Racial disparities in court dispositions and sentences might reflect systemic biases toward minorities, but they might also stem from race group differences in legal or other extra-legal factors linked to a defendant’s risk for future criminality. Analyses of over 5,000 felony defendants from an urban Ohio jurisdiction revealed that significant main effects of a defendant’s race on release on one’s own recognizance (ROR), bond amounts, and prison sentences were rendered nonsignificant when controlling for legal factors, such as offense severity. Analyses of interaction effects, on the other hand, revealed that African American males age 18–29 experienced lower odds of ROR, higher bond amounts, and higher odds of incarceration in prison relative to other demographic subgroups, even with the inclusion of rigorous controls for legally relevant criteria. The relevance of these findings for understanding disparate treatment at different stages of case processing is discussed.  相似文献

This article examines how out-group perceptions among Asian Americans, blacks, Latinos, and whites vary with the racial composition of their surroundings. Previous research on the contextual determinants of racial attitudes offers mixed expectations: some studies indicate that larger percentages of proximate out-groups generate intergroup conflict and hostility while others suggest that such environments promote interracial contact and understanding. As most of this research has been directed at black-white relations, the applicability of these theories to a multiethnic context remains unclear. Using data that merge the 1992–1994 Multi-City Study of Urban Inequality and 1990 Census, we find that in neighborhood contexts, interethnic propinquity corresponds with lower levels of out-group prejudice and competition, although intergroup hostility is higher in metropolitan areas with greater minority populations. Further tests suggest that these results do not occur from individual self-selection; rather ethnic spatial and social isolation bolster negative out-group perceptions. These findings suggest the value of residential integration for alleviating ethnic antagonism .  相似文献

The conventional wisdom in public opinion research suggests that the white public views government spending as a single race-coded issue. This article develops an alternative theory that rests on two propositions. First, the white public sees government spending not as a single issue, but rather, as two distinct issues: spending on the deserving poor and spending on the undeserving poor. Second, political sophistication strengthens the impact racial stereotypes have on attitudes toward spending on the undeserving poor, and it does not affect the relationship between stereotypes and attitudes toward spending on the deserving poor. These hypotheses are tested using data from the 1996 and 1992 NES surveys. The empirical results provide strong support for both propositions.  相似文献

Nearly half a million children are victims of abuse and neglect and part of our foster care system. Over time, many of these youth cross into our juvenile and then adult justice systems; some will end up as federal offenders, immersed in a process where mandated penalties provide little room for flexibility or consideration of the characteristics and needs of the individual. This article will offer the perspectives of a former prosecutor and child welfare advocate on: (i) the current conditions and challenges within our foster care system—the feeder for many youth into gangs and criminal activity; (ii) the misaligned priorities and disheartening patterns we currently see in our justice system; and (iii) the ill‐advised practices, that set our nation apart from the rest of the world, allowing juvenile offenders to receive life without parole sentences. The article will then discuss a series of recommendations in all of these areas that would enable us to turn the corner and chart an improved and more hopeful path for our nation's vulnerable and at‐risk children and youth.  相似文献

Relatively few studies have assessed theoretically relevant predictors of individual’s perceptions of racial profiling by law enforcement officers. The current study addresses this limitation by drawing on theoretical frameworks highlighted in the growing body of literature examining disproportionate minority contact (DMC) with the criminal justice system. Specifically, we draw on the racial and symbolic threat perspectives with the objective of identifying theoretically relevant individual and community level predictors of perceptions of racial profiling by public and private police bodies in airports, malls, and on the roads. Results of our analysis of data on White and Black individuals nested within communities support the racial threat perspective in documenting the influence of racial heterogeneity and interracial labor market competition on perceptions of racial profiling. However, in contention to predictions derived from the symbolic threat perspective, the results fail to uncover a link between interracial socioeconomic inequality and perceptions of racial profiling by law enforcement officers. These results highlight the importance of moving beyond individual explanations of profiling and other forms of DMC and suggest community characteristics and perceptions of intergroup threat are particularly salient to understanding perceptions of race-based distinctions in formal social control.  相似文献

This paper explores punishment philosophy and practices in the United States from a critical criminological perspective, utilizing a racial capitalism framework to illustrate forces that impede prison abolition. The paper examines historic and contemporary punishments implemented against ‘others’ to show how such practices help to sustain white capital accumulation and white privilege. The paper also discusses a number of the individual social-psychological theories that assist in the maintenance of that system. Finally, the paper calls for the eradication of racial capitalism through a stronger revolutionary consciousness.  相似文献

Recent studies evince that interpersonal racial discrimination (IRD) increases the risk of crime among African Americans and familial racial socialization fosters resilience to discrimination's criminogenic effects. Yet, studies have focused on the short‐term effects of IRD and racial socialization largely among adolescents. In this study, we seek to advance knowledge by elucidating how racialized experiences—in interactions and socialization—influence crime for African Americans over time. Elaborating Simons and Burt's (2011) social schematic theory, we trace the effects of childhood IRD and familial racial socialization on adult offending through cognitive and social pathways and their interplay. We test this life‐course SST model using data from the FACHS, a multisite study of Black youth and their families from ages 10 to 25. Consistent with the model, analyses reveal that the criminogenic consequences of childhood IRD are mediated cognitively by a criminogenic knowledge structure and socially through the nature of social relationships in concert with ongoing offending and discrimination experiences. Specifically, by increasing criminogenic cognitive schemas, IRD decreases embeddedness in supportive romantic, educational, and employment relations, which influence social schemas and later crime. Consonant with expectations, the findings also indicate that racial socialization provides enduring resilience by both compensating for and buffering discrimination's criminogenic effects.  相似文献

Although considerable research on psychopathy has been conducted over the past 30 years, relatively few studies have examined key issues related to potential ethnic differences in this constellation of socially maladaptive personality traits. Given recent sociopolitical and scientific developments, an issue of considerable debate is whether Black individuals possess "more" traits of psychopathy than do Whites. To address this issue, a meta-analysis of differences between these groups' scores on the Psychopathy Checklist--Revised (PCL-R; Hare, 1991) was performed, using 21 studies (N = 8,890) of correctional, substance abuse, and psychiatric samples. Blacks exceeded Whites by an average of less than 1 point on the PCL-R total score. Effect sizes for core interpersonal and affective traits of psychopathy (Factor 1) were sufficiently homogeneous to clearly interpret, although other features manifested statistically significant heterogeneity. Our finding that Blacks and Whites do not meaningfully differ in their levels of core psychopathic traits is consistent with community-based findings for self-report measures of psychopathy and clinical diagnoses of antisocial personality disorder.  相似文献

   In response to community demands, case settlements, and state laws concerning racial profiling, police departments across the nation are collecting data on traffic stops. While the data collection is rapidly moving forward, there are few if any agreed upon methods for analyzing the data. Much of the attention has been on benchmarks for the race distribution of stops and searches. Little empirical work has advanced our understanding of the influence of race in the post-stop activities of police. The present study proposes a propensity score technique to determine the extent to which race bias affects citation rates, search rates, and the duration of the stop. Adjusting for confounding variables using the propensity score offers an alternative to multivariate regression that is more interpretable, less prone to errors in model assumptions, and ultimately easier to present to stakeholders in policing practices. An analysis of traffic stop data from the City of Oakland, California demonstrates the process, presentation, and interpretation of the results that the methodology produces. Ultimately, the study addresses the extent to which race plays a role in officers’ use of discretion.
