美国医疗纠纷替代性解决机制现状及发展

美国医疗纠纷替代性纠纷解决机制卓有成效,其不仅包含作为传统非讼手段的调解、仲裁、和解。还创设出监察员制度、事实调查、建立共识、混合式ADR、聘雇退休法官程序、微型审理、简易陪审团审判、诉前审查庭等多种方式。因受到司法机关与行政单位的重视和民间团体的大力支持,美国ADR制度已经发展成为与民事诉讼制度双轨并行、相互补充的重要纠纷解决机制。当前,针对我国医患纠纷事件频发,伤医事件愈演愈烈的情况,将ADR机制导引入国内医疗纠纷领域,不失为一条妥善解决医疗纠纷的有效可行的途径。     

"堰塞湖"型社区治安管理模式探析 ——以北京市崔各庄东辛店村为例

基层治,则天下安。在新型城镇化纵深推进大背景下,对流动人口住处的疏解整治成为解决"大城市病"的必要手段,但实践中拆迁整治引发了"堰塞湖效应","堰塞湖效应"使得流动人口流入地社区演变成"堰塞湖"型社区。对此类社区的治安管理应革新以往防范式治安管理模式,有针对性地构建社区治安问题"审视→分析→反应→评估"的治安管理模式,根据"堰塞湖"型社区治安问题产生的原因及管理困境,形成一套从宏观到微观的逻辑严谨、运行有序的治安管理体系。具体可从树立"善治"和"共治"治安管理理念、促进流动人口社区融合和社区治安资源整合等方面入手解决"堰塞湖"型社区治安问题,以维护社区安全稳定。     

North Korea's Internet strategy and its political implications

Abstract

During recent years, the role of information technology in shaping politics and social movements in the digital age is drawing increasing scholarly attention. There is, however, little such literature on North Korea as the country remains almost completely cut off from the Internet. Since the mid-1990s, the DPRK government has strategically developed its information and communication technology and has subsequently built a domestic intranet. Although North Korea keeps a minimal presence on the web, there are signs that the country is taking small and cautious steps to allow some social elites to take advantage of the Internet in order to leapfrog its economic development. Indeed, a high-profile defector indicated that North Korea will most likely start allowing wider but limited internet access in the near future. This paper examines North Korea's intranet and Internet policies and explores their political implications by drawing upon first-hand data from Korean sources and existing literature as well as by juxtaposing the North Korean case with other communist regimes such as China and Cuba in terms of their attempts to control and manipulate the Internet. It shows that the DPRK government is likely to learn from the Chinese and Cuban experiences and adopt a ‘Mosquito-Net’ model in controlling the Internet in an effort to attract foreign investment while keeping out information deemed threatening by the regime.

当前仍在持续的国际性经济危机,本质上是资本主义生产方式的危机。这次危机不仅使传统资本主义模式难以为继,也宣告了新自由资本主义的破产。但资本主义制度不会就此退出历史舞台,而是将在资本主义制度范围内通过深刻的变革而实现模式转型。中国作为新兴的市场经济大国,已经不可避免地处于国际性的经济危机之中了,其内因是基本的。为此,必须深刻总结30多年来改革发展的经验教训,适当转变改革思路和发展方式,走一条既符合一般规律又符合中国国情的发展道路。     

Data Protection: An Opening Door?

Swedish public law has incorporated a general rule of public access to documents, and to information in the wider sense, since the Freedom of the Press Act of 1766. On the Community level, the relationship between Regulation (EC) 45/2001 on data protection and Regulation (EC) 1049/2001 on public access to documents exemplifies the tension between the public's interest in scrutinising the administration carried on in its name, and the integrity of the individual. However, a similar tension exists between Sweden's Personal Data Act of 1998, implementing Directive 95/46, and the Freedom of the Press Act. A misuse model of data protection law, by seeking to concentrate on serious rather than technical infringements of privacy, might serve to ease the tension. 猪圆环病毒2型猪伪狂犬病病毒和猪细小病毒三重PCR检测方法的建立

针对猪圆环病毒2型(PCV2)ORF2、猪伪狂犬病病毒(PRV)gD和猪细小病毒(PPV)VP2基因保守区域,设计了特异性引物,在分别建立单一病毒基因PCR检测方法的基础上,通过对3组引物的比例和浓度、dNTPs和Mg2 浓度、退火温度等条件的优化,建立了针对上述3种病毒的三重PCR检测方法。敏感性试验表明,应用该方法最低可检测到4×10-4ng/μL的PRV双链DNA模板和2×10-5ng/μL的PCV2和PPV单链DNA模板。对21份自然感染病猪样品的检测结果表明,该三重PCR检测结果与单一PCR检测的结果完全符合。试验结果显示,建立的三重PCR方法可用于3种DNA病毒的同时检测,具有快速、准确的特点,有临床应用前景。
