检察机关参与社会管理创新的路径--以法律监督实践为视角

社会管理与检察工作密切相关,既是检察机关履行职责的重要内容、发挥职能的重要领域,也是检察机关必须承担的重要社会责任。检察职能具有多样性,参与加强和创新社会管理的路径也有多种。根据法律规定和检察实践,以执法办案为依托,完善检察环节的各项工作机制,配合相关部门深化犯罪预防、制发检察建议、完善行政执法与刑事司法衔接机制、参与社会管理综合治理、参与“两新组织”和虚拟社会的服务管理,是检察机关参与社会管理创新的有效路径。     

Mapping the effects of Brexit on legal education in Wales: proposals for addressing students’ concerns

ABSTRACT

Whilst the future for UK–EU relations remains to be realised, Brexit will have consequences for legal education. However, to date, neither the UK nor Welsh Governments have sufficiently addressed what those consequences will be for higher education. This paper, which documents the results of 336 student questionnaires received from law students surveyed from every law school in Wales, evidences that learners have already started to decide what they believe Brexit means for them. Amongst the numerous challenges for Welsh law schools is the opinion of current students that Brexit makes Wales a less attractive place for overseas students and lecturers, both EU and other internationals, to study and work. Meanwhile UK students studying in Wales are questioning the relevance of EU law modules, and are viewing aspirational careers within EU institutions as now being “closed doors”. By drawing upon our findings, as well as comparisons with other EU Member States, this paper proposes six areas where urgent collaboration between governments and universities is needed. Failing to address the concerns identified by this research has the potential to further threaten the internationalised education model that UK students benefit from by studying law at Welsh universities.     

Key agent and survivor recommendations for intervention in honour-based violence in the UK

This paper concerns recommendations for intervention in honour-based violence (“HBV”) as recommended by individuals who face such violence in their everyday lives. Utilising data extracted from interviews conducted with 30 key agents and 8 South-Asian female survivors in the UK, this paper will argue that UK public agencies are struggling to cope with how to respond to HBV. This is despite the UK government recognising shortcomings in the support for victims in the House of Commons Home Affairs Committee report in 2008. In particular, participants identified that (a) the police, healthcare, and social services are particularly poor at supporting victims; (b) public sector workers require appropriate training and awareness on HBV; (c) education on HBV and forced marriages is absent in schools, colleges, and universities; and (d) more needs to be done to engage and educate communities about HBV and where victims can access support.     

论涉警突发事件中警察应对媒体的方法和建议

新媒体的出现和广泛应用颠覆了传统的信息传播模式,在面对公共事件特别是涉警突发事件时,公安机关及人民警察应该努力做到转变思维,创新工作方式和方法,从传统的应对模式转变到积极主动面对媒体、有效引导舆论、树立和维护警方的整体形象上来。本文概括性的说明了新时期媒体的发展现状、特点和趋势,强调了涉警突发事件中公安机关及人民警察积极应对媒体的重要意义,同时重点指出了警察应对媒体的建设性建议和方法。     

刑事诉讼量刑程序改革问题新探

最高人民法院等五部委于2010年10月1日签发量刑程序司法解释文件,确立＂相对独立量刑程序＂,规范检察院＂量刑建议＂工作,明确未成年人案件＂社会调查报告制度＂等,具有重要意义。然而,我国刑事审判采用＂案卷笔录中心主义＂,法官难以形成当庭决断,且量刑信息调查受多种因素制约,难以保证客观公正。此外法院检察院关于具体量刑处置的争议,尚无明确的解决思路,这都影响量刑程序改革实施效果。文章通过分析量刑程序改革中可能存在的不足,挖掘其进一步变革空间,并提出改进建议,以期能为量刑程序改革有所裨益。     

Committee Inquiries in the Australian Parliament and their Influence on Government: Government Acceptance of Recommendations as a Measure of Parliamentary Performance

Committees in the Australian parliament often make recommendations to government and attempt to persuade the government to accept them. Using a sample of committee reports tabled between the 2001 and 2004 elections, this paper measures the government acceptance of committee recommendations as a proxy for committees' influence. On average, the government stated it accepted three majority recommendations out of 11 per report, although this figure drops to two and a half when viewed as recommendations implemented and not merely promised. The government accepted virtually no minority recommendations. The most important report characteristic is the extent to which it affects the government's reputation, but the breadth of political support that it can muster is also relevant.     

从权力来源的角度看乡村基层党组织选举方式的创新

近年来，中国大陆的乡村基层选举开启了基层民主化的进程，出现了“公推直选”“两推一选”“公推竞选”“两票推选，交叉兼任”等形式多样的选举方式。基层党组织把这种选举方式引入到党的换届选举中，引起了学术界的关注。本文从权力来源的角度分析基层党组织民主选举方式的创新。     

民事诉讼法的修改与民事检察制度的发展

1991年民事诉讼法确定了民事检察制度,但由于法律规定过于原则,民事检察制度的发展十分缓慢。2007年10月民事诉讼法的修改,完善了审判监督程序,细化了检察机关的抗诉理由,明确了再审法院和法院裁定的再审期限。这次修改推动了民事检察制度的发展,但仍未从根本上解决民事检察制度存在的弊端。本文从审判监督程序修改内容及对民事检察工作所带来的影响入手,分析现行民事检察制度的不足,并对我国民事检察制度的发展进行粗浅的法律构想。     

村寨经济体系下和谐劳动关系的政策构建与操作实务 —— 以贵州乡村地区为例

基于战略劳动关系管理的理论框架与构建和谐劳动关系的价值导向,聚焦以中国贵州乡村地区(特别是民族村寨地区)本地产业发展中所呈现的劳动关系问题。在"村寨经济"这一全新的产业分析框架下,提出村寨经济劳动关系中的传统价值因素。这些传统价值因素不仅使村寨经济劳动关系不同于经典劳动关系,也不同于农民工、农村用工的概念范畴,即便与以非标准与灵活就业为特点的、互联网共享经济时代下的新用工理念也并不契合,而需要一套全新的分析框架与实务规范。研究结合贵州乡村地区企业案例,认为村寨经济企业要发展必须尊重并容纳这些传统价值因素,并据此提出在村寨经济的发展中构建和谐劳动关系的政策建议与操作实务。     

论我国患者隐私权的法律保护——以侵犯患者隐私权的民事责任为视角

近年来,患者在医院就诊被侵犯隐私权的现象频繁发生,继<侵权责任法>第62条直接将侵犯患者隐私权的情况纳人到医疗损害赔偿范围之后,患者隐私权纠纷成为医疗纠纷的另一热点诉讼.本文试图通过一则真实案例分析我国现有的患者隐私权法律保护状况,并同时提出一些其他对策和建议.
