新技术在网络洗钱中的应用及中国的应对

在网络洗钱的四种主要支付模式中,技术都发挥了不可或缺的作用。以网络银行、网络赌场和网络第三方支付平台为例分析网络洗钱的原理,介绍打击网络洗钱的主要风险管理手段,以及中国政府应对网络洗钱的举措。中国政府在预防和打击网络洗钱的立法层级、立法涵盖面,以及相应的风险管理手段的要求等方面还有改进的空间。     

信用证欺诈例外在我国的司法实践

本文通过介绍我国有关信用证欺诈例外制度方面相关法律,结合我国司法实践现状,对我国在审理有关信用证欺诈案件中存在的问题进行较为详细的分析,并提出改进建议,以完善我国在信用证例外制度方面的立法和司法。     

论恶意欠薪的入罪设置——评《刑法修正案（八）案》第四十一条

为了有效地保障劳动者获得劳动报酬的权利,2011年2月25日出台的刑法修正案（八）在第四十一条中明确将恶意欠薪行为纳入刑法的规制。但人们对这一条款的设置存在诸多争议,较为合理的解决“支付能力”的证明责任难、“政府部门责令支付”的限制不合理、“严重后果”的判定依据不统一等问题,建议将本罪设定为亲告罪并删除不当的罪状描述,同时修改“严重后果”的表述。     

肝豆汤合驱铜疗法对肝豆状核变性患者生活质量影响的前瞻性研究

目的观察肝豆汤合驱铜疗法对Wilson病(Wilsons disease,WD)患者生活质量的影响。方法共纳入135例WD患者,在二巯基丙磺酸钠强力驱铜治疗及青霉胺和二巯基丁二酸维持驱铜治疗的基础上,口服肝豆片。治疗前及治疗1年后分别采用WHO生活质量简表评价患者的生活质量,并观察总体疗效。结果与治疗前比较,135例WD患者治疗后WHO生活质量简表的生理领域、心理领域、社会领域、环境领域得分均显著提高(P0.01)。135例WD患者中,临床痊愈5例,显效33例,有效88例,无效7例,恶化2例,无死亡病例,总有效率达93.3%。结论肝豆汤口服合驱铜治疗可以明显改善WD患者的生活质量。     

Inequalities of Redress: Australia’s National Redress Scheme for Institutional Abuse of Children

ABSTRACT

The national redress scheme proposed by the Royal Commission into Institutional Responses to Child Sexual Abuse is unique and unusual in the world of government redress. It is unique with its inclusion of both care leavers and non-care leavers (it is the only government scheme to do so), and it is unusual in focusing on sexual abuse alone (18% of government schemes do). These unique and unusual qualities come at a price for justice. Care leavers and non-care leavers are different groups with respect to their experiences of abuse and social status as child victims. Unless these group differences are explicitly recognised in guidelines for the monetary payment, care leavers will be disadvantaged. Two corrective measures are proposed: adopting an inclusive understanding of sexual abuse in closed and open settings, and addressing the negative bias that may result from care leavers’ lower social status as children compared to that of non-care leavers. Their lower status is likely to affect (that is, devalue) judgements of the severity and impact of abuse.     

论住客遭第三人侵权的法律关系——以上海市首例被害人家属状告宾馆案为例

住客遭第三人侵权,宾馆不能免除责任。宾馆行为构成加害给付,形成违约责任与侵权责任的竞合。宾馆与歹徒对住客负不真正连带债务。     

论清偿抵充

2009年出台的最高人民法院《关于适用〈中华人民共和国合同法〉若干问题的解释(二)》首次规定了清偿抵充制度。然而,基于司法救急的原因,《合同法司法解释二》没有规定指定抵充。我国民法典应当按照《德国民法典》的债务人指定模式对指定抵充进行规定,同时,应当在《合同法司法解释二》相关规定的基础上,借鉴大陆法系国家和地区民法典关于清偿抵充的立法经验,进一步完善法定抵充制度。     

UNINTENDED CONSEQUENCES OF BARGAINING FOR ADOPTION ASSISTANCE PAYMENTS

Families that adopt children who are in foster care may receive monthly adoption assistance payments to offset the cost of raising the adopted child. The amount of the adoption assistance payment is the subject of bargaining between the family and the child welfare authority. This article uses a bargaining model to highlight factors that, in addition to the expected costs of raising the child, might influence the outcome of bargaining over adoption assistance payments. Findings indicate that married parents who adopt children already in their care have an advantage in bargaining, and single women who adopt their kin or foster children have a disadvantage in bargaining.     

我国督促程序的司法完善

我国民事诉讼法中的督促程序由于立法规定中的简略,在司法实践中存在着一些适用不明确的地方。最高人民法院通过两次对督促程序的司法解释完善了我国民事诉讼法中的督促程序。     

我国电子商务存在的问题及对策

当前我国电子商务存在着基础设施不足、物流配送体系不完备、电子支付安全性无法得以保障等问题 ,已严重影响了电子商务的健康发展。因此 ,改变我国的微观经济基础尤其是信用基础 ,改善电子商务的基本支持系统 ,加强税收征管和相关法律法规建设 ,对我国电子商务的发展有着非常重要的意义。
