大学生道德素质由道德认识、道德感情和道德意志构成。道德认识是道德行为和道德素质的指导因素、首要环节 ;道德情感是道德行为和道德素质的动力因素、决定性因素、基本环节 ;道德意志是道德行为和道德素质的过程因素、最终环节。     

Mobilising evidence in public policy: The contribution of the evidence provider

This article contributes to the conceptualisation of evidence‐based policy through providing a framework of the key factors that influence research utilisation, including those that shape the quality of evidence provided. We apply this framework to an analysis of public policy to regulate the remuneration of freight truck drivers to improve workplace safety in their industry. Recent policymaking concerning the regulation of truck drivers’ remuneration in Australia provides an opportunity to examine the quality and utilisation of research evidence by external evidence providers in opposing political contexts. This article suggests the need for informed and vigilant scrutiny of the contributions of evidence providers to government policymaking, particularly in the case of wicked policy problems about which there are sustained ideological differences that underpin problematisation, research interpretation, and conceivable policy solutions.     

Alternative South–South development collaboration? The role of China in the Coega Special Economic Zone in South Africa

Aid, in the form of financial aid and investment, has become increasingly prevalent in both bilateral and multilateral partnerships in the BRICS. In Africa, the Forum on China–Africa Cooperation provides the official framings for forms of development assistance to the continent, with financial forms of aid available through the New Development Bank and the China–Africa Development Bank (CADFund). This article explores how Chinese international development assistance has influenced South Africa's economic growth and development strategies and is reshaping South Africa as “gateway” to Africa and continental leader. Special economic zones (SEZs) have become a prioritised form of BRICS development collaboration particularly in terms of Chinese trade and investment expansionism into Africa through South Africa. Chinese international development assistance and foreign direct investment in South Africa in particular are very notable and have been strengthened during the Chinese official state visit prior to the Johannesburg BRICS Summit in 2018. The article critically analyses the development policy discourse on BRICS spearheading an alternative model of South–South international cooperation by examining the Coega SEZ in South Africa, hailed as the most SEZ in Africa. The article critically examines the development alternative potential of the Coega SEZ.     

市委书记个人特征与GDP增长关系的实证分析——基于GDP百强市10年1000份市委书记样本的数据分析

当前,经济发展面临较大的下行压力,各地GDP发展动能成为各方关注的焦点。GDP百强市何以傲视群雄,实现GDP高质高量的发展?除了传统的经济发展影响因素外,地方领导与地方经济发展是否存在一定关系?通过对2017年GDP百强市2008-2017年间1000份市委书记个人特征和GDP增长的平衡面板数据进行实证分析发现:市委书记晋升途径和GDP增长呈显著相关关系;市委书记年龄和任职市数量均与GDP增长呈“倒U型”变动关系,其中最佳任职年龄是54.68岁,最佳任职市数量是2.787个;市委书记的性别、学位、本科学校性质、基层工作经历与GDP增幅没有表现出显著相关关系。结合实证结果,提出了领导者选拔任用的政策取向。     

公安质量管理的标杆机制

公安服务水平和质量已经成为公民评价执政党与政府的形象与效率的日益重要的指标之一,如何提高公安质量,从体制或机制上确保公安产品的合法性与科学性,已经成为公安部门关注的热点。本文从质量管理机制的视角,引出公安质量管理的标杆机制,以期为我国提升公安质量起到支持作用。

马克思主义中国化是毛泽东思想和中国特色社会主义理论体系之源,是中国共产党安身立命之本。因此,从中国共产党的历史进程中去考察马克思主义中国化概念的演进与扩展就有着特别重要的历史意义和现实意义。     

文化遗产廊道构建的理论与实践——以滇藏茶马古道为例

文化遗产廊道是国际遗产保护界内专门针对大尺度、跨区域、综合性线状文化遗产保护的新思维与新方法。面对滇藏茶马古道屡遭破坏的严重事实,构建文化遗产廊道保护战略将茶马古道及古道上的遗产单体纳入区域性整体保护体系是极其重要且必要的。以遗产廊道理论为基础,文化遗产廊道在概念、内涵及建构模式方面形成自身的理论框架,在此框架下,须采取多项措施保障以滇藏茶马古道为对象而进行的文化遗产廊道的构建实践,以期为我国类似于茶马古道的线状遗产保护提供有效借鉴。     

环境公益诉权及其程序保障——以检察机关提起环境公益诉讼为视角

实践表明,我国保护环境的传统模式即行政执法方式是失灵的。当前,探索司法介入环境保护的新模式是必要的,而环境司法的首要问题就是环境公益诉权的问题。根据我国实际情况,赋予检察机关环境公益诉权不仅是必要的,而且是可行的。同时,还要探索检察机关在提起环境公益诉讼过程中的诉讼地位、处分权的规制、证明责任的分配、诉讼时效等程序机制,以达到既保障且诉权、又加以合理规制的目的。     

论自动驾驶汽车生产者的刑事责任

自动驾驶汽车是人类研发、制造、使用和管理的智能产品,不是犯罪主体或刑事责任主体。在自动驾驶汽车自主控制状态下发生交通事故的,其生产者、使用者和其他人员难以按照我国现有刑法的罪名定罪处罚。除非道路交通安全法和刑法有专门的规定,驾驶位人员不接管汽车或接管后无力改变交通事故结果的,不构成交通肇事罪或其他管理过失犯罪。驾驶位人员的注意义务是阻止自动驾驶汽车自主控制下发生交通事故,其注意义务不应过高。允许的风险、紧急避险理论不能为自动驾驶汽车紧急路况处理算法的生产与应用提供合法、合理的解决方案,生产者遵守算法安全标准仅可以使生产行为合法化。鉴于现行刑法不适应自动驾驶汽车应用的特性,我国应当建立以生产者全程负责为中心的新刑事责任体系,使之在自动驾驶汽车生产和应用两个阶段承担安全管理责任,生产者拒不履行自动驾驶汽车应用安全管理义务且情节严重的,应当承担刑事责任。     

The political effects of referendums: An analysis of institutional innovations in Eastern and Central Europe

Theory suggests that the political effects of referendums should vary according to the institutional provisions that allow for direct involvement of citizens in decision-making. Relying on extant theoretical models the paper proposes initial tests of some implications for the newly democratized countries in Eastern and Central Europe. The constitutions of these countries distinguish themselves by a wide variety of institutional provisions for referendums. Taking advantage of this increased variance, the paper demonstrates effects of different institutional provisions on policy outcomes, which, so far, have only been demonstrated at the sub-national level, for example, in the United States and Switzerland.
