在源远流长的中华法制文明的历史上,尽管有着重实体轻程序的传统,但随着历史的发展,法制文明的进步,传统法上的搜查制度也在实践中不断地完善。清代法制是中国封建法制的高峰,相应的,清代法律中的搜查制度也比较完善。它对搜查的主体、搜查的对象、搜查的执行方式、搜查主体的责任等方面都有比较详细的规定,并且体现出有效保障原则、遵循令状原则、合理根据原则、针对性的搜查原则以及鲜明的国家利益至上的法律思想与人本主义的法律思想。 相似文献

The notion of going from government to governance, known as the transformation thesis, as depicted in early Governance Theory has been subjected to substantive critique. This paper explores two different stances of such critique. The first critical stance is represented by Jonathan S. Davies’ 2011 book “Challenging Governance Theory: From networks to hegemony” and entails a radical rejection of the transformation thesis. The second stance offers a more moderate reconfiguration of the transformation thesis and is represented by the recently co-authored work of several prominent governance theorists titled “Interactive Governance: Advancing the paradigm”. While both aspire to set new agendas for governance research, this paper argues that the latter reconfiguration carries a problematic preposition towards overemphasizing the separation between government and governance practices. 相似文献

Surprising correspondences emerge from the parallel investigation of fund accounting practices in Italian entities until the late nineteenth century and in the contemporary U.S. public sector. The analysis attempts to interpret similarities and differences in light of dissimilar environmental features, and wonders if the Italian tradition could have some explanatory capability on the U.S. present standards. The “fund” concept and its use are strictly similar; they are founded on information needs for governance and internal control. This practical note highlights lessons learnt during the data collection of two large field surveys as part of the ongoing “Sindh Union Council and Economic Strengthening Support” (SUCCESS) programme in southern Pakistan. When creating a process of international aid, the definition of a political strategy is critically important. In theory, a government able to deliver services and goods to its population and to guarantee participation in decision-making might not need the presence of international aid. Multi-partner consortia have emerged as an important modality for knowledge generation to address complex sustainability challenges. Establishing effective multi-partner consortia involves significant investment. This article shares lessons from the Collaborative Adaptation Research Initiative in Africa and Asia (CARIAA), which aims to support policy and practice for climate change adaptation through a consortium model. Key lessons include the need to facilitate collaborative spaces to build trust and identify common interests, while accepting that this is not a guarantee of success; the importance of programmatic leadership to achieve synthesis; and the value of strategic planning in supporting motivation and alignment between partners. 相似文献
