审查批捕工作改革探讨

鉴于目前我国审查批捕工作存在的若干问题，对其进行深化改革显得尤为必要和紧迫。应在更新司法理念的前提之下，在办案模式、办案机制、工作方式等各方面进行深层次的、实质意义的改革和完善，这将有利于保障人权，提高办案质量和效率，维护社会公平和司法公正。     

村务公开存在的问题及对策探讨--以新田县某乡村务公开为例

村务公开是尊重民意、还权于民的一项民心工程,是实现村民自治的一个核心环节。文中通过分析新田县某乡村务公开工作中存在的诸多问题,有针对性地提出了一些解决对策。     

Legislative Fragmentation and Government Spending in Presidential Democracies: Bringing Ideological Polarization into the Picture

We claim that, in presidential democracies, the effect of increasing fragmentation on government spending should be conditional on polarization, defined as the ideological distance between the government's party and other parties in Congress. We build a model where this result follows from negotiations between the legislature and an independent government seeking the approval of its initiatives—as in presidential democracies. Using cross‐country data over time, we test the empirical validity of our claim finding that, in presidential democracies, there is indeed a positive effect of fragmentation only when polarization is sufficiently high. The same is not true for parliamentary democracies.     

浅析农业支持与保护之农业科技推广——以黑龙江省农科院为例谈“院县农业科技合作共建模式”

建立健全农业科技推广服务体系,加强对农民的技术培训,是我国加入世界贸易组织之后实现农业支持与保护目标的必然要求。尽管目前我国在农业科技推广过程中还存在一些问题,但也积累了许多有益的经验。黑龙江省农科院开展的＂院县农业科技合作共建＂方式探索出了一条科技兴农,建设社会主义新农村的有效模式,为科技服务、科技推广、科技帮扶开辟了新思路。     

反思与前瞻:刑法司法解释的理性思考

刑法的适用过程就是解释刑法的过程,而且刑法解释的水平也是刑法学理论是否先进的重要标志之一.从1997年刑法典实施以来的十余年时间里,"两高"的司法解释"十分繁荣",而在这种"繁荣"的背后,存在着令人担忧的问题,如刑法解释内容立法化,刑法司法解释主体多元化,刑法司法解释效力冲突化,刑法司法解释方法违法化,刑法司法解释语言粗疏化等诸多问题,较为明显地体现出我国的最高司法机关在刑法司法解释方面不够慎重的态度.     

高校学生惩戒纠纷解决机制的现状与问题

当前,我国高校学生惩戒纠纷呈现出类型多样、内容复杂、解决难度较大等特点。学生惩戒纠纷的主要类型有行政纠纷、学术纠纷和民事纠纷等。目前惩戒纠纷解决机制存在的突出问题是校内申诉机制缺陷突出,校外行政解决机制通道不畅,通过诉讼渠道解决障碍较多。构建崭新的纠纷解决机制势在必行。     

The Walk in the Woods: A Step‐by‐Step Method for Facilitating Interest‐Based Negotiation and Conflict Resolution

In this article, we describe a method we have used successfully in both academic and professional settings to rapidly introduce novice negotiators to the principles and practice of interest‐based negotiation: “the walk in the woods.” The walk incorporates much of the principles of interest‐based negotiation: fostering self‐awareness, cultivating curiosity, and understanding the importance of world view. The walk's effectiveness is illustrated in this article using the case of the merger of two large, complex health‐care organizations.     

对73起重大疑难命案的实证分析——从刑事证据的收集、固定、审查判断和运用的角度

命案中的证据收集瑕疵表现为重嫌疑人有罪供述,轻物证、书证;重有罪证据,轻无罪辩解;勘查现场不及时、不细致;非法取证等。证据固定瑕疵表现为靠重复讯问固定证据;不善于运用录音录像固定证据;物证检验不及时;刑事技术鉴定结论不明。证据审查判断和运用瑕疵表现为轻信鉴定结论等科技证据;忽略物证证明的间接性;依赖口供又不会运用口供;不能正确对待嫌疑人的辩解;不能正确认识证据数量和证明力的关系;不善于排除证据矛盾。造成这些瑕疪的原因在于不能准确把握"命案必破"的内涵;办案思维方法不正确;不会把握证据确实、充分的定罪标准等。建议强化责任意识;增强人权意识;强化证据意识;正确运用有罪口供;建立切实可行的非法证据排除制度;制订科学合理的考核办法。     

Emerging technologies and problem definition uncertainty: The case of cybersecurity

For governments to regulate, they must first define the problem and decide which policymakers have the authority to make decisions. Technological development can disrupt the authority-allocation process by fostering uncertainty about which actors are responsible for making policy. This article examines the role that changing technology has played in the development of cybersecurity policy in the United States. New technologies have increased the type and scope of assets vulnerable to cyberthreats, and with them the number of governing units who can claim jurisdiction over cybersecurity-related issues. Uncertainty about the nature of the problem has led the U.S. Congress to rely heavily on bureaucratic witnesses and focus on how existing regulations can be brought to bear. Emerging technologies create regulatory challenges for governance not only through unforeseen consequences but through uncertainty over who can regulate. Fragmented authority can produce piecemeal responses and a reliance on existing frameworks that benefit regulated industries.     

经济全球化：国内理论前沿

国内关于经济全球化问题的研究尚未形成一致的理论。为推进这方面研究的发展与创新,本文对我国理论界关于经济全球化问题的研究从定义、起始时间、产生原因及影响等方面进行了梳理,分析了这方面研究的进展与不足;对国内理论界关于经济全球化的研究方法和视角进行了剖析,指出了其科学性和局限性。
