被遗忘的权利———社交网站引发的隐私权规制困境与对策研究

随着社交网络时代的到来,人们开始在现实世界里运用互联网、以数字化方式建立人际交往关系、表达和传递自己的个人信息.互联网这一“第四媒体”在生活中的悄然融入,虽然为人们提供了一个“共享信息、展示自我”的平台,但由此引发的隐私过度暴露问题却不容小觑.鉴于社交网站所引发的隐私争议,以语境完整性理论的视角分析争议背后的隐私风险与规制困境,在借鉴域外保护隐私权的成功经验基础上,探讨我国保护网络隐私权的有效机制,以期为网络隐私权保护的实践运作提供理论参考.     

食品监管渎职罪解析

《中华人民共和国刑法修正案（八）》针对食品安全监管漏洞增设了“食品监管渎职罪”,用于督促和惩治食品安全监管过程中的渎职行为.认定“食品监管渎职罪”的关键在于把握其构成要件和法条竞合时的适用原则这两方面,然而英罪名和法定刑仍须完善.     

新媒体发展对大学生思想表达的影响

新媒体已成为中国社会文化生活的中心和推进中国社会成长的新力量。而新媒体传播机制的渗透性、舆论生产方式的煽动性、组织动员的误导性以及对接方式的虚拟性对大学生的思想表达产生了一定的负面影响。因此,在新媒体环境下如何占领新媒体舆论高地、健全高校新媒体的信息监管机制、培育新媒体中的高校意见领袖团队,多角度利用新媒体对大学生进行思想引导和道德培养,本文提出了一定的对策。     

The ‘Regulatory State’ in Higher Education: Assuring Quality through New Modalities of Control in Brazil

The Brazilian Higher Education (HE) sector, following a global trend of rapid transformation, has undergone marked changes over the past two decades. These changes have involved the design of quality assurance tools as instruments for regulatory governance. In presenting an overview of the recent history and characteristics of quality assurance in the Brazilian HE sector, this paper contextualises the Brazilian experience according to broader conceptual frameworks and discusses how and why regulatory governance in this sector has so radically changed.     

俄罗斯农业信贷合作社监管机制研究

苏联解体后,俄罗斯农业信贷合作社发展速度非常快,从最初1996年注册的8个增加至2012年的1 847个.农业信贷合作社在农民经济中发挥着越来越重要的作用,已经成为农户、小农业企业获得贷款的主要来源之一.如今俄罗斯已经初步形成了对农业信贷合作社从国家层面、行业层面到自身监管多层次、立体的监管体系.     

Driving growth: Regulatory reform and expressways in Indonesia

This article uses the case study of Indonesian governments' attempts to construct a 1,000 kilometer toll road through the densest parts of Java to shed light on how governments with a checkered past of enforcing contracts and protecting private property rights go about establishing the requisite regulatory framework to attract private investment for infrastructure. While regulatory reform has taken place in Indonesia, vested interests and power will keep the country's political economy from taking on World Bank-promoted best practice characteristics. Programs that promote private sector participation in infrastructure need to be reconsidered where the main ingredients for these programs' success exist in small measures.     

我国保安监管体系的营造与完善

中国保安业已走过22年的风雨历程,发展迅速、成绩喜人,创造了很好的社会效益和经济效益,成为新兴的朝阳产业。而保安业现有的监管体系中存在的缺陷和问题在一定程度上限制了保安业的发展。为寻求保安业的进一步突破性发展,营造和完善符合我国社会主义市场经济规律的保安监管体系已势在必行。     

Tracing and periodizing China's food safety regulation: A study on China's food safety regime change

How has China's food safety administrative system changed since it was founded in 1949? How can we periodize the process of this historical transformation in terms of regulators, regulatees, and regulatory tools? This review article offers an analytical framework that distinguishes three regimes in the history of China's food safety governance: an old regime of command and control (1949–1977), an intermediate regime of mixed instruments (1978–1992), and a new regime of regulatory governance (1993–ongoing). In the article the regimes' features, advantages, disadvantages, and development tracks are discussed, and the groundwork is laid for an analysis of China's emerging regulatory state. Finally, a new notion of “transitional regulatory state” is used to define the current Chinese regulatory state based on its food safety regulation.     

Information, Interests, and Environmental Regulation

This study contributes to the understanding of informational approaches to bringing about compliance with environmental regulations with particular attention to differences in the influence of information provided by different information sources. Based on theorizing from a combination of information processing and interest group literatures, we develop hypotheses about regulatees' reliance upon and the influence of different sources of information. We test these hypotheses for Danish farmers' compliance with agro-environmental rules. Our findings show that information plays a role in bringing about regulatory compliance, but its influence is not as strong and is less direct than might be thought to be the case. In addition, we show that not all information sources have the same influence. The findings demonstrate that interest groups have important roles in information provision and legitimization of policies that have often been assumed in the literature but have rarely been empirically examined.     

Salt,high blood pressure,and performance‐based regulation

Performance‐based regulation is a new approach to public health promotion. The aim of this article is to explain how this idea might be applied to the public health goal of reducing salt consumption as a way of reducing high blood pressure and thereby saving lives. Performance‐based regulation is compared with competing regulatory strategies.
