无直接利益诉求的群体性突发事件具有偶然的触发性、参与者无直接利益诉求性、成员无组织性及群聚群散性的特征.无直接利益诉求的群体性突发事件的引爆,并非源于偶然的事件,而是经济社会在非协调发展中长期积累下,遭遇偶然事件而必然发生的结果.要有效治理无直接利益诉求群体性突发事件的关键在于:一是必须保障公民在利益博弈过程中享有充分的谈判权、表达权、知情权:二是政府必须转变传统的治理模式;三是要强化地方政府应对无直接利益诉求的群体性突发事件的处置能力.     

Property Rights and Game-Theory Implications of Satellite Communications: The Bilateral Case of Greece and Russia

In this paper we examine the actual legal situation concerning the attribution of geostatic positions and frequencies and the problems of frequency interference by other satellites due to not fully clear property rights. We analyze the property rights setting governing satellite communications and review the implications of the Coase theorem of these rules through a game theoretical approach between two players: Russia and Greece (Hellasat commercial communication attempt). The basic finding, in accordance with the theorem's prediction under non-zero and possibly high transaction costs, is that the end result may be sub-optimal due to the inappropriate present specification of property rights, leading either to non-use of scarce resources, or to total over-investment.

公共利益：一个需要界定的行政法原则

公共利益,作为一个行政法的基本原则,其特定的法律内涵有两个方面的层次,一个是相对于个体利而言所具有的内容,即机会均等、公平竞争、资源共享和社会福利;另一个是功能性内容,即通过行政管理调节利的再分配。与此相应,公共利益应当具有以例举式与概括式相结合为特点的法律形式和通过一定条件下的“博弈”程获得实现的方式。     

The formation of an international environmental agreement as a two-stage exclusive cartel formation game with transferable utilities

We construct a two-stage exclusive cartel formation game with utility transfers to model the formation process of an international environmental agreement. Our results show that in the first stage of low degree of consensus, engaging in utility transfers by asymmetric countries will accomplish little. In contrast, in the second stage of higher degree of consensus, it is more likely for asymmetric countries to engage in monetary transfers to form the grand coalition, particularly if a small stable coalition has already been formed in the first stage. This article therefore provides a theoretical perspective to explain why it is more likely for some developed countries to initiate an IEA formation process by forming a small stable coalition first before engaging in monetary transfers to form the grand coalition with all the other countries. Such a perspective is consistent with the historical development of the Montreal Protocol and may also explain the difficulty for asymmetric countries to form the grand coalition at the beginning of the IEA formation process of the Kyoto Protocol.
