犯罪分类的观念与形态

刑法学注重事后合理的定罪量刑,表现在犯罪分类上,主要以行为性质展开,关注的是行为的法益侵害属性,竭力表述不同性质的行为在具体犯罪构成上的区别;犯罪学注重揭示犯罪原因、强调事前犯罪预防,表现在犯罪分类上,主要展示犯罪原因与犯罪预防个别特征的犯罪人的类型;同时关注说明犯罪人人格特征的行为类型。在法律规范的框架内,刑事近代学派的思想只是一种观念的引导,它的刑法学意义必须通过刑法规范的形式,转化成具体的技术方法;尽管思想为根、为本,但是技术为体、为形;并且,若是缺乏了技术操作,则无所谓刑法。     

面向多元文化关系的法治理论

多民族多元文化关系的变迁和发展,构成现代民族国家公民身份认同的政治学问题,导致文化认同关系危机。多民族国家也面临由于多元文化关系而面临主流文化与少数文化发展的冲突要求。西方传统自由主义公民权理论受到挑战,自由主义法治理论由于缺乏充分接受多元文化的准备而陷入争议和困惑。中国多民族文化传统为其他社会提供多元文化认同的历史经验,并提出当代普遍公民文化的中国实践。

本文通过对社会主义社会生产方式、劳动和价值创造特点的研究,提出了社会主义劳动价值论是社会主义剩余积累论的理论主张。     

Public Value Management: A Case Study of Transitional Change in Disability Sector Reform in Western Australia

This paper contributes to the study of public value management (PVM). PVM is distinguished from other approaches to public administration in its focus on establishing community networks and collaborative capacity building for the creation of public value. We explore PVM through a case study of a public–community sector partnership strategy called the positive behaviour framework (PBF), a state government initiative designed to transform services for people with disabilities. The development and implementation of the PBF is analysed via a transitional change or ‘sector awareness’ model. Each phase of the model is illustrated through ‘positive stories’ that depict key moments in the change process and in the activities that public sector managers employed to raise awareness, build capacity, and promote collaboration. We discuss the implications of the study for disability sector change management and for the further study of the PVM approach to public sector administration.     

Putting the Supplier in Housing Supply: An Overview of the Growth and Concentration of Large Homebuilders in the United States (1990–2007)

As housing production was ramping up in the 1990s and 2000s, some of the industry’s largest firms experienced remarkable growth primarily through mergers and acquisitions and the issuance of debt; the market share of the 10 largest firms tripled between 1995 and 2005. This article describes the role of financial firms in encouraging that growth and some of its consequences. Drawing on financial filings, news reports, investor analyses, and other relevant data, this article offers an overview of the relationship between homebuilders and investment firms, as well as a new explanation of the oversupply of housing in the 2000s. In doing so, this article seeks to bring attention to homebuilders as a missing feature in analyses of housing supply and housing markets, and proposes directions for future research.

Moving Up the Value Chain in ICT: ASEAN Trade With China

The rise of China increased competition for foreign direct investment and exports for the ASEAN economies. It also increased ASEAN trade with China. But, are ASEAN countries able to move up the value chain in their trade with China? The objectives of this article are to examine upgrading in the information and communications technology (ICT) value chain through changes in the product quality of parts and components (PNC) exports from ASEAN to China and the influence of these changes on their ICT trade with China. The main findings indicate that there is little or no product upgrading in the most important SITC 776 sub-component of the PNC exports from the four major ASEAN economies (ASEAN-4) to China after 2005. It is also found that improvements in product quality are more apparent for SITC 772 but this product group constitutes a small share in total manufactured exports from the ASEAN-4 to China. Lastly, with little or no product upgrading, exporters from the ASEAN-4 have shifted to exports of non-PNC goods to China. This shift has enabled the overall ICT exports from the ASEAN-4 to China to continue to grow for the period of this study.     

我国同种数罪处罚方法通说的内在矛盾及其解决

我国同种数罪处罚方法存在的问题,源于我国刑法制度层面的冲突,主要表现为我国数罪并罚制度与刑法规定的法定刑之间的冲突,数额犯、数量犯的大量存在使这种冲突表现得直观和明显。在现有的刑法规定之下,任何解决方案都无法从根本上解决问题。笔者认为,应该把同种数罪处罚问题的解决,放在我国刑罚制度改革的整体中予以考虑,以期在我国的刑罚制度改革中加以彻底解决。     

经济法的价值本位探究

经济法是一门新兴的部门法,它的出现有其内在的必然性及客观的历史渊源。经济法出现之初始终伴随着国家强制干预色彩,“市场失灵”是国家干预的理论基础。经济法是以国家公权力的强制手段面貌出现,维护社会公共利益和人的基本权利是经济法的基本价值和宗旨。维护公平竞争、进行宏观调控、实现社会整体公平与效率的统一是经济法的基本原则。     

论高校教师师德修养的价值取向

师德修养是教师的永恒主题。在社会转型的大背景下,受市场经济大潮的影响,师德修养面临许多新问题、新挑战。如何使师德修养与时俱进,提高师资队伍的整体素质,进而达到提升高校人才培养水平,这是一个亟待研究、探索的课题。本文结合当前高校的实际,客观分析了当前高校教师队伍的师德现状,指出了存在的问题,论述了加强师德修养的价值,提出了加强师德修养的基本取向。
