,主要表现在资本主义法学与社会主义法学的关系、革命时期法学与执政时期法学的关系、法学与意识形态、法学的研究对象、法学与实践、法学的知识来源、法学研究的范式与方法、法学学科的独立性、法学教育的模式等九个方面。关于中国法学与苏联法学之间的渊源关系,一是要反思中国法学与苏联法学的渊源关系背后的中国法学与苏联模式的渊源关系,二是要反思关于中国法学与苏联法学渊源关系的几种主要研究视角,积极影响和消极影响、路径依赖两种视角并未真正抓住问题的核心,从普遍性与特殊性辩证法的视角展开讨论将是一种更有助益的视角。     

Evidence of sixteenth- and seventeenth-century iron production and ironworking in Vidzeme (the example of Ropaži manor): an interdisciplinary approach

ABSTRACT

Using Ropa?i Manor as an example, this article analyzes evidence of iron production and ironworking in Vidzeme in the sixteenth and seventeenth centuries, characterizing the first results from an interdisciplinary study of this previously almost unresearched field. Content analysis of written sources in conjunction with linguistic analysis, archeological fieldwork, remote sensing and geophysics, paleobotany, and analysis of forest growing conditions illuminate aspects of economic life linked to or hypothetically relating to iron supply and processing, namely iron importation and circulation, craft activities, and charcoal production far exceeding local needs. Local iron production is not proven; neither is there evidence excluding it.
