探索征地制度改革 确保农民合法权益

征地工作事关国家经济建设和农民切身利益。随着工业化和城市化进程的加快,大量土地被征用。目前土地还是农民生存保障之本,征地过程中如何确保农民合法权益已成为迫在眉睫的问题题。该文通过分析中国征地制度存住的问题,从保护失地农民权益的角度,提出了要严格规范土地征用、完善补偿机制及规范土地交易市场等建议。     

警察人性化执法的合理定位及其有效保障——以袭警事件为视角

近几年来,我国各地发生了一系列暴力袭警事件,不仅严重危害了警察的人身安全,而且也是对警察执法权威和执法尊严的挑战,更是对国家法律尊严的藐视和挑衅。随着袭警事件的凸显．有关部门和学者在分析原因时认为。袭警事件频发与公安机关推出的“人性化”执法有关,应当叫停人性化执法。其实．正当的警察人性化执法非但不是袭警案件发生的原因,反而是消减该类案件发生的一项有效举措。当前,警察人性化执法之所以引起争议．并非其本身的问题,而是制度设计存在漏洞。因此,应当走出人性化执法的误区,完善警察人性化执法的保障机制．     

全球治理中的跨国反洗钱台作

全球治理是国际社会应对全球问题而变革传统治理模式的一种构想,它的兴起为全球反洗钱控制与治理提供了重要的理论指导。在跨国反洗钱控制的全球治理模式中,国家和政府间、国际组织间的制度性合作机制仍然占据主导地位,发挥着不可替代的规范性与约束性的治理作用。但值得注意的是,非国家行为主体在跨国反洗钱的全球治理中日益发挥着越来越重要的促进作用和参与作用,并能在一定程度上缓解传统治理模式的＂民主赤字＂问题。

通过分析城乡居民抽样调查资料,建立城乡居民收入差距的回归分析模型,对城乡居民收入差异的区域性特点进行了比较分析。从而为缩小城乡居民收入差距提供了理论参考。     

公共危机管理视角下的应急警务

SARS危机以后,传统政府治理模式下的公共危机管理和应急体系受到了普遍的质疑。随着政府应急体制、机制、法制建设的不断发展完善,突发事件中的应急警务在训练、应急备勤、信息披露等方面发生了重大变化。从公共危机管理的视角而言,应急警务是公共危机管理的重要环节之一。公共危机管理理论为应急警务研究提供了必需的理论依据;在行动逻辑、法律规制、组织建构、应急技术等方面为应急警务的相关研究提供了更为广阔的空间。     

侦审合一后的预审工作研究

我国的预审制度起源于1931年12月中华苏维埃共和国临时中央政府颁布的训令,立法于1979年7月我国颁布的第一部《刑事诉讼法》中,它在公安机关办理刑事案件中发挥了重要作用。1997年6月公安部作出侦审合一的刑侦体制改革,但目前侦审合一呈现多元化的格局,它既有改革相配套的制度和措施跟不上的原因,又有侦查人员破案任务重和素质能力弱,无法适应改革要求的原因。未来的预审工作,除了允许侦审合一的多种形式存在外,应当继续推进侦审合一;提高现有侦查人员侦查、预审素质;实行受过专门训练的公安、政法院校侦查学专业或者相近专业毕业的学生准入侦查部门的制度。     

Parliament on its Knees: MPs' Expenses and the Crisis of Transparency at Westminster

In May 2009, revelations made in The Daily Telegraph about the way that MPs had used and abused the House of Commons expenses and allowances regime threw the British political system into turmoil, forced the resignation of the Speaker of the Commons along with a number of implicated MPs, and ignited talk about a crisis in parliamentary democracy and a collapse of public trust in politics. This article explores the events that led to this situation, from the structure of MPs pay and allowance system, the Freedom of Information context that framed the disaster, and the crisis of transparency which the House of Commons has itself precipitated. It argues that, talk of parliamentary reform aside, MPs must radically rethink the way that they approach their representative role and the nature of their broader engagement with the public they claim to serve.     

Relativism

Modern democracies increasingly confuse civic or political equality with a radical relativism that calls into question legitimate principles of hierarchy and the very idea of reasonable value judgments. This confusion reflects a “corruption,” in Montesquieu’s sense, of democracy rooted in a refusal to recognize distinctions that are integral to both human nature and social life. A moderate form of cultural relativism is a genuine intellectual achievement that helps combat ethnocentrism and allows one to better appreciate the full range of human experience. But criteria of meaning and truth are by no means entirely dependent upon cultural context. Our contemporary awareness of the “relativity” of cultures and historical experiences must be complemented by a robust appreciation of the universality of Reason and citizenship.

Resettling Refugees in Rural and Regional Australia: Learning from Recent Policy and Program Initiatives

Conscious policy and program support for the resettlement of refugees in regional and rural areas is a relatively recent trend in Australia. Resettlement is a complex process that hinges on the establishment of viable communities. This review suggests that its outcomes, especially for refugee communities, are potentially mixed. However, an appropriately resourced, well managed and well planned refugee resettlement program can potentially provide beneficial outcomes for refugees and host communities. This article draws on existing empirical data and contributions made at a VicHealth Roundtable in late 2007 to thematically explore the challenges facing rural and regional resettlement programs. Given that settlement is a dynamic process and the approaches to rural and regional settlement are evolving, this article provides 12 propositions for a more effective and integrated approach to policy and practice.
