监狱劳教人民警察职业枯竭问题研究

监狱劳教人民警察工作任务重、岗位责任大、危险程度高的职业特征,决定了他们是职业枯竭的高发人群。长期持续的职业压力是引发警察职业枯竭产生的最主要的原因。除此之外,社会环境、组织内部因素等也会导致职业枯竭的产生。监狱劳教人民警察的职业枯竭问题不容忽视,它不仅影响着警察的身体健康,而且严重影响着警察的心理健康．导致警察队伍不稳定、战斗力下降等问题的产生。因此,应当创建针对监狱劳教警察职业压力的疏导调适机制．建立为监狱劳教人民警察提供服务的帮助系统,以帮助干警解决心理问题．预防和降低职业枯竭。     

关于量刑建议权的几点思考

量刑建议权是公诉权的重要内容,是求刑权的外在表现,本文在论证量刑建议权价值合理性的基础上,结合司法实践,对量刑建议抗诉权行使的时间、载体及具体内容提出了构想。并论证量刑建议与抗诉的关系。     

监狱罪犯教育的理想与现实

培养身心健康、重新适应社会的守法公民是监狱罪犯教育追求的目标：当前我国传统的行刑制度和行刑理念,使罪犯教育缺乏针对性、适应性、科学性。确立现代、科学的罪犯教育理念,构建科学化、社会化、个别化的罪犯教育体系是提高罪犯教育效能的必然选择。     

Exploring the effects of work environment variables on the job satisfaction of Nigerian correctional staff

Correctional staff job satisfaction is critical for the staff’s well-being and low turnover. This study’s focus was identifying variables that predicted job satisfaction for Nigerian correctional staff and comparing the findings to past studies of US correctional staff job satisfaction. One hundred and twenty correctional staff from Nigeria were surveyed. The personal characteristics of age, gender, and tenure were not significant predictors of satisfaction in the multivariate analysis. Similar to finding for US correctional staff, job autonomy, quality of supervision, and instrumental communication all had significant positive effects on Nigerian correctional staff job satisfaction. Contrary to previous findings on US prison staff, neither job variety or role overload were significant predictors of Nigerian staff job satisfaction. Other factors may account for this discrepancy, including working conditions, the socio-economic environment and availability of job opportunities.

在我国监狱中,存在男性罪犯遭受性侵犯的现象,这给被害人与社会带来十分严重的危害.我国应当借鉴美国的经验,对性侵犯进行全面的调查,确立"零容忍"政策,建立调查、研究、预防与处理性侵犯问题的领导机制,同时完善被害人寻求救济的机制.     

一篇尘封26年的立法建议——对监狱工作方针的早期研究

监狱工作方针历经多次变革,至今日趋完善。然而,任何立法的过程都凝结着科研工作者和立法决策者的心血,有时还要打破种种思想束缚。可以说,立法的日趋完善体现着法制建设的进步和民主进程的发展,也是建设社会主义和谐社会所必需的。     

关于狱政管理专业毕业生在岗基本情况的调查

文章是针对原辽宁省大连监狱的21届狱政管理专业毕业生的真实情况而撰写的调查报告。文中根据调研掌握的监狱机关及毕业生对警校狱政管理专业教学的要求,提出了"应加大实践教学力度"和"专业教学与素质教育有机结合、拓展教育空间"等可行性意见。     

监狱警察职业心理健康现状调查

监狱警察是指在监狱工作机关从事刑罚执行、实施惩罚和改造罪犯的人民警察,他们既是执法者,又是管理者,也是教育者,正是由于这种特殊的社会角色,他们不得不面对单调、枯燥的工作内容,偏远、闭塞的工作场所,压抑、沉闷的工作环境,不近人情的工作制度等等。长期在这种状态下生活、工作,他们中的很多人都产生了各种各样的职业心理健康危机,严重影响了他们的工作绩效、身心健康、生活满意指数。不能以社会认可的行为进行克服,致使紧张、焦虑、烦躁甚至抑郁等消极情绪体验,未得到及时有效的心理输导和宣泄,最终引发严重的心理问题。     

非政府组织参与监狱危机管理——现代社会监狱危机管理的新课题

非政府组织作为公民参与的最佳形式参与监狱危机管理是多种背景因素共同起作用的结果。在参与中,二者既博弈又互补:监狱规制着非政府组织参与的程度,非政府组织又影响、反制监狱危机管理。在各种监狱危机发生的前、中、后三个阶段,非政府组织或在其中之一或全程演绎着独特的作用,证明着自己的不可或缺。由于法制建设、社会和人们的观念的相对滞后、监狱社会化的不彻底,使得非政府组织参与监狱危机管理处于探索和试验的状态。鉴于此,参与的模式也多种多样,如咨询建议模式、授权、契约模式、监督模式和理想模式,以适应不同境状的发展。     

Rethinking Prison Disciplinary Processes: A Potential Future for Restorative Justice

Abstract

The movement for restorative justice (RJ) has struggled with marginalization on the soft end of the criminal justice system where the threat of net widening and iatrogenesis looms large. To realize the full potential of RJ as an alternative philosophy of justice, restorative practices need to expand beyond the world of adolescent and small-level offenses into the deeper end of the justice system. Disciplinary hearings inside of adult prisons may be a strategic space to advance this expansion. This article presents findings from a study of prison discipline in four U.K. prisons. The findings strongly suggest that in their current form such disciplinary proceedings are viewed by prisoners as lacking in legitimacy. Although modeled after the adversarial system of the criminal court, the adjudications were instead universally derided as “kangaroo courts” lacking the basic elements of procedural justice. Based on these findings, we argue that RJ interventions may offer a viable redress to these problems of legitimacy which, if successful, would have ramifications that extend well beyond the prison walls.
