Since April 2009, the Care Quality Commission (CQC) has been responsible for regulating standards of health and adult social care in England, as well as monitoring the operation of the Mental Health Act 1983. The latter function was previously performed by the Mental Health Act Commission (MHAC). This article compares the role and functions of both bodies in terms of their ability to provide a legitimate system of regulation and an effective safeguard for psychiatric patients who are deprived of their liberty. This paper is important, as there is very little published data to date on the work of the CQC and its predecessor, the MHAC. It is also necessary to evaluate changes to the regulatory landscape and compare the different regimes, to find out whether it has improved the protection and quality of care for mental health patients. The article concludes that the CQC does have the capacity to monitor detention, enforce standards and improve the quality of patient care, as long as it continues to endorse a commitment to human rights and service user involvement, to preserve the expertise and knowledge of visiting inspectors and to maintain accountability and independence from the State. 相似文献

The Annie E. Casey Foundation’s Juvenile Detention Alternatives Initiative (JDAI) seeks to reduce the reliance on pre-dispositional detention. While anecdotal evidence indicates that the program has enjoyed some success in reducing detention populations, no controlled study has assessed the efficacy of the program. The current study investigated the impact of JDAI following its adoption in one Virginia juvenile court. Specifically, using data on all juveniles referred to intake over a seven-year period, the research analyzed predictors of detention and length of stay before and after JDAI. Results indicate that after the implementation of JDAI, greater emphasis was placed on legal factors including offense seriousness and prior record, though the increased emphasis was greater for non-whites than for white youth. Additionally, results suggest that after JDAI’s adoption, older non-white youth were more likely to receive secure detention while non-white females received some degree of leniency compared to non-white males. 相似文献

The detention of non-status migrants is now commonplace in developed countries. Detention has been justified on such grounds as security, the welfare of non-status migrant populations, and as a way to speed up processing asylum claims. Drawing from the artist Krzysztof Wodiczko's sustained interest in themes of migration and belonging, this article examines the relationships between technologies of government in detention and accommodation facilities, and the possibilities and constraints of protest that these settings and practices give rise to. The analysis highlights paradoxes of freedom as well as opportunities for protest that imbue these spaces. Using Foucault's discussion of technologies of government, we draw on empirical research to highlight how orientation booklets, classes, and legal self-representation manuals are technologies that compel asylum seekers to become ideal detainees in hopes of being understood as ‘liberal subjects’ worthy of inclusion in a small number of evermore tightly policed Western European states. We conclude with the suggestion that asylum seekers' paradoxical encounters with technologies of liberal government deliver a challenge to the accepted framework of citizenship within liberal societies. 相似文献
