中小企业私募债券监管法律制度研究

中小企业私募债券业务是解决中小企业融资难的一条新路径。中小企业私募债券市场存在着监管制度位阶过低、市场准入标准过高、投资者利益保护力度不足及应对市场风险措施不健全等方面的问题。应从市场准入、市场运行和市场退出三个层面,分别构建中小企业私募法律监管制度。     

从劳动派遣三方关系看雇主的责任分配

劳动派遣制度自在我国出现以后迅速发展,与此相对应的是法律理论和立法的空白,随着《劳动合同法》和《侵权责任法》的出台,使劳动派遣在我国有法可依,但由于发展时间短,许多地方有待完善。只要理清劳动派遣中用人单位、用工单位和劳动者三方关系,相关的责任分配则一目了然。     

Bringing the Past Back in: How Attitudes towards the Democratic Transition Influence the Portuguese Voter

Abstract

This article analyses the way in which attitudes towards the transition to democracy explain party identification and ideology in Portugal. This question is important because the transition to democracy in Portugal was a turbulent process marked by a rupture with the past and institutional fluidity. It has also conditioned the main political parties’ relationships with the electorate and each other since 1974. I compare the same explanatory model results from two surveys, conducted in 2004 and 2014, respectively, to understand the extent to which perceptions about the transition help characterise the Portuguese voter over the last decade.     

Trauma-Informed Resource Parent Training and the Impact on Knowledge Acquisition,Parenting Self-Efficacy,and Child Behavior Outcomes: A Pilot of the Resource Parent Curriculum Parent Management Training (RPC+)

This pilot study illustrates one state’s development, implementation, and outcomes of a trauma-informed curriculum called the Resource Parent Curriculum + CARE (RPC+). The RPC+ is an intensive co-trained curriculum intended to be trauma-informed and skills-based focused on ameliorating child behavior problems that are frequently the source of parenting stress and placement instability. This article will provide a literature review of child and caregiver needs, describe the training curriculum, and present the results from the pilot implementation of the curriculum. Preliminary findings from this study show participants of the RPC+ show positive changes pre- to post-training on a number of dimensions that have been correlated with placement stability for children including knowledge of trauma, parenting self-efficacy, and child behavior outcomes.

REALITY IS. . . . A RESPONSE TO MARTINDALE,TIPPINS, BEN‐PORATH,AUSTIN, AND WITTMANN

This article is written as a response to the Martindale et al. critique of the Ackerman and Pritzl (2011) child custody evaluation practices article. The Martindale et al. critique focuses on a small portion of the overall results regarding test usage and suggests that the entire article is “flawed and deficient.” However, their critique engages in confirmatory bias and exaggerated statements and ignores the overall value of the article in general. A more broad‐based explanation of the results is provided herein.

Do female legislators benefit from incumbency advantage? Incumbent renomination in a flexible-list PR system

This study investigates whether female legislators, just like their male colleagues, also benefit from incumbency advantage in the form of privileged access to candidate selection. This is done by examining whether female and male MPs receive the same reward for equivalent political performance when renomination decisions are made by political parties. Political performance is conceptualised in terms of incumbents’ popularity among voters, readiness to vote along the party line and legislative activity. An original dataset comprising 1032 observations on Czech legislators elected between 1996 and 2017 is used in the analysis. The results suggests that well-performing female MPs are just as likely as their male colleagues to secure a favourable renomination outcome. This result should not, however, be interpreted as evidence of gender-neutral access to re-election and political seniority as past research clearly indicates that female MPs need to work harder than men to produce the same political output.     

重庆市土地行政征收案件调查报告

现行征地立法规范存在较强局限性,行政征地权缺乏自我约束、自我发展、自我完善的内部约束与激励机制,人民法院在审理征地案件时,既不能评判既有的征地规则,也不能对具体征地案件从形式上与实质上进行审查,难以有效监督、制约征地行为。改革征地制度,限制政府征地权力,保障农民土地的最大收益权,已经成为实现城乡统筹发展,构建和谐重庆的关键所在。以城乡统筹发展观为指导,提高征地与征地补偿法律位阶,制定《重庆市土地征收条例》,制定《重庆市行政征收程序规定》,以及建立和完善我市土地整理制度是防治征地行政争议扩大化的根本性解决机制。
