县城经济发展与农村基层组织建设的关系极为密切。一方面,县域经济快速、健康、全面发展需要农村基层组织的有力支持和社会保证;另一方面,农村基层组织要建设好、完善好必须依靠县域经济的大发展,为其提供物质力量和发展思路,在县域经济发展和农村基层组织建设问题上,必须重视研究各自的个性,特点及其发展规律,探索两者有序、健康、协调发展的正确方式、方法和道路.     

云南省中小学毒品预防教育现状及对策研究

目前 ,云南省中小学毒品预防教育虽取得了一些成绩 ,并积累了一定经验。但存在着在校学生吸毒人数少 ,离校学生吸毒人数多等问题。原因 :1、对学校毒品预防教育的重要性认识不足 ;2、缺乏专门人员和专项经费 ;3、受毒品和社会客观环境因素的制约。建议 :1、进一步提高认识 ,切实加强领导工作 ;2、提供专任教师和专项经费 ;3、保证学校毒品预防教育的课堂教学时间……     

再探我国刑法中的转化犯

转化犯是刑法学界研究的热点之一 ,并存在很多争议。文章认为 ,转化犯是指在行为人实施的已构成某一故意犯罪 (本罪 )的基本行为的同时或者非法状态持续过程中 ,由于特定行为或结果的出现 ,使基本行为与特定行为或结果的结合该当另一较重的故意犯罪 (转化罪 )的构成要件 ,依法律规定以转化罪定罪处罚的犯罪形态。     

试析劳动价值论面临的几个难题

劳动价值论正面临着种种质疑、难题和挑战。这些难题主要有:是否只有劳动创造价值?如何解释自然资源的价值源泉和有偿使用?生产资料和科学技术是否创造价值?如何解释价值生产中多要素投入与单要素产出的矛盾?如何解释古文物和企业无形资产的价值源泉?如何计算商品中凝结的社会必要劳动时间?只有这些问题得到合现解释,劳动价值论才能得以坚持和发展。     

如何消除宗族势力对我国农村基层党建的影响

当前复兴的宗族势力对我国农村的基层党建已造成严重影响,主要表现在宗族意识对党员干部的影响、宗族组织向党组织的渗透、宗族利益同党的方针政策的对抗、宗族权力对党的领导的威胁四个方面,而且,这种影响有进一步恶化的趋势。文章认为对宗族势力应采取“有保有压”的方法,从而最大限度地减少它对农村基层党建的影响,为党的农村基层建设提供有利的环境。     

Norwegian Politics of Abortion: Perspectives, Arguments, and Values

Grid-group cultural theory is applied to an empirical analysis of five debates on abortion in the Norwegian Parliament between 1992 and 1996. Policy arguments concerning selective abortion and abortion in general are compared. In the cultural–theoretical literature, restrictive policy arguments towards abortion have been connected to the hierarchical cultural bias, whereas permissive policy arguments have been associated with egalitarian and individualistic worldviews. The empirical analysis, however, shows that there are various different connections between abortion policy arguments and cultural biases. The possibly contradictory situation that arises when parties switch between cultural biases is discussed, and the article concludes that grid-group cultural theory proves useful in relating the various abortion policy arguments to broader worldviews that transcend this particular policy issue.     

巨额财产来源不明罪适用中若干问题研究

巨额财产来源不明罪的实行行为方式为不作为犯 ,行为人说明财产来源合法的义务来源为有权机关的依法责令 ,根据现有法律可以作出责令的机关为检察机关和监察机关。本罪的罪过形式为直接故意 ,其停止形态只存在既遂犯。本罪可能存在教唆犯、帮助犯的情形 ,在特定情形下共同实行犯也可能成立。本罪不存在自首的可能。判决生效后 ,如果行为人履行了说明义务 ,应当依审判监督程序改判 ;如果查明其财产属于其他犯罪所得 ,在维持原有判决的效力的情况下 ,与本罪进行数罪并罚。

ABSTRACT

When the Assemblée Nationale Constituante (ANC) adopted the first French constitution, delegates composed 11 articles whose purpose was to guide and govern the behaviour of members in a future legislative assembly. Procedures in three of these articles required that a bill receive three readings during its progress through the assembly. Beginning with works of René Descartes (1637) and Galileo Galilei (1638), I located sources for procedures that guide and govern the work of law-makers, applying their reasoning to the process of legislation. I explain how investigators went about identifying variables that captured conditions of possible experience. Narrowing my focus to three articles in the 1791 constitution, I extracted variables pertinent to the three readings of a bill, along with the permissible range of values that the text of these articles assigned to each variable. An Excel 3D Surface chart presents procedural choices which were available to French delegates to the Assemblée Nationale Constituante, the body responsible for drafting the 1791 constitution. The Excel chart is based on arrays of variables and the values assigned from the text of these three articles; these are located in Section II Tenue des Séances et Forme de Délibérer / Conduct of Meetings and Form of Deliberation’.     

“两岸”的平潭，抑或“平潭”的平潭？——《平潭时报》消息来源与议题建构的视角

消息来源对于媒介议题具有重要的建构意义。媒介通过引用不同的消息来源策略，塑造不同议题倾向，从而达成其媒介意图。本文以平潭综合实验区地方党报《平潭时报》为例，通过对其新闻报道中使用的消息来源进行内容分析，试图了解该报的消息来源策略以及议题建构偏向。研究发现，尽管平潭综合实验区承担着两岸“共同家园”的政策使命，但其地方党报仍以本土意识为中心，议题局限于官方话语权统领之下的本地建设和政策引领，忽略了两岸关系互动中的内在同一性。换言之，本应定位“两岸”的平潭，在实践中却还停留在“平潭”的固有意识。     

首要标准下监狱企业转型升级的思考

发展是永恒的话题。在服务“首要标准”的方针指引下，对监狱企业实行转型升级，实现监狱生产的可持续健康发展，是一个重要的理论课题。当前，我国监狱企业面临诸多困境，深度解读“首要标准”和“转型升级”，有助于科学认识监狱生产的发展规律，推动监狱和监狱生产工作实现良性循环发展。
